The Weld County Health Department has reviewed this substantial change application. The proposal
has changed from a 6 lot PUD (a minimum proposed lot size of 4.0 acres with the overall density of
one septic system per 10.9 acres)to a 9 lot minor subdivision ranging in size from 5 to 15 acres
(overall density of one septic system per 8.4 acres). Previously, the application covenants allowed for
up to 10 alpaca per acre, which raised concern for the manure management of the property. The
substantial change application has not addressed this issue, so no comment can be made.
No new information regarding septic systems was submitted in the application materials; the following
was stated in the Change of Zone comments:
According to a preliminary geotechnical engineering report from Terracon dated October 1, 1999,
shallow bedrock was found on portions of the site. This may require that some septic systems be
designed by an engineer.
Because of the number of animal units previously allowed on the site, the Department had requested
that primary and secondary septic system envelopes be located on the Change of Zone Plat, and that
language be placed in the development covenants for the preservation and/or protection of the
secondary absorption field envelope. This requirement may change, depending on the number of
animal units allowed.
Based on these outstanding issues the Department comments made for Z-547 are subject to change.

RE: Owl Creek Estates
In regard to the review of a previously denied application for land use—SCH-24, Platte
Valley Schools ask that you review the letter dated June 2, 2003, in which we asked that
this development have a minimum of a 100 foot turn around point where the driveway to
the subdivision connects to Hwy 392. This is necessary to safely pickup and drop off
passengers in this area without backing up or stopping the bus on the Highway during
inclement weather conditions. There is no door-to-door service for subdivisions and this
area is to be maintained by the subdivision property owners in all weather conditions.
We would ask that you provide a safe place off of Highway 392 that would be safe for all
students while waiting for the bus. The bus will approach the stop from either the east or
west depending on AM or PM routes.
Also the cash-in-lieu for each lot/building site still remains in effect as stated on the
original plans.

Weld County Public Works Department has reviewed this substantial change plan request. Comments made during
this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the
remaining application process.
Comments
External Roadways:
❑ SH 392 is classified by the County as a State Highway. The applicant shall coordinate with CDOT the requirements
for right-of-way on SH 392 and provide a letter of confirmation to Public Works. The applicant, on the change of
zone plat, shall show and label the right-of-way recognized by CDOT. This State Highway is paved.
❑ SH 392 serving this development is paved. This development will introduce approximately 86 additional vehicle
trips per day to the roadway system. The residential traffic added to the roadway system will not have enough impact
to require off-site roadway improvements. A traffic study is not required, based on the proposal of limited
development and anticipated low traffic impact on surrounding roads.
Internal Roadways:
u This development has direct access to SH 392.
u The internal roadway right-of-way shall be 60-feet in width including cul-de-sacs with a 65-foot radius, and dedicated
to the public. The typical roadway section of interior roadway shall be shown as two 12-foot paved lanes with 4-foot
gravel shoulders on the change of zone plat. The cul-de-sac edge of pavement radius shall be 50-feet. Stop signs and
street name signs will be required at all intersections.
❑ Intersection sight-distance-triangles at the development entrance will be required. All landscaping within the triangles
must be less than 3'h feet in height at maturity, and noted on the final roadway plan.
❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal.
u Roadway and grading plans along with construction details will be required with the final plan submittal.
u Easements shall be shown in accordance with County standards and / or Utility Board recommendations, also
dimensioned on the final plat.
❑ The applicant shall enter into Improvements Agreements According to Policy Regarding Collateral For
Improvements. These agreements shall be approved by the BOCC prior to recording the final plat.
Drainage:
u The Preliminary Drainage Plan Report for Hegwood PUD Sketch Plan (Owl Creek Estates) dated May 2000, by
Boden Engineering,LLC in its initial form acceptable.
u The final drainage report shall:

o Be updated with respect to detention of stormwater. It is unclear at this point if detention is still
considered, since there are no outlots proposed.
- o Address a larger off-site tributary water shed area, especially to the north.
o Deal with the flood hazard of Owl Creek, especially the inundation area along the creek caused by a 100-
year storm. There may be areas of lots that adjoin Owl Creek, which are not suitable for building.
o Discuss Howards Lake located to the north and above the proposed development, especially should there
be a catastrophic event emptying the lake into Owl Creek and how the residents would be safeguarded.
❑ A final drainage report stamped,signed and dated by a professional engineer licensed in the State of Colorado shall be
submitted with the final plan application. The 5-year storm and 100-year storm drainage studies shall take into
consideration off-site flows both entering and leaving the development. Increased runoff due to development will
require detention of the 100-year storm developed condition while releasing the 5-year storm existing condition.
❑ The final drainage report shall include a flood hazard review documenting any FEMA defined floodways. The
engineer shall reference the specific map panel number, including date. The development site shall be located on the
copy of the FEMA map.
❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage at final plan. Front,
rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line
swales shall be considered. Building envelopes must be planned to avoid storm water flows, while taking into
account adjacent drainage mitigation.
❑ Final drainage construction and erosion control plans, conforming to the drainage report, shall be submitted with the
final plan application.
Recommendation
O The Public Works Department recommends approval of this substantial change plan.
The applicant shall address the comments listed above at the specific step of the review process stated. The review
process will continue only when all appropriate elements have been submitted. Any issues of concern must be
resolved with the Public Works Department prior to recording the change of zone and final plats.`

The sheriffs office recommends the following improvements for this housing sub-
division:
1. The sheriffs office requests that builders and developers designate an area by
the entrance of the sub-division in which to place a shelter for school children
awaiting the school bus. This area should also include a pull off for the school
bus which enables it to safely load and unload children out of the roadway in
^
the event the bus is unable to drive down the street due to road conditions.
2. Either a mail distribution within the sub-division or a central drop off location
within the sub-division should be developed so that residents do not have to
cross a county roadway to obtain their mail.
3. The name of the street within the sub-division should be presented to the
sheriffs office for approval. This will eliminate duplication of street names
within the county. .
4. A permanent sign should be placed at the entrances to the sub-division
detailing the name of the sub-division, and address. There should be a plan
developed to maintain this sign.
5. If the roadways within this sub-division are not maintained or adopted by the
county, individuals purchasing property in this sub-division should be notified
that the sheriffs office will have limited traffic enforcement powers.
6. A plan should be developed to maintain roadways within the sub-division
especially during inclement weather conditions for emergency vehicles.
7. The sheriffs office is very supportive of homeowner funded homeowners
associations. These associations provide a contact for the sheriffs office and

a means for maintaining common areas.
8. The plans for this sub-division show roadway with no sidewalks. The
sheriff's office requests that sidewalks be provided.
9. If there is a oil or gas well within this sub-division. This needs to be fenced
off in order to mitigate the potential for tampering. These facilities are known
to create an attractive nuisance for young people. Tampering not only creates
a significant danger to safety but also of environmental damage with extensive
mitigation and clean-up costs.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Review of a Previously Denied Application for Land Use (Change of Zone PZ-547) and a
request for a Substantial Change Determination.
SCH-24
1. Building permits shall be obtained prior to the construction of any building or structure.
2. A plan review is required for each building. Two complete sets of plans are required when
applying for each permit.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 Uniform Building Code,
1998 International Mechanical Code, 1997 International Plumbing Code, 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. (For residential
occupancies, walls shall be protected with one-hour fire resistive construction within three feet
of property lines and openings are not permitted within three feet of property lines) Separation
of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances for all structures, to include the bus shelter, shall be
determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
Property lines shall be clearly identified and all property pins shall be staked prior to the first
inspection. Approved building and foundation plans shall be on the site and available to
inspectors for each inspection.

7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.
