Dear Sir:
I was in your office several days ago researching items relating to The Elms Community
Association a planned community located off of Weld County Road 5.5. One of your
approval documents specifies that property will be annexed into the Association
immediately upon being sold.
I talked with Mr. Morrison in the legal division to get a preliminary interpretation of what
the word "sold" means in respect to annexing the 3r° filing property at The Elms at
Meadowvale. His thoughts were that the property would be"sold"when a homeowner
bought the property.
The Elms Community Association would like to have a written legal opinion regarding
this issue. We don't want to argue the legal opinion before it is rendered by your legal
department, but we would like to present a few observations regarding this issue:
. In the first and second filings,the property was immediately annexed into the
Association when the property was sold to the builder.
. If the "Sold"provision means the buyer must live on the property,then what is the
interpretation when the same property in the development is sold multiple times to
different builders?
. Also the Association is required to provide, services and maintenance to the sub-
division, such as electricity, snow removal, open space mowing and general cleanup.
The Association is also required to provide irrigation water to the 3`a filing. This puts an
unfair and costly burden on the Association to provide these services without dues
payment from the property owners.

Dear Sir:
The Filing for phase I &II for The Elms at Meadowvale indicated the Mail Center would
be landscaped with a half circle of trees/shrubs between the mail center and Pearl Howlett
Drive. The mail center area is completely covered with concrete or black top. I have
enclosed a photo of the area.

Dear Sir:
The Elms Community Association has recently discovered that the main water line and
the fire hydrant water line installed by the developer to serve The Elms community (sub-
division I & II) has been co joined after passing through two separate meters.
This single line is then co joined with the fire hydrant water line servicing the
Meadowvale Farms complex.
This has the effect of reducing the potable water to the residents of The Elms Community
when a fire or break in the fire hydrant water serving the Meadowvale Farms occurs.
Just such a break occurred the night before Christmas of 2002. The residents of The
Elms Community were without water for several hours before the developer had a person
shut off the fire hydrant water in the Meadowvale complex.
This co joining of water and fire pipes also cost the Elms Community a considerable
amount of money because the break in the Meadowvale Farms fire hydrant pipe went
undiscovered for several hours.
It is my belief this kind of connection is not authorized by the filing for developing The
Elms Community sub-division I & II
