DISTRICT FOR LYNN SETTJE, 1305 6TH STREET, GREELEY, COLORADO
80631 AND JOE E. SMITH, 3301 24TH STREET ROAD, GREELEY, COLO-
RADO 80631.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the

affairs of Weld County, Colorado, and
' WHEREAS, a public hearing was held on the 2nd day of July,
1980 at 2 : 00 o' clock p.m. for the purpose of hearing the petition
of Lynn Settje, 1305 6th Street, Greeley, Colorado 80631 and

Joe E. Smith, 3301 24th Street Road, Greeley, Colorado 80631 ,
requesting a change of zone from B-Business District to C-Com-
mercial District for the following described parcel of land,
to-wit:
The North one-half (Nz) of Lot Three (3) ,
EXCEPT the East one-hundred feet (100' )
thereof, All in the Southwest Quarter of
the Southwest Quarter (SWaSW4) of Section
Nine (9) , Township 5 North, Range 65 West
of the 6th P.M. , according to the sub-
division of lands as made by the Union
Colony of Colorado, County of Weld, State
of Colorado.
WHEREAS, Section 8. 2 and 8. 3 of the Weld County Zoning Reso-
lution authorizes the Board of County Commissioners to grant a
change of zone upon the showing by the petitioners of certain
facts, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the petitioners and the recommendations of the Weld
County Planning Commission, and having been fully informed, is
satisfied that the request for re-zoning complies with the Weld
County Comprehensive Plan and the conditions set out in Section
8 . 2 and 8 . 3 of the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Lynn
Settje and Joe E. Smith, for a change of zone from B-Business

District to C-Commercial District on the abovedescribed tract
of land be, and hereby is , granted subject to the condition
that the applicant shall provide for 50 feet of right-of-way
south of the center line of 18th Street.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated June 3, 1980, be, and hereby are, adopted as the findings
of fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 2nd day of
July, A.D. , 1980.

I hereby certify that pursuant to a notice dated May 28, 1980 and
duly published May 29 and June. 19, 1980 in the Johnstown Breeze a
public hearing was held on the request of LYNN SETTJE AND JOE SMITH
for a CHANGE OF ZONE FROM BUSINESS TO COMMERCIAL.
Mr. Honn read the Planning Commission' s favorable recommendation and
conditions.
Stephen J. Worrell, attorney for the applicants, was present and
elaborated on the reasons for this request.
There was no one in opposition to this request present.
Following discussion Commissioner Roe made a motion to approve the
change of zone from B to C for Lynn Settje and Joe Smith with the
Planning Commission' s conditions. Commissioner Carlson seconded the
motion and it carried unanimously.

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS
REQUEST BE Approved FOR THE FOLLOWING REASONS :

requested by reservation. The Greeley Planning Commission and the State
Highway Department has requested the additional right-of-way.

Ken McWilliams indicated that this is a request for rezoning from
business to commercial on approximately 1 3/4 acres . The site
involved is the former location of the Chuckwagon Dinner Playhouse .
John Gauthiere noted that there is an existing 5/8 inch water
` tap which serves the property. Mr. Gauthiere noted that this
tap was obtained prior to the City ' s requirement pertaining to
raw water transfer in exchange for City domestic water service .
Mr. Gauthiere indicated that raw water may be required if the
property is subdivided, if new taps are requested, or if larger
taps are requested . Ken McWilliams noted that the raw water dona-
tion requirement is tied to provision of City water service irregard-
less of whether the request is inside or outside the City limits .
Mr. McWilliams also noted that the cost of the water taps as well
as the water rate charges are less inside the City than outside the
City. John Gauthiere indicated that development of the property
would necessitate an additional sewer tap since the existing tap
does not conform to City specifications . Mr. Gauthiere noted that
sewer service is available in First Avenue and could be accomplished
through extension of a sewer line from First Avenue . Mr . Gauthiere
also noted that additional water service would require extension of
the 8 inch water line from First Avenue . Mr . Gauthiere noted that
a 14 inch water line is projected to be developed along East 18th
Street in the next four to five year time frame . Mr. Gauthiere noted
that this is part of the East Greeley Water Service Study which has
yet to be completed . The study basically deals with the provision
of an arterial water transmission system for the East Greeley area .
Vertis Einspahr identified the need to provide a fire hydrant within
250 feet of any development which occurs on the property .
Max Karner indicated that 18th Street is a designated arterial in
the City' s Comprehensive Plan and identified the need for an addi-
tional 17 feet of right- of-way for the development of a 100 foot
wide arterial street. Mr. Karner indicated that there was some
confusion as to the existing right-of-way for this section of 18th

