HomeMy WebLinkAbout20032887.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING COMPLIANCE WITH CONDITION F OF RESOLUTION DATED APRIL 9, 2003, AND REQUEST FOR INCREASE IN OCCUPANCY NUMBERS - RJML, LLC, DBA LA MARAVILLA RESTAURANT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #2003-0955 on April 9, 2003, the Board of County Commissioners lifted the Temporary Summary Suspension of the Hotel and Restaurant Liquor License issued to RJML, LLC, dba La Maravilla, and WHEREAS, Condition #F of said Resolution states, "That a temporary Certificate of Occupancy be issued by the Weld County Building Inspection Department, for a period not to exceed 180 days, with the requirement that by the end of such 180 day period, the Licensee must receive a permit for and have installed a new septic system for the licensed premises, sufficient to handle increased capacity and/or a requirement by the State of Colorado Department of Public Health and Environment for the installation of a reverse osmosis system on the water system, or have amended the Department of Planning Services Site Plan for the licensed premises to reflect the limited occupancy for both the area where food service is to occur and the dance hall portion of the license premises, and any other necessary service capacity limitations, such as limited hours of operation and/or methods of food service", and WHEREAS, RJML, LLC, dba La Maravilla Restaurant has requested an increase in the occupancy numbers for the establishment, and WHEREAS, after review, the Board deems it advisable to extend Condition #F of said Resolution for 180 days, thereby extending the Temporary Certificate of Occupancy for 180 days with the current capacity limitations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Temporary Certificate of Occupancy be, and hereby is, extended for 180 days, with the conditions, requirements, and limits stated in the original Temporary Certificate of Occupancy, including, without limitation, Condition #F stated above, to remain in full force and effect. A copy of the April 9, 2003, resolution is enclosed. The Board's consideration of this matter will take place in the First Floor Meeting Room, Weld Centennial Center, 915 10th Street, Greeley, Colorado. As we discussed by telephone on Tuesday, October 7, 2003, Condition F. requires the following: "F. That a temporary Certificate of Occupancy be issued by the Weld County Building Inspection Department, for a period not to exceed 180 days, with the requirement that by the end of such 180 day period, the Licensee must receive a permit for and have installed a new septic system for the licensed premises, sufficient to handle increased capacity and/or a requirement by the State of Colorado Department of Public Health and Environment for the installation of a reverse osmosis system on the water system, or have amended the Department of Planning Services Site Plan for the licensed 2003-2887 Letter, Ruben J. It is my understanding from our discussion and from my conversations with representatives of the Weld County Department of Public Health and Environment("the Health Department") that RJML has not as of this date received a permit for or installed a new septic system on the La Maravilla property. Therefore, in order to comply with the requirements of Condition F., prior to the expiration of the Temporary Certificate of Occupancy(October 17, 2003), RJML must have ". . . amended the Department of Planning Services' ("Planning Services") Site Plan for the licensed premises to reflect the limited occupancy for both the area where food service is to occur and the dance hall portion of the license premises, and any other necessary service capacity limitations, such as limited hours of operation and/or methods of food service." To amend the site plan in this fashion, RJML must provide to Planning Services a letter consenting to the limited occupancy and other service capacity limitations. The Mylar Site Plan plat must also be- amended to include a note detailing such limitations. In our conversation, you mentioned that RJML may wish to request that the Board of County Commissioners increase the occupancy numbers for the La Maravilla. To make such a request, you must do so in a letter to the Board of County Commissioners. I suggest that such a writing be received by the Board prior to October 15`s. At a minimum, I also suggest that you be prepared on October 15th to submit to Planning • Services the letter to amend the Site Plan so as to comply with Condition F. Planning Services will most likely grant you no more than ten (10) days thereafter to submit the revised Mylar Site Plan plat. Si ly, uben Ro guez Lemorandum To: Bruce Barker From: David Tuttle Date: 10/13/2003 Re: La MaraVilla This is a summary of the activity at La MaraVilla with respect to the number of patrons observed in the bar. On Sat night,August 23`d,Deputy Mercer did a Bar check at La MaraVilla for the purpose of assessing the capacity of the crowd. He stated that they did not appear to be over capacity and there were no problems noted. Since that time,he has been in the bar nearly every weekend and said that on Thursday and Sunday nights,they have approximately 80 to 150 people in the bar at maximum. On Friday and Saturday nights,they usually have a crowd that is near capacity. He would estimate either just under or just over capacity. On some of those nights, it is crowded and difficult to walk through the bar. He has noted that the management is using a manual counter and that on Friday and Saturday nights, there is almost always a line waiting to get in the bar. As one person leaves,another is allowed in the bar. Since there is no way to physically count the number of patrons in the bar,one can only estimate whether or not they are overcrowded or if they are properly monitoring their capacity and keeping it at the limit or under. When the officers are present, they demonstrate the use of the counter and admit patrons on a one for one exchange. From this, one can only assume that they are managing the size of the crowd and are in compliance with the capacity limits. Commander Martin stated that he was in the bar on two occasions earlier in the summer of 2003. On both of those occasions,the management was using a manual counter and there was a line outside the bar. Patrons were admitted on a one for one exchange. Deputy Mathews stated that on 10-03-03,there was a verbal confrontation between 5 customers. All five customers were visibly intoxicated. Deputy Mathews told security personnel that those five customers should not be served any more alcoholic beverages. Mathews stated that security personnel complied with his request and told the men they could not be served any more that night. On October 4th,Deputy Mathews noted a very large crowed,possibly over capacity,and stated it was difficult to walk through the crowd. Deputy Mathews again checked the bar capacity on Friday,October 10th and stated that he estimated the crowd at 350 persons. On Saturday night, he estimated there were 400 to 450 persons in the bar with