RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT #53 -AURORA DAIRY
CORPORATION, CIO AGPRO ENVIRONEMENTAL SERVCIES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 10, 1970, the Board did approve Special Review
Permit#53 for a Feedlot Operation for Albert D. Kurtz, said property presently owned by Aurora
Dairy Corporation, c/o AgPro Environmental Services on the following described real estate, to-
wit:
NE1/4 of Secton 30, Township 3 North, Range 67
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Aurora Dairy Corporation, do AgPro
Environmental Services, 4311 Highway 66, Suite 4, Longmont, Colorado 80504, to vacate said
Special Review Permit#53, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Review Permit#53 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of August, A.D., 2003.

MEMORANDUM

SUBJECT: Request for Vacation of Special Use Permit 53 (SUP 53)
Request: AgPro Environmental Services on behalf of Aurora Dairy Corporation is
requesting that SUP 53 be vacated. This is condition of approval item 1.1
in the resolution approving USR-1405 for a 2,500 milking cow dairy that
was approved by the Board on June 25, 2003. At that hearing, the Board
agreed to waive the requirement that the property owner or
representative submit a letter requested the vacation of SUP 53.
SUP 53 Background: SUP 53 was approved by the Board of County Commissioners on June
10, 1970. It is located in part of the NE4 of Section 30 T3N R67W. SUP
53 allowed for the expansion of an existing feedlot facility. No specific
limit on the number of cattle allowed is stated in the resolution of approval
for SUP 53. The boundaries for SUP 53 are located in the same area as
USR-1405.
The Department of Planning Services is in support of this request.