Street and suggested that SO feet of right- of-way from the existing
center line be provided for each side of 18th Street for its
future development as an arterial street . Mr. Karner suggested
that Mr . Billings contact the State Highway Department to determine
more accurately the existing right- of-way for this particular
section of 18th Street . Mr . Karner also noted that a drainage
report done by a professional engineer should be done at the time
of development of the property.
Ken McWilliams indicated that the proposed rezoning to commercial
at this location would be in conformance with the adopted policies
in the Greeley Comprehensive Plan . Mr. McWilliams suggested that
the developer consider annexation to the City of Greeley , which is
now available since the Seyler No . 2 Annexation has been brought
into the City. The Seyler No . 2 Annexation should provide the
necessary contiguity so as to make this particular piece of
property eligible for annexation .
Don Billings indicated that he has a contract to purchase the
property subject to rezoning of the property to a commercial desig-
nation. Mr. Billings indicated that he has no particular development
plans for the property at this point in time . Mr. Billings indicated
that he would like to have time to consider the alternative in
annexing to the City and developing in the City rather than pursuing
the rezoning in the County. Additionally, Mr . Billings indicated
that he would like to review with the City Planning staff the
type of zoning which the staff could support in the City and the
specifics of that zoning category including uses , setbacks , etc .

This is in answer to your request for soil and site information for change
of zone for a 1.74 acre lot on east 18th Street, Greeley, Colorado.
There are two soil types present on the property that will influence the use
of the site. The soils are Otero sandy loam, 0 to 1 percent slope (53-A) ,
and Olney fine sandy loam, 0 to 1 percent slope (55-A) . Please reference the
attached soils map for approximate location of each soil and the soil map unit
descriptions for soil details.
Both soils have only slight limitations for use as commercial sites. Both soils
indicate adequate supportive capacity for construction of small commercial build-
ings, and the site should be adequate for septic tank filter fields.
Both soils are susceptible to wind erosion if soil surface is exposed. Measures
should be taken during construction to insure adequate soil surface protection is - - ---
maintained to avoid wind erosion hazard.
These two soils are c msidered to be prime agricultural land if irrigated.
However, due to location and size of the parcel, this should not be considered
a factor for approval of this request.
If soil conditions other than those described above and in the attached soil
descriptions exist, an on-site soil investigation should be performed by a
competent soils engineer to determine proper design criteria for conditions.

Gentlemen:
The proposal to rezone this property appears to be consistant
with the Weld County Comprehensive Plan to concentrate commer-
cial areas near population centers and where adequate traffic
access and utility services are available or are economical
to expand or extend. It is also consistant with the City of
Greeley ' s present planning in this area. The tract to the
South is presently in the process of being annexed to the
City and a I-1 District (Light Industrial) is being considered.
The uses permitted under the "C" Commercial District are not
extremely divergent from those allowed under the existing
"B" Business District. In fact , some of the uses would
actually be much less demanding on the street and utility
systems. In my opinion, the uses allowed in the requested
"C" zone would be compatible with the existing uses to the
North and West of the property. Land to the South is
vacant, to the East is an older residential unit located
on 0. 7± acres.
The property has an existing 4" sewer tap and service line
to the 21" trunk line in First Avenue. There is also an
existing 5/8" or 1" water tap to the 4" main in East 18th
Street. Fire protection is available from the City hydrant
at the intersection of 1st Avenue and 18th Street (approxi-
mately 350 feet from the Northwest corner of the site) .
The contemplated use of "storage warehousing" would require
only domestic use for office facilities and the existing
services would be more than adquate. The City of Greeley
is continuing planning and construction to up grade water
and sewer service to this area.
The owner would dedicate an additional 17 feet along the
North side of the property to provide a 50 foot half
Right-of-Way for East 18th Street. This is consistant
with the Highway Department ' s previous requests along
East 18th Street . The property is about 350 feet East of

the street intersection. The Highway Department would have
the opportunity to review access locations to the property
at the time development plans are complete.

We have reviewed the Lynn Settje and Joe Smith rezoning application, and we have the
following comments.
1 . As indicated in the application, right of way is to be dedicated so that a 50-foot
width will be available to the south of the U.S. Highway 34 centerline. This is
acceptable to us and is also consistent with the City of Greeley's transportation
plan.
2. We also agree with the statement concerning future review of access to this
property. We are interested in limiting access to well-defined driveways which
are necessary to serve this property. Curb and gutter would be an appropriate
means to define the access to this property.
3. Surface runoff and potential highway traffic noise impacts are also factors for
consideration. The City' s requirements for detention should provide adequate
storm-water control . Highway noise impacts may or may not be of concern, depend-
ing upon the proposed use for this site. Building setbacks and/or noise insula-
tion should be considered as means to provide noise abatement.
