This letter is in reference to the Special Review Permit request of Marcelle
Geudner to permit a Commercial Zone District(Landscaping Materials
Yard) in an A (Agricultural) Zone District. For the following reasons, we
are strongly opposed to the approval of this request:
1. The application refers to a"Storage Yard". The many advertisements
for TimberRock refer to a "Landscape Center", with the statement
"you pick up or we deliver". (Refer to the attached advertisement
samples) It's a retail business, not simply a storage yard.
2. The means of access to the business is on more than 753 feet of
private, not public, roadway. This roadway is deeded to the adjacent
landowners who require this road for access, their only means of
access, to their properties. We are two of those adjacent landowners
who use and share ownership of this roadway. It is our strong opinion
that making drastic physical changes to the road, and drastically
changing the historic and intended use of this private road can not be
allowed without the approval of the owners of this road.

3. The private roadway is for ingress and egress of the landowners
adjacent to the roadway. On several occasions, we were prevented
from using the road. One instance was when an 18-wheel tractor-
trailer rig had the road blocked. Another incident was when the
business owner installed a culvert. In the second instance, the road
was blocked for several hours. A third example is when on June 23
and 24, a trencher impeded traffic on the roadway for two days. We
were informed that it had run out of gas.
4. The proposed business, TimberRock Landscape Center, has been in
operation since February in violation of the present zoning and is
totally unregulated. Prior to operating at this location, he operated his
business at either two or three locations in Windsor, with documented
citations for similar zoning violations.
5. The operation of this business has resulted in a significant increase in
traffic on the private roadway and at the intersection of the private
roadway and CR 17. The numbers of vehicles on certain days is
documented in the testimony of others. This traffic has included
everything from customers' cars and pickup trucks, many with
trailers, two-ton dump trucks, and large 18-wheel tractor-trailers. This
increased traffic has resulted in several near misses with adjacent
property owners, as the private road has no regulations and no means
to enforce any regulations should they be instituted. There is a stop
sign at the gate to TimberRock, but it is typically ignored, as is the 5

MPH speed limit sign that is posted on the road. In addition, the
roadway has suffered from potholes and other use degradation without
any maintenance.
6. The owner of the business has unilaterally modified the private
roadway for his benefit as he sees fit and without regard for anyone
else. These modifications have included filling in low spots with dirt
rather than road base, narrowing a portion of the roadway to only 14
feet, and trenching for underground services. Contrary to testimony
by Mr. Aragon, he did not contact any adjacent landowners before he
made modifications to the private road and began using it for access to
his business. He did not ask anyone to share in the cost of these
modifications. On June 23, he opened a trench approximately 1-1/2 to
2 feet deep from the landscape property and angling into the private
roadway approximately 45 feet. The trench was left open until June
26. The trench was not marked or barricaded in any way, and was
clearly a danger to traffic. When another neighbor closed the portion
of the trench on the private roadway, an altercation took place. The
neighbor closing the trench was informed that the private roadway
was the property of Jesse Aragon, and he was letting the adjacent
landowners use it.
7. The noise from the equipment operating in the landscaping yard is
very loud and disturbing. This includes noise from the back-up
beepers on the loaders and heavy equipment, the engine noise from
the large trucks, and the very loud noise of gravel and rocks being

unloaded from and loaded into trucks with steel beds. Contrary to
testimony, the dairy does not generate any similar noise.
8. The business is operating in an agricultural and residential area.
(Windsong Ranch Subdivision is 'A mile to the north, and there are 6
homes along the private road.) A private home is 160 feet
immediately to the west of the business. Since 1986, the county has
approved the building of 27 homes on the north and northeast portion
of this section. This shows a trend of merging from an agricultural
community to a residential community. This business is incompatible
with that trend.
9. Prior to the planning hearing, the business did not conform to its own
posted hours, which are 9:00 AM to 5:00 PM, closed Sunday. Several
of these non-conformities were presented to the planners. Mr. Aragon
was then granted expanded hours of operation from 8:00 AM to 6:00
PM. Mr. Aragon was asked if he understood the terms and conditions
set forth by the planners and if he agreed to them. He answered yes.
Yet he continues to operate outside of the approved and agreed upon
hours. Notice the following examples.
• Saturday, August 23
TimberRock was still open for business at 6:15 PM when I
went to get the mail.
• Monday, August 26

