Dear Sherri:
Thank you for referring the Jeff Stamp Minor Subdivision Change of Zone to the School District. The District has reviewed the
development proposal in terms of future student impacts and available school capacity and has the following
RECOMMENDATION: the District is OPPOSED to the approval of this application due to this development's impact on already
overcrowded school facilities.
The Board of Education has established a District-wide policy of opposing new developments that add to the student enrollment
of schools projected to be at or above 125% of their capacity. This particular application, which is currently located in the Mead
Elementary, Mead Middle, and Skyline High School Feeder, will add 9 new single-family dwelling units with a potential student
impact of 6 additional student in this feeder. The District opposes this development because, as indicated in the chart below for
the year 2003, Mead Middle School and Skyline High School will exceed 125% of their capacities with the addition of students
from this development.

The School District's current opposition to this proposal, may be modified if the developer can come to an agreement with the
School District regarding capacity concerns. To this end, School District policy acknowledges two possible ways to alleviate
capacity concerns. The first is that the developer agrees to mitigate their potential student impact on capacity by making a
voluntary, per unit contribution to the School District (in addition to cash-in-lieu funds noted below). Funds collected under this
policy would most likely add classroom space within the subject feeder or, in situations where additional capacity is known to be
eminent, provide portables. The second way to resolve capacity concerns would be for the developer to demonstrate that no
units will be constructed prior to the availability of school capacity, as indicated by the above chart. Should agreement be
reached on either of these possibilities, this office will write a new letter to the County updating this referral. The developer can
contact this office directly to further discuss either of these possibilities.
Should the County decide to recommend approval of this development proposal, the School District's cash-in-lieu and/or land
dedication requirements would still need to be satisfied. This requirement involves the dedication of land with the adjacent
infrastructure or payment of an equivalent cash-in-lieu fee based on the student yield of the development. Since this property is
not a likely future school site,the fee would be assessed per the attached chart. Please let me know of any further questions.
The recommendation of the District noted above applies to the attendance boundaries current as of the date of this letter. As a
result of new school construction in this feeder, boundary changes are likely within the next few years, which could affect the
capacity and school of attendance of this project. Under current attendance boundaries, transportation would most likely be
provided.

I have reviewed the submitted material pertaining to the change in zoning for the Jeff Stamp
minor subdivision, located north of and adjacent to Weld County Road 38; and west Weld County
Road 13. (Case Number: MX-1017). The Fire District does not object to the request for Change
in Zoning.
Fire hydrant locations will need to be approved before the final plat is approved. Construction
plans for the utilities showing the location of fire hydrants, the size of water mains and available
fire flows must be submitted to the Fire District for review and approval.

Weld County Public Works Department has reviewed this change of zone request. Comments made
during this phase of the subdivision process may not be all-inclusive, as other concerns or issues
may arise during the remaining application process.
Comments
❑ The County GIS mapping database shows a different parcel configuration than that proposed by the applicant.
The applicant shall provide the survey coordinate data on the change of zone plat describing specifically the
parcel proposed for development.
External Roadways:
❑ CR 38 is classified by the County as a local road and requires a 60-foot right-of-way. If the right-of-way cannot
be verified, it will be dedicated on the final plat.
❑ Based on the proposal of limited development, a traffic study is not currently required. The development will
add approximately 86 vehicle trips per day to CR 38 and the roadway system. A County traffic count taken
September 26, 2002, yielded 85 AADT.
❑ CR 38 is a gravel road. The applicant shall enter into an agreement with the County to proportionately share the
cost of improvements to CR 38. The agreement shall particularly include the Great Western Railroad crossing
at CR 38 in the immediate proximity of the development. The cost will be based on a proportion of the traffic
generated by the development to existing traffic. The applicant shall submit a proposed agreement with the
final plat application.
❑ Additional right-of-way shall be required adjacent to the bus pullout area equivalent to the width of the pullout
lane. Revisions must be made to the drawings, and this right-of-way shall be dedicated on the final plat.
Furthermore, the applicant shall show details of the bus pullout on the Road Plan&Profile.
❑ Appropriate referral agencies shall be contacted regarding the bus pullout, especially the school district of
jurisdiction. The applicant shall provide to the Public Works Department written documentation regarding this
issue along with the final plat application materials.
Internal Roadways:
❑ The applicant references two different names for the intemal roadway: Red Tail Court, and Stamp Boulevard.
The applicant shall decide on a name for the roadway and make the appropriate corrections.
❑ The intemal roadway cross-section shown on the change of zone plat is not acceptable. The typical roadway
cross-section should be shown as two 12-foot gravel lanes with 4-foot gravel shoulders on the change of zone
plat. The cul-de-sac edge of roadway radius shall be 50-feet minimum.
❑ All landscaping within the triangles must be less than 3'/ feet in height at maturity, and noted on the change of
zone plat. The applicant shall move the mailbox kiosk out of the sight distance triangle.
❑ Roadway and grading plans along with construction details will be required with the final plan submittal.
'•'� ❑ Easements shall be shown on the final plat in accordance with County standards and / or Utility Board
recommendations.

