HomeMy WebLinkAbout20031160.tiff 181 RESOLUTION RE: APPROVE CANCELLATION OF COLLATERAL FOR PHASE 1 THROUGH 4, AND DESIGNATION OF SAME TO BE APPLIED TO AMOUNT OWED FOR AMENDED AGREEMENT FOR ROAD IMPROVEMENTS TO WCR 35 AND 10 FOR BUFFALO RIDGE ESTATES, S #414 - MARTIN BROTHERS, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated January 29, 1997, the Board did approve the application of Martin Brothers, LLC, 216 Beth Avenue, Fort Lupton, Colorado 80621, for a Major Subdivision Final Plat on the following described real estate, to-wit: Part of the S1/2NW1/4 and part of the SW1/4 of Section 12, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, by Resolution #971278, dated July 2, 1997, the Board of County Commissioners of Weld County, Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements (Publicly Maintained Roads) for Buffalo Ridge Estates, S #414, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Martin Brothers, LLC,with terms and conditions being as stated in said agreement, and accepted Deeds of Trust for Phases 3 through 7 as collateral for Phases 1 and 2, and WHEREAS, the obligation of Phase 3 was canceled by an addendum approved by Resolution #2000-1819, dated July 31, 2000; the obligation of Phase 4 was canceled by an amended addendum approved by Resolution #2001-0192, dated January 22, 2001; and the amount of collateral held for Phases 1 through 4 of the project was reduced to $16,771.74, or 15 percent of the total amount, by Resolution #2001-2062, dated August 1, 2001, and WHEREAS, staff from the Weld County Department of Public Works has conducted a visual inspection of Phases 1 through 4 of the project and recommends cancellation of said collateral, and designation of same to be applied to the amount owed for the Amended Agreement for Road Improvements to WCR 35 and 10; and to accept the roads in Phases 1 through 4 to be placed on the County road system for full maintenance. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the collateral for Phases 1 through 4, in the amount of$16,771.74, be, and hereby is, canceled; and said collateral be, and hereby is, designated to be applied to the amount owed for Amended Agreement for Road Improvements to WCR 35 and 10 for Buffalo Ridge Estates, S #414. I understand that all of these have successfully completed their warranty phase and can be fully accepted as public roads. I am not certain if Public Works has formally documented this but I understand they are prepared to do so. There is currently cash in the amount of$16,771.74 still being held for warranty collateral for phases 1-4 and the warranty for 5-6 was provided by the Contractors warranty. Martin owes funds for the amended Road 10 agreement of July 31, 2000 and has asked that the money released for phase 1-4 be applied to that obligation. I propose the following course of action. Upon confirmation of Public Works, the warranty collateral for phase 1-4 shall be released and applied to the Road 10 obligation. The Deeds of Trust for Phase 5-6 should be released but the Phase 7 Deed of Trust should be retained Phase 1-6 should be accepted for full maintenance. The result of this will be that the developers may sell lots in all phases except phase 7. Lee D. Greeley, CO 80632 �1 Dear County Commission: On August 1, 2001 the Board of County Commissioners of Weld County, Colorado adopted the Resolution re"Approve Accepting Road for Public Maintenance, Approve Cancellation and Release of Collateral, and Accept Replacement Collateral for Buffalo Ridge Estates, S#414 — Martin Brothers, LLC". Among the resolutions adopted by the Board in the aforementioned resolution was "that $16,771.74, be, and hereby is, accepted to be retained in escrow with Weld County for a one-year period." The one-year period ended on August 1, 2002. We understand that once the Public Works Department has the opportunity to grant final acceptance on all the internal roads for phases 1-6 of Buffalo Ridge Estates,the retained escrow will be returned to Martin Brothers, LLC. On September 24, 2002, the Weld County Public Works Department billed Martin Brothers LLC the amount of$38,502.02 for its obligations relating to the paving of WCR10 from WCR37 to Buffalo Ridge Estates in accordance with our Road Improvement Agreement. On November 4,2002 Martin Brothers made a payment to Weld County in the amount of $10,000 toward this obligation. Martin Brothers currently owes Weld County the balance of$28,502.02 plus any accrued interest pursuant to our Road Improvement Agreement. We hereby respectfully request that Weld County proceed to grant final acceptance on all the internal roads for phases 1-6 of Buffalo Ridge Estates and then either: (1) return to Martin Brothers LLC the retained escrow funds referred to in the first paragraph of this letter and Martin Brothers LLC will then send a payment of similar amount to Weld County toward its obligations mentioned in the second paragraph of this letter; or (2) credit the retained escrow toward Martin Brothers LLC obligation mentioned in the second paragraph. The 15% of the asphalt items shall be retained for a period of one year. At the end of one year, and if no distress or repairs are needed to the asphalt, the 15% collateral ($16,771.74) shall be released. Weld County Public Works Department is recommending acceptance of the streets, Phases l-IV, for partial maintenance for the first year, which consists of snow removal only. The only remaining portion that needs to be completed is Phase 7, which requires a canal crossing. The Weld County Public Works requires a one-year guarantee for the workmanship and product for Phases 5 and 6. Usually a 15% collateral is held on the asphalt item. Since the collateral appears to be lots, we recommend the applicant secure a letter from Coulson Excavating Co., Inc. that guarantees Phases 5 and 6 for a one-year period. The Weld County Public Works Department recommend accepting Phases 5 and 6 for partial maintenance for the first year. At the end of one year and if there is no distress or repairs are needed, we will recommend that these phases be placed on the County roadway system for full maintenance.
