HomeMy WebLinkAbout20031989.tiff RESOLUTION RE: APPROVE AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO SIGN - COLORADO YOUTH CORPS ASSOCIATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Employment Services of Weld County, and the Colorado Youth Corps Association, commencing May 30, 2003, and ending June 30, 2004, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Servcies between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Employment Services of Weld County, and the Colorado Youth Corps Association be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. L.P 'ounty Attorn-y /•� Glenn Vaad Date of signature: ` --/g `/?3 2003-1989 HR0074 AGREEMENT FOR SERVICES This agreement (hereinafter "Agreement") is entered into by Weld County Youth Conservation Youth Corps (hereinafter "Contractor") and the Colorado Youth Corps Association (hereinafter "CYCA") this 30th day of May 2003. The parties, in consideration of the mutual terms and promises as set forth below, agree as follows: 1. Scope of Services by the Contractor The Contractor agrees to perform the services as described below and as set forth within the following document(s), incorporated herein by this reference: Colorado State Parks Project Description V Project Agreement Form(s) for each project 2. Training The Contractor will be required to have met the appropriate CYCA accreditation standards prior to entering into this agreement. 3. Independent Contractor The services to be performed by the Contractor are those of an independent contractor and not as an employee of CYCA. As an independent contractor, the Contractor is not entitled to worker's compensation benefits except as may be provided by the Contractor nor to unemployment insurance benefits. The Contractor is obligated to pay all applicable federal and state income tax on any moneys paid pursuant to this Agreement. 4. Term of Agreement This contract shall begin on May 30, 2003 and end on June 30, 2004. 5. Fees for Services The Contractor will be compensated strictly on a fee-for-service basis for the performance of those services described in the attached Project Description(s)for this Agreement. The Contractor shall be reimbursed at a rate described in specific Project Description(s) attached hereto and incorporated herein. CYCA shall pay the Contractor for services performed upon submittal of invoices by the Contractor. Invoices shall provide a detailed description of the work performed, and time allocated toward such performance. 2003 Contract Agreement 1 &oJ 7997 Payment shall be made upon approval of a written request from the Contractor, subject to the following conditions: a) Projects in duration of two or more weeks may invoice CYCA no more than once every two weeks, with final payment paid upon receipt of project evaluation documentation from the project sponsor. Up to 80% of the final payment may be paid at the time of invoice if project documentation has not been received by the CYCA within the current invoicing period the project was completed. The remaining 20% will be paid upon receipt of the project documentation. b) For projects less than two weeks duration, payment will be made once upon completion of the project. c) CYCA reserves the right to withhold up to 20% of any project payment if project evaluation forms indicate unsatisfactory project performance. To the extent possible, the Contractor agrees to promptly correct and/or address the unsatisfactory performance. Withheld payments will be paid upon such corrections being satisfied. The Contractor is responsible for all expenses, including personnel, tools, and equipment needed to fully perform these services. 6. Termination Either party may cancel this Agreement upon fourteen (14) day advance written notice to the other party for any reason. If termination of this Agreement occurs after services have been performed, payment of fees shall only be provided upon submittal of final reporting documents for that portion of the work satisfactorily completed at the effective date of such action. 7. Insurance The City and County are "public entities"within the meaning of the Colorado Governmental Immunity Act, C.R.S. 24-10-101, et seq., as amended ("Act"). The City and County shall at all times during the term of this Agreement maintain such liability insurance, by commercial policy or self-insurance, as is necessary to meet its liabilities under the Act. Upon request by either party, the other party shall show proof of such insurance. 8. Liability Each party assumes responsibility for its negligent actions and omissions, and those of its officers, agents and employees in the performance or failure to perform under this agreement. By agreeing to this provision, neither the City nor the County waives or intends to waive, as to any person, the limitations on liability which are provided to the City and the County under the Colorado Governmental Immunity Act, Section 24-10-101,et seq. 9. Miscellaneous a. The Contractor agrees to comply with the letter and spirit of the Colorado Anti-discrimination Act, as amended from time to time, and other applicable law respecting discrimination and 2003 Contract Agreement 2 unfair employment practices (CRS §24-34-402), and as otherwise required by State and Federal Laws and Regulations. b. The Contractor shall procure all permits and licenses, pay all charges, fees and taxes and incidentals that may be required for the lawful execution of the work. c. This Agreement