o The applicant shall enter into Improvements Agreements According to Policy Regarding Collateral For
Improvements. These agreements shall be submitted with the final plan application, and approved by the
BOCC prior to recording the final plat.
Drainage:
❑ The Final Drainage Investigation& Erosion Control Report for Stamp Minor Subdivision dated February 2003,
by Messner Engineering,Inc. is acceptable.
❑ Public Works does not accept concentrated flows from subdivisions directly into the County roadside ditches.
The drainage report provides evidence that the current historical drainage does not substantially increase. The
applicant's proposed drainage is acceptable.
❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage with the final
plan application. Front, rear and side slopes around building envelopes must be addressed. In addition,
drainage for rear and side lot line swales shall be considered. Building envelopes must be planned to avoid
storm water flows, while taking into account adjacent drainage mitigation.
o Final drainage construction and erosion control plans, conforming to the drainage report, shall be submitted
with the final plat application.
Recommendation
❑ The Public Works Department recommends approval of this change of zone.
The applicant shall address the comments listed above at the specific step of the review process
stated. The review process will continue only when all appropriate elements have been submitted.

1. Building permits shall be obtained prior to the construction of any building including a bus
stop shelter if provided.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for
each permit.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 Uniform Building Code;
1998 International Mechanical Code; 1997 International Plumbing Code; 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
Property pins shall be clearly identified and all property lines shall be identified by string
stretched between pins or by other approved means. Approved building and foundation plans
shall be on the site and available to inspectors for each inspection.

7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.

The Weld County Health Department has reviewed this proposal. The applicant proposes a 9
lot minor subdivision on 58.5 acres. The minimum lot size is 2.5 acres with an overall density of
one septic system per 6.5 acres.
The application has satisfied Chapter 24 of the Weld County Code in regard to water and sewer
service. The application states the water will be supplied by Little Thompson Water District. A
water main extension agreement between the applicant and Little Thompson Water District has
been included in the application materials. Sewer will be provided by individual sewage disposal
systems. The minimum proposed lot size (2.5 acres) coupled with the overall density of one
septic system per 6.8 acres does meet current Department policy.
Preliminary information in the geotechnical report conducted by Church and Associates, Inc.,
dated July 12, 2002, and submitted in the sketch plan application indicates all lots will require
engineered septic systems due to poor percolation test results. The existing home on proposed
Lot 5 also required an engineered system due to shallow bedrock and poor percolation rates,
and is consistent with the Church and Associates, Inc., findings. Surface slopes are estimated
to be 10 to 12% on the northeast portions of the site and 2 to 4% throughout most of the
property. Based on percolation test results, and topographical features it appears that any
septic systems installed on the site will be required to be designed by a registered professional
engineer.
The Department requested that the applicant designate two septic system envelopes on each lot
that meet all setbacks, including the 100-foot setback to any irrigation ditch (one located roughly
along the lot line between Lots 5 and 6). The engineer recommended that all absorption fields
be placed in non-irrigated areas of the lots. That applicant has placed 2 envelopes on each lot.
The Department further recommends that language for the preservation and/or protection of the
second absorption field envelope be placed in the development covenants. The covenants
should state that activities such as landscaping (i.e. planting of trees and shrubs) and
construction (i.e. auxiliary structures, dirt mounds, etc.) activities are expressly prohibited in the
designated absorption field site.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the Little Thompson Water District.

2. A Weld County septic permit is required for each proposed septic system,which shall
be installed in according to the Weld County individual sewage disposal system
regulations. Each septic system shall be designed for site-specific conditions,
including, but not limited to: maximum seasonal high groundwater, poor soils, and
shallow bedrock.
3. Language for the preservation and/or protection of the second absorption field
envelope shall be placed in the development covenants. The covenants shall state
that activities such as landscaping (i.e. planting of trees and shrubs)and construction
(i.e. auxiliary structures,dirt mounds,etc.) are expressly prohibited in the designated
absorption field site.
4. If required, the applicant shall obtain a storm water discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and the
Environment. Silt fences shall be maintained on the down gradient portion of the site
during all parts of the construction phase of the project.
5. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance conditions,at
the request of the Weld County Health Department, a fugitive dust control plan must
be submitted.
6. In accordance with the Regulations of the Colorado Air Quality Control Commission
any development that disturbs more than 5 acres of land must incorporate all

7. If land development creates more than a 25-acre contiguous disturbance,or exceeds
6 months in duration, the responsible party shall prepare a fugitive dust control plan,
submit an air pollution emissions notice, and apply for a permit from the Colorado
Department of Public Health and Environment.
8. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County
Code shall be placed on any recorded plat.
