HomeMy WebLinkAbout20031802.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST THE LOCKER ROOM FOR VIOLATION OF HEALTH REGULATIONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a recommendation from the Weld County Department of Public Health and Environment for the County Attorney's Office to proceed with legal action against The Locker Room, 975 Railroad, Gilcrest, Colorado 80623, and WHEREAS, a hearing before the Board was held on the 14th day of July, 2003, at which time The Locker Room was present to pay the civil penalty of$250.00, and WHEREAS, following payment, at the recommendation of staff, the Board deems it advisable to dismiss the violation hearing. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the violation hearing regarding the recommendation from the Weld County Department of Public Health and Environment for the County Attorney's Office to proceed with legal action against The Locker Room be, and hereby is, dismissed. The conversation was in regards to his Retail Food Establishment (RFE) license in which the Department had not received payment. Additionally we spoke of the Civil Penalty assessed as a result of failing to pay the license fee. At that time, it was agreed that Mr. Esquivel would pay for his RFE license (3110.00). Mr. Esquivel requested additional time to pay the civil penalty fee of 3250.00. Mr.Esquivel indicated he would attempt to pay the civil penalty fee by May 31, 2003. If payment could not be made as discussed, I asked that he contact myself so additional arrangements could be made. He agreed that he would do that. Please include a copy of your current Colorado Sales Tax License along with your renewal and payment. Failure to comply with the provision of this notification will subject you to a civil penalty,which may be assessed by this Department.
