A public hearing was conducted on June 25, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 6,2003,and duly published June 12, 2003, in
the South Weld Sun,a public hearing was conducted to consider the request of John Johnson for
a Site Specific Development Plan and Amended Use by Special Review Permit#1282 fora Dairy
in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made this a matter
of record. Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the record
as written. Mr. Gathman gave a brief description of the location of the site and surrounding uses.
He stated 11 referral agencies reviewed this proposal, and ten responded favorably or provided
comments which have been incorporated into the Conditions of Approval and Development
Standards. Mr. Gathman explained Use by Special Review Permit#1282 was approved by the
Board in 2000 for 11,240 head of cattle and 20 horses. Under this amendment the number of cattle
will remain the same; however, 2,000 of that amount will be dairy cows. Mr. Gathman displayed
photograph of the existing site and surrounding areas. In response to Commissioner Masden,Mr.
Gathman stated there were some issues initially, but there have been no violations since the site
began operating. TrevorJiricek,Department of Public Health and Environment,clarified shortly after
Use by Special Review Permit#1282 was approved, the applicant had cows on the site prior to
completing some of the drainage features. He stated those issues were corrected following a
complaint and staff has received no further complaints since that time. He reiterated the permitted
number of cattle will not increase; however, the applicant will be required to submit an updated
Wastewater Plan to account for the additional wasterwater generated by the dairy activities on the
site.

Donald Carroll, Department of Public Works,stated there are existing accesses to the residence,
feedlot,and agricultural areas on the property. He stated there will also be one improved access
on the south side of the property leading to the milking parlor,which will be utilized by 19 employees,
working three separate shifts, and one milk truck per day.
Lauren Light,LANDPROfessionals,LLC,represented the applicant and stated this amendment will
allow for the addition of a milk parlor and incorporate 2,000 head of milking cows into the currently
permitted number of cattle. She stated the dairyfacilitywill include a milking parlor,separators,and
an additional lagoon. Ms.Light stated this facility has existed since 1973,Booth Feedlot is located
to the north, and it will be compatible with the area. In response to Commissioner Vaad, Tom
Haren,LAN DPROfessionals,LLC,stated the applicant previously expanded this operation to raise
heifer cows for dairies. He stated since the animals are already on the site and are not currently
selling at the price the applicant wants,this amendment will allow him to use the resource until the
animals are sold. He stated there are no health and safety issues for the public by combining
animal feeding and dairy operations. He further stated one pond will be added on the south;
however, the existing foot print of the pens will remain the same, with some internal changes to
accommodate the dairy cows separate from the heifers. He stated the waste water from the dairy
facilities will be directed to the new lagoon, which is larger than the existing stormwater lagoons.
Mr. Haren stated the wastewater will be land applied and manure will be hauled off the site.
Responding further to Commissioner Vaad, Mr. Haren reiterated the footprint of the facility will
remain the same; however, the dairy pens will have a small density of cows to accommodate the
dairy management practices to keep the cows clean, versus the standard feedlot pen practices.
No public testimony was offered concerning this matter. In response to Chair Long, Ms. Light
requested Condition of Approval#2 be amended to extend the time limit from 30 days to 180 days
to allow adequate time to complete all of the health requirements. Staff concurred with this request.
Responding to Commissioner Jerke, Ms. Light stated this property is adjacent to Weld County
Roads 47 and 74, and there is no frontage along Weld County Road 49.
Commissioner Vaad moved to approve the request of John Johnson for a Site Specific
Development Plan and Amended Use by Special Review Permit #1282 for a dairy in the A
(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record. His motion also included amending Condition of Approval#2 from 30 days to 180 days. The
motion was seconded by Commissioner Jerke,and it carried unanimously. There being no further
discussion, the hearing was completed at 10:25 a.m.
