Huddlestonn Property Tax Administrator SUBJECT: 2003 BAA - Touch America (TL457) Stipulation DATE: November 25, 2003 MEMORANDUM As a result of Touch America's year-end asset write-down that was not reflected in its 2003 ASOP, Touch America filed with the BAA. As a result of the filing, we have entered into a stipulation, which has been approved by the Board of Assessment Appeals. Since then, Touch America filed bankruptcy. In October, we informed the treasurers of the bankruptcy filing. The Stipulation and Joint Motion for Order and the BAA Order on Stipulation are attached. Petitioners Touch America, Inc. and Respondent Property Tax Administrator hereby stipulate that the actual value assigned to the property that is the subject of this appeal for tax year 2003 is $12,244,500 with an assessed value of $3,550,900. 2. The parties agree that these values apply to tax year 2003 only. The parties request that the Board enter an Order approving the stipulation to reduce the actual value and assessed value assigned to this property for tax year 2003 to the values shown above. 3. The parties agree to ask the Board to dismiss this case based on this stipulation. Each party will bear its own costs in connection with this appeal.
