Ladies and Gentlemen:
Patina Oil&Gas Corporation("Patina")has been contacted by Stephan I.Brancucci(the"Owner")and Weld
County Board of County Commissioners regarding the proposed Request for a Change of Zone from
Agricultural to Industrial on portions of the captioned property ("Property"). The hearing is scheduled for
April 9, 2003. Patina operates the Brancucci #1 oil and gas well ( the"Well"), associated pipelines and
production facilities on the Property. Patina also owns oil and gas leasehold rights and has rights to drill
additional well(s) on the Property. Patina is concerned about the impact the proposed development will have
on Patina's ability to produce,operate and maintain the Well,pipelines,access roads and production facilities
as well as the drilling and operations of future wells on the Property. To date. Patina has received no
confirmation from the Owner that Patina's real property rights to use a reasonable portion of the surface for oil
and gas operations and development ate being preserved.
Patina requests assurance from the Board of County Commissioners of Weld County that the proposed
development will not preclude Patina from producing,operating,drilling and maintaining its wells and related
facilities. Until this matter is resolved by agreement with the Owner, Patina is not waiving its rights as a
leasehold owner. Any approval of the proposed development should be conditioned upon the preservation of
Patina's real property rights that allow it to make reasonable use of the surface of the lands for oil and gas
operations. The proposed development must take into account and provide adequate setbacks from Patina's
current and future wellsitcs,pipelines,and production facilities as well as continuous access to these facilities.
Patina requests that these comments be entered into the record for the Owners proposed development and that
we continue to be provided with advance notice of all other hearings affecting the Property. If you have any

Dear Mr. Brancucci:
Pursuant to your letter of September 23, 2003 and several prior phone calls, Patina Oil & Gas
Corporation ("Patina") encloses an aerial photograph showing your property and the drilling windows for
oil and gas wells as prescribed by the Colorado Oil and Gas Conservation Commission. Patina is also in
receipt of a notice from Weld County for Docket #2003-76, wherein it appears you are requesting a
change of zone from agricultural to industrial for your 30+/- acre parcel that is located immediately south
of Weld County Road #6 and east of US 85.

As you are aware, Patina operates the Brancucci 81 oil and gas well ( the "Well") and related production
facilities on the subject property. In addition to Patina's rights under the oil and gas lease, we require that
any future development of the surface provide for adequate access to and setbacks from the Well.

On 02-18-2003 an evaluation of the existing individual septic disposal system at:
1281 WCR 27, Brighton;
Section 30, Township 01, Range 66,
was conducted by Stephen J. Wiatrowski, an Environmental Specialist of this department.
The existing individual septic disposal system is not of sufficient size and capacity to
adequately handle the proposed load. This evaluation is based on a final treatment capacity for
a 2 bedroom residence.
The system is not constructed in accordance with current regulations, as the tank is undersized
by 500 gallons. Because the system was installed prior to the adoption of statewide guidelines
by the Colorado Board of Health, the County considers this system to be "grandfathered" and
will not require that the system be brought into compliance with current regulations so long as
the system functions in accordance with current Regulations. The Department recommends
that the tank size be increased by 500 gallons. Please be advised that should you decide to
repair your system a permit is required from this Department prior to any alterations to the
system.
Be advised, neither the County of Weld nor any of its agents or employees undertake or
assume any liability to the owner of the above property, to any purchaser of the above property
or to any lending agency making a loan on the above property or in the report.

This inspection was conducted for the purpose of determining compliance with current
regulations and for detecting health hazards observable at the time of inspection. This does not
constitute a warranty that the system is without flaw or that it will continue to function in the
future. Inspections requested during periods of snow cover and high soil saturation may be of
questionable value to potential buyers due to adverse conditions. Evaluations based on
Statements of Existing (S.O.E.) relies on information the property owner provides, under oath,
indicating current status of the system and representing to the best of his/her knowledge the
system is not failing to function properly.
