HomeMy WebLinkAbout20031532 RESOLUTION RE: APPROVE 2003-2004 ALLOCATION LETTER#4-19 FOR COMMUNITY CORRECTIONS SERVICES AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with the 2003-2004 Allocation Letter#4-19 for Community Corrections Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the 19th Judicial District Weld County Community Corrections Board, and the Colorado Department of Public Safety, Division of Criminal Justice, commencing July 1, 2003, and ending June 30, 2004, with further terms and conditions being as stated in said allocation letter, and WHEREAS, after review, the Board deems it advisable to approve said allocation letter, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado,that the 2003-2004 Allocation Letter#4-19 for Community Corrections Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the 19th Judicial District Weld County Community Corrections Board, and the Colorado Department of Public Safety, Division of Criminal Justice, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said allocation letter. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 16th day of June, A.D., 2003. Box 758 Greeley,CO 80632 Dear Ms. Zuber: Pursuant to paragraph 1.A.1 of the contract between the Department of Public Safety,Division of Criminal Justice(DCJ),and the Board of Commissioners of Weld County,DCJ hereby notifies you of the following funding allocations for Fiscal Year 2003-04. 1) The maximum amount payable from the State for community corrections services under Contract # DCJ 00-04-19, for the period July 1, 2003 through June 30, 2004, is as • follows: $1,054,117 for residential diversion direct sentence and diversion condition of probation placements at a daily rate of$34.70 per offender, Bill Owens GOVERNOR C.Suzanne Menoer $ 129,290 for diversion non-residential placements at no more than$247.00 per month EXECUTIVE DIRECTOR per offender,not to exceed an average of$4.71 per day per offender, Division of Criminal Justice $ 723,911 for residential transition placements at a daily rate of$34.70 per offender, Colorado State Patrol Colorado Bureau $ 127.002 for residential parole placements at a daily rate of$34.70 per offender, of Investigation Division of Fire Safety P$ 597.898 for residential transition IRT placements for specialized services as described in Exhibit"A"at a daily rate of$51.05 per offender, $ 65,547 for residential diversion IRT placements for specialized services as described in Exhibit"A"at a daily rate of$16.35 per offender,which is the difference between the IRT per diem($51.05) and the regular diversion residential per diem($34.70), DC J $ 79,310 for residential transition specialized female services as described in Exhibit "A" at a daily rate of $15.70 per offender, which is the difference between the specialized female services per diem ($50.40) and the regular transition residential per C: diem($34.70). hap://dcj.state.co.us E-Mail:raymond.slaughter@cdps.state.co.us Allocation Letter-Board of Commissioners of Weld County May 22,2003 Page Two $ 100,209 for Community Corrections Boards Administration, and per diem supplements to provide specialized services,with prior approval by the State, for offenders with special needs. 2) Payment pursuant to this Allocation Letter shall be made as earned, in whole or in part, from available State funds encumbered in an amount not to exceed $36,827,496 for the purchase of community corrections services for all Contractors,subject to the line item and per diem expenditure limitations in Paragraph 1.above. It is further understood and agreed that the maximum amount of State funds available for fiscal year 2003-04 for the purchase of community corrections services is in the amount of$36,827,496. Total liability of the State, at any time, for such payments shall be limited to the unencumbered amount remaining of such funds. 3) Funds allocated in this Funding Letter are for services rendered during the current contract period and cannot be used to pay for community corrections services provided in prior or future fiscal years. 4) Any unexpended funds allocated or advanced to the Contractor by the Funding Letter shall be reverted to the State no later than September 1, 2004. 5) The State may prospectively order an increase or decrease in the amount payable and the corresponding levels of service under this Funding Letter through a"Change Order Letter",approved by the State Controller or his designee,in the form attached,marked as Exhibit"C"and incorporated herein by reference,subject to the following conditions: a) The Change Order Letter("Letter") shall include the following: 1) Identification of Contract by Contract number, Allocation Letter Number and affected paragraph number(s); 2) Types of service or programs increased or decreased and the new level of each service or program; 3) Amount of the increase or decrease in level of funding for each service or program and the total; 4) Intended effective date of the funding change; 5) A provision stating that the Change shall not be valid until approved by the State Controller or such assistant as he may designate. b) Upon proper execution and approval, such Letter shall become an amendment to this Contract and, except for the Special Provisions of the Contract,the Letter shall supersede the Contract in the event of a conflict between the two. It is understood and agreed that the Letter maybe used only for increased or decreased funding,and corresponding adjustments to service levels and any budget line items. Allocation Letter-Board of Commissioners of Weld County May 22, 2003 Page Three c) If the Contractor agrees to and accepts the change, the Contractor shall execute and return the Letter to the State by the effective date indicated in the Letter. In the event the Contractor does not accept the change,or fails to timely return the executed Letter,the State or the Contractor,upon notice to the other,may terminate this Contract effective at any time after twenty (20) days following the return deadline specified in the Letter. Such notice shall specify the effective date of termination. In the event of termination,the parties shall not be relieved of their obligations up to the effective date of termination. d) Increases or decreases in the level of contractual funding made through the Letter process during the term of this Contract may be made under the following circumstances: 1) Adjustments to reflect current year expenditures; 2) Supplemental appropriations resulting in an increase or decrease in the amounts originally budgeted and available for the purposes of this program; 3) Closure of programs and/or termination of related contracts; 4) Delay or difficulty in implementing new programs or services; and 5) Other special circumstances as deemed appropriate by the State. This amendment to the contract is intended to be effective July 1,2003,but in no event shall this amendment be deemed valid until it shall have been approved by the State Controller or his designee. This is the final allocation letter of the current contract. A major change is the reduction of administration funding from five percent (5%) to four percent (4%). This is now a separate line item and is appropriation taken from Residential Transition, Transition IRT, Transition Sex Offender, Diversion Residential and Diversion Non- Residential budget line items. You will note that four percent (4%) of residential parole funding is not included in the administrative funding. This was an oversight at the state level. The Division of Criminal Justice is confident that a correction will be made by the second quarter of the fiscal year. I respectfully request the Board of Weld County Commissioners include this item on the Wednesday, June 11, 2003 meeting agenda for signature approval. If approved, please forward all copies to me, I will forward them to DCJ, and return a fully executed copy to the Board of Commissioners.
