The Listrict has received notice concerning the requests for the formation of the Carbon Valley hetropolitan Recreation District. The District has no objection to the formation of a park and recreation district pursuant to Section 32-1-1G1 et. sea., C.k.S. 1973 (1982 Sup.) . however, the District does have objection to the formation of a metro- politan district pursuant to saic statutes. Under these applicable statutes, there is a distinction between a metro- politan district and a park and recreation district. A metropolitan district is a district which may provide two or more of the following services: fire protection, parks and recreation, safety protection, sanitation, street improvement, transportation, water, and miscellaneous functions. A park ana recreation district, however, is a special dis- trict which can provide only park or recreational facilities or programs within said district. If the proposed district is to provide only park and recreation facil- ities or programs, the Longmont Fire Protection District has no objection to its formation. however, if the proposed district is to be a metro- politan district, the Longmont Fire Protection District hereby objects to the formation because certain areas to be included within the proposed district lie within the Longmont Fire Protection District which provides fire protection services. naturally, this would lead to a duplication of efforts and would lead to double taxation of the property owners for the sane services provided. If the intention of the petitioners is to form merely a park and recre- ation district, we suggest that you seek clarification from the Weld County attorney as to the imrlications of the insertion of the word "met- ropolitan" into the name of the proposed district as stated herein, the 83090, /rt i i.