is not assignable. d. This Agreement, with attachments as incorporated herein, represents the entire Agreement of the parties. e. No modification or change to the Agreement will be effective unless it is in writing and signed by both parties. f. The signatories attest that to their knowledge that no employee has any personal or beneficial interest whatsoever in the service or property described herein. Box 1805, Greeley, CO 80632 Corps Contact Information: Jay Molock Project Site Location: St. Vrain State Park Project Contact Information: Bob Finch(303) 678-9402 Brief Description of the Project: This project is mainly fence construction& de-construction for newly acquired property surrounding the park —approximately 500 acres. Project will include signing boundary fences. No technical skills are required,but careful supervision is advised as crews will be mainly working with barbed-wire fencing materials. Project may also include some weed mitigation of Tamarisk along the banks of the St. Vrain river. Projected Duration of the Project: 2 weeks Fee for Service Rate: $5100 per week Pre-project site visit: $250 TOTAL CONTRACT: $10,450 The following minimum standards are required in this agreement. • Minimum of 8 corps members, including crew leader • Minimum of 324 hours per week on project work,exclusive of environmental education • Use of the Colorado Outdoor Odyssey Curriculum for a minimum of 4 hours and required reporting Colorado Youth Corps Association Environmental Education Curriculum Use Agreement Colorado Youth Corps working under contract with the Colorado Youth Corps Association(CYCA) on Colorado State Park (CSP) and/or Division of Wildlife(DOW) contracts will be required to incorporate at least 10% of each crew week to environmental education EE). Of that 10%, at least 50% of the EE must include the use of the EE curriculum that has been designed for the Colorado Youth Corps Association by Colorado State Parks and the Division of Wildlife. The efforts to use the EE curriculum will be documented by crew leaders as they complete and submit the "Curriculum Evaluation Form". Specifically each crew leader will be expected to make brief entries on the form about each lesson they use from the EE curriculum throughout the work season. The completed forms will be submitted to Faye Koeltzow, Colorado State Parks Youth Outreach Coordinator, within 30 days after the end of the final CSP and/or DOW 2003 project for each corps. Curriculum and respective forms will be provided to each participating corps at the Statewide Crew Leader Training to be held in Sylvan Lake State Park, Eagle, Colorado, May19-23, 2003. COLORADO YOUTH CORPS PROGRAM SPONSOR AGREEMENT Thank you for using a Colorado Youth Corps program this season. Please read and complete both sides of this form with the respective youth corps program representative. This sponsor agreement must be signed and received by the Colorado Youth Corps Association prior to the start of any work by the youth corps. Two copies are enclosed. ROLES AND RESPONSIBILITIES > The Youth Corps: The youth corps program agrees to provide a minimum of 324 hours of work per week(excluding transportation time but inclusive of allowable lunch and work break, safety circle and on-site project-specific training with the sponsor) on the project described above to be accomplished by a crew of young adults between the ages of 16 and 25. The crew will be supervised by a Crew Supervisor to be provided by the youth corps program. The crew supervisor will be responsible for all supervision and discipline of the corps members assigned to the project. The youth corps program will perform the work in a timely and professional manner. > The Project Sponsor: The Project Sponsor agrees to assign a technical advisor to the project to provide general project oversight and assurances that the project is proceeding according to the specified scope of work. The Project Sponsor agrees to provide all project materials, supplies, tools and equipment(unless otherwise agreed to by the corps program). The Project Sponsor will provide a safe working environment. The Project Sponsor will provide a thorough orientation for the crew which includes a general overview of the organization,its mission and goals,key staff and user needs in addition to specific topics which directly relation to the completion of the project. The Sponsor agrees to assist the crew with understanding the environmental education component of the project and will provide information on his/her job for purposes of orienting the corps members to the natural resources field. The sponsor agrees to provide a written review of the crew's performance at the conclusion of the project. ➢ The Colorado Youth Corps Association(CYCA): CYCA will provide a statewide technical training to corps receiving state contracts. CYCA will also ensure that programs performing work on statewide contract meet basic CYCA Accreditation and Affiliation Standards. It will manage Colorado Youth Corps Association Project Sponsor Agreement—2003 1 payment of services to the youth corps program,provide at least one on-site visit with the project sponsor and with the participating corps, scheduling the visit when at all possible with the youth corps on site at the time. CYCA will also ensure that the project will be completed to the satisfaction of the project sponsor as indicated in the Project Sponsor Evaluation Form submitted at the conclusion of the project.