• Friday, August 26

We could hear TimberRock equipment running while we were
in our home and the TV was on. The large loader operated until
after 7:00 PM. AT 7:00 PM, the tractor/trailer entered the
landscaping property. It was gone before 6:30 the next
morning.

• Thursday, September 4
TimberRock equipment generated enough noise that we could
hear it in the house with the doors and windows closed and the
radio was on
• Monday, September 8
Still open for business at 6:40 PM
• Tuesday, September 9
When we returned home at 6:30 PM, TimberRock was open for
business. In addition, the tractor/trailer was backing up in the
yard. The T/T rig then pulled forward, then backed up, then
pulled forward, then backed up, and on & on until 7:05 PM! At
that time it fmally dumped its load. Also at 7:05 PM, a white
TimberRock delivery truck pulled on to the private road and
back in to the business. Throughout this time, a loader was
operating and the beeper was continually sounding.
• Thursday, September 11
The gates to the business were closed, but someone at the
business ran a loader until 7:15 PM.

The tractor/trailer pulled in at 7:05 PM and dumped a load of
compost at 7:10. We could hear this activity in the house with
the doors and windows closed and with Monday Night Football
on TV.
We could site many more examples, but the message is clear. Mr. Aragon
will agree to anything to gain approval for his business, but then he will do
as he darn well pleases.
For the many reasons mentioned above, particularly altering the use of a
private roadway without the owners' approval, the significant increase in
traffic on this private roadway, and for the continual operation of the
business outside of approved hours, we strongly oppose the Special Review
Permit request and the operation of landscaping business at this location. It
is definitely not compatible with the surrounding area.

To whom it may concern:
We are currently under contract to purchase the 27 acre parcel
across the street from the TimberRock's new location on WCR 17. We
understand that there is a special review exemption hearing to allow
Timberrock to operate a business in an agricultural zoning area on
August 5`h. We would like to make known our concerns regarding this
review, as probable new neighbors and as citizens of the county who use
that road quite frequently.
Our concerns are as follows:
Unsafe traffic conditions at the corner of the private dirt
road and WCR 17. There is a dip in WCR 17 just to the north of the
private road. Even leaving the private road in a passenger vehicle
warrants extra caution as cars ,completely hidden in the dip, are coming
up at a high rate of speed. If you don't have good traction or are a slow
vehicle, you stand a good chance of being broadsided by the oncoming
traffic. A semi or large truck that takes longer to accelerate to traffic
flow would be very dangerous. I understand that several near misses
have already happened since they moved in in February.
Excessive usage of the private road by the delivery trucks, semis
and retail customers of TimberRock. The road maintenance has

historically by performed as needed by the residents/owners of the road
in cooperation with on another. Apparently, TimberRock has made
modifications to the road without consulting the other owners, in
advance. The increased usage of the road will cause more damage and
therefore the need for more maintenance.
With the new culvert put in by Timerrock, any run off from rain,
etc. will cross under the road and drain into our new property. I assume
that TimberRock's products is mostly natural landscaping products and
probably will not affect the land quality on our property. However, I
have seen railroad timbers on their lot. I am unsure if these are treated
timbers and what the effect of the treatment would be on the land, but
his business could affect the value of our property by placing
hazardous materials in the runoff.
Noise and dust. We are also concerned about the noise and dust
levels during hours of operation. With backup beepers and large
machinery operating before, after and during business hours, it will
affect the quiet enjoyment of our new home.