an estimated 80 individuals waiting in line outside to enter. He stated that there were 5 persons inside the bar who were obviously extremely intoxicated. He did not note that they were being served any more alcoholic beverages. He also charged one person inside the bar with M.I.P. On Sunday night he noted there were approximately 250 persons inside the bar when he checked on the capacity. The only estimate of any over crowding is on the 11th of October, last Saturday night. From all accounts,the management has a system in place that is designed to keep the crowd from exceeding the capacity. When Deputies are present,they are using the system and there is no way to determine if their count is correct or if they have exceeded capacity. (CHURCH) has conducted an assessment of the existing onsite wastewater system COWS) with respect to daily sewage flows produced at the subject site. This assessment is based on the water use data provided by you and a previous evaluation report of the OWS by others. Th.e physical condition of the existing OWS or characteristics of wastewater at the subject site were not evaluated by CHURCH. Site Conditions; The site is an approximate 3.4-acre parcel of land located at the northeast comer of Colorado State Highway 85 and Weld County Road 16. A site visit was conducted on October 13,2003. At the time of the site visit, it was observed that the existing leach field area was paved with asphalt pavement.Drain field observation pipes were not observed. Therefore,the condition of the existing drain field was not determined. It is understood that municipal sewer maybe near the subject site in the next few years pending on future development in the area. Water is provided by an onsite well. Current Operations: It is understood that the restaurant has a temporary certificate of occupancy that will expire in October 2003,which allows for a maximum of 60 seats in the restaurant serving 158 meals per day and 350 people per night in the dance hall, The restaurant currently operates with paper service from 11:00 am to 7:00 pm,seven days a week. The dance hall operates from 8:00 pm to 1:30 am on Thursday to Sunday every week. It is understood that you wish to increase the capacity of the Dance Hall from 350 people per night to 600 people per night, if possible. It is understood that the current maximum capacity of the dance hall per local building and/or fire department regulations is 752 people. The dance hail capacity is currently limited by OWS capacity. Existine QWS: The existing OWS consists of septic tanks and a 3740 square-foot drain field. The existing OWS was permitted under Weld County permit No. SP-9700328 and is at least 10 years old. A copy of this evaluation is presented in Appendix A. The results of this evaluation were used in establishing the limits of temporary certificate of occupancy. A sewage flow of 1727 gallons per day (GPD) was determine by High Plains to the average daily sewage loading for the drain field. This was in part based on a 15 minutes per inch percolation rate. High Plains Engineering proposed addition septic tank capacity be installed, which has been completed. You informed us the existing OWS has functioned adequately, and no surfacing of effluent or backups of the sewer line have occurred. Water Usage: Water usage has been monitored by you from May 2003 until present The water use data is presented in Appendix B.Based on the data provided,peak usage is during the periods when both the restaurant and dance hall arc in operation,particularly during the weekends. The average water usage for both the restaurant and dance hall ranged from about 1000 to 1200 gallons per day, or 58% to 70%, respectively, of the average daily sewage load capacity mentioned above. The number of meals sold during the month of July was also provided for the peak periods of the month which ranged from. 63 to 94 meals per day with an average of about 80 meals per day.This is approximately 50% of the permitted meals allowed per day. • Conclusions: Based on this information it appears that the existing OWS drain field is being utilized at 60% to 70% of its average daily loading capacity. It also appears that if the dance hall capacity were increased and if the restaurant were to serve the maximum meals currently permitted, the average daily sewage flow of 1727 GPD may be exceeded. Therefore, it may be possible to increase the capacity of the dance hall provided the meals permitted were reduced. Considering that approximately 500 gallons of additional sewage could be produced to achieve the average daily flow of 1727 GPD and based on 2 gallons/person/day for the dance hall, the capacity of the dance hall could he increased to by 250 people to 600 people/day. The number of meals permitted per day should be reduced to 80. Wastewater strength testing should be performed to assess the wastewater characteristics. High-strength wastewater being discharged to the drainfield will reduce its performance and service life. Drain fields placed under pavement may also be subject to a shortened performance life due to reduced oxygen transfer. Ike-treatment or secondary treatment may be required, if the long-term performance of the drain field is desired. Limitations: The conclusions developed for this assessment were based on the water use data provided by you and the information presented in the High Plains Engineering evaluation. This assessment should not be considered as a performance evaluation of the existing OWS or as an estimate on the performance life of the existing drain field. Excavations into the drain field would be required to assess its current condition and for the presence of biomat material. Water usage,the number of meals served and number of people using the restaurant and dance hall on a daily basis should be recorded. If water usage exceeds the average daily loading capacity of the drain field, water use reduction measures should be implemented or the number of people allowed in the dance hall reduced. The existing absorption bed is adequate for a restaurant serving a maximum of 158 meals perday with paper service, with maximum occupancy of 50 patrons seated at tables and 10 patrons at the cocktail bar in the restaurant. The restaurant will be open from 11:00 a.m. to 7:00 p.m. The dance hall will have an occupancy load of 350 patrons. The existing septic field is sufficient to handle the designed flows from the facility. The existing 1000-gallon septic tank will be used as the grease trap for the kitchen. A. 1000-gallon septic tank will be added for the kitchen flows, (see diagram). The bathroom waste will be run through 2-proposed 1500-gallon septic tanks and the existing 1250-gallon grease/sand trap, • Which will be used as a septic tank. The water well will run as is for the next six (6) months while the nitrates are being tested. A reverse osmosis system may be added if required at a later date. The wastewater from the R.O. system will be collected in a separate tank so the septic system will not be affected by the in-efficiency of the R.O. system.
