RE: APPROVE AGREEMENT FOR NUCLEAR TECHNOLOGIST TRAINING PROGRAM
AND AUTHORIZE CHAIR TO SIGN -AIMS COMMUNITY COLLEGE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for the Nuclear
Technologist Training Program between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Human
Services, and Aims Community College, commencing March 1, 2003, and ending October 31,
2004, with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement for the Nuclear Technologist Training Program
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and Aims
Community College be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of February, A.D., 2003.

AGREEMENT
THIS AGREEMENT, made this 1st day of March 2003, by and between the Board of Weld
County Commissioners of Weld County, Colorado, on behalf of the Weld County Division of
Human Services ' Employment Services of Weld County, hereinafter referred to as "Employment
Services,"the Weld County Workforce Development Board, hereinafter known as the Workforce
Development Board and Aims Community College,hereinafter known as Aims.
WHEREAS, Employment Services' and the Workforce Development Board's mission is to
keep the workforce system responsive to employers, employees and job seekers, and
WHEREAS, Employment Services, the Workforce Development Board and Aims are
developing strategies to address the shortage of skilled health care workers, and
WHEREAS, Aims delivers education and training activities, and
WHEREAS, Aims has developed partnership arrangements with Banner/North Colorado
Medical Center and Poudre Valley Hospitals for the implementation of a Nuclear Medicine
Technology Training Program, and
WHEREAS, Employment Services and the Workforce Development Board have received a
grant to implement a nuclear medicine technologist training program in partnership with Aims, and
WHEREAS, the Colorado Workforce Council's Skills Development Partnership
Committee's goal is to support local Workforce Investment Boards (Weld County Workforce
Investment Board) in sector-based activities (Nuclear Medicine Technology) that will produce
workers for high demand, high skilled jobs (nuclear medicine technologists) and increase the supply
of high skilled workers,
THEREFORE, in consideration of the premises, the parties hereto convents and agree as
follows:
I Purpose And Goal:
Addressing health care workforce shortages was identified as a high priority for the
Weld County Workforce Development Board after completion of an analysis of the
labor market for Northern Colorado. Currently in the Weld/Larimer County area,
there is a 30% to 50% shortage of nuclear medicine technologists. In Northeastern
Colorado alone, there are seven to ten positions available for nuclear medicine
technologists. Compounding the issue of the shortage of trained nuclear
technologists is the lack of nuclear medicine schools in Colorado. The closest
schools for training are in Omaha Nebraska or Las Vegas Nevada. In a study
completed by the American Health Association in April of 2002, radiology/nuclear
imaging shortages were experienced by 71% of the CEOs reporting significant
workforce shortages, second to nurses.

Employment Services has received a Workforce Investment Act 10% Discretionary
Grant to develop, in partnership with Aims Community College, a Nuclear Medicine
Technologist Training Program.
The program will be integrated within the community college system which provides
further eligibility for federal financial aid for students. The vision is high school
medical preparation programs become a channel for radiography students, which in
turn become another channel for nuclear medicine students. This project could also
provide help with initiating additional advanced imaging modality programs such as
Cardiovascular Imaging, Quality Management, Magnetic Resonance Imaging,
Computerized Tomography Imaging and Diagnostic Medical Sonography.
II Term:
The term of this Agreement shall commence March 1. :003, and end October 31,
2004, and is subject to the provision of Section W herein and future written
me 3ifications requested by any of the parties. Any party who wishes to rescind this
Agreement must provide written notice stating their intent to the other parties at least
thirty(30) days prior to the desired end date of the Agreement.
III Scope of Services:
A. Aims:
Aims will develop the curriculum in accordance with the academic and
clinical competencies established by the American Registry of Radiologic
Technologists. Aims will be the primary site for providing the academic
portion of the program, and will partner with hospitals in Greeley, Loveland,
Fort Collins, and Longmont to provide the clinical training for all students.
As contributions to the project, Aims will be responsible for working with the
hospitals to provide the clinical training sites, which will include, necessary
equipment, facility, patient contact and clinical supervision.
Level One Program would be a certificate program offered only to Registered
Technologists in Radiography. The average duration of the Level One
Program will be one year. However, program completion is based upon the
length of time the individual student needs to complete all required
competencies. After initiation of Level One, there is strong potential the
program would evolve into a two-year A.A.S. Degree program.

1. Expected Outcomes:
Aims agrees to assist in preparing quarterly reports on the
following expected outcomes.
a. Develop and implement a model training program which will address
the current workforce shortage for nuclear medicine technologists.
b. Development of a Level One Certificate at the Community College
level for Nuclear Medicine Technologists with possible
development of a two-year A.A.S. degree program.
c. Improve medical imaging services in Northeastern Colorado and
eventually in the State, by increasing training options for nuclear
medicine departments.
d. Increase available positions in diagnostic radiology departments by
providing additional avenues for advancements.
e. Develop a one-year Nuclear Medicine Technologist certificate
program.
£ Seven to ten registered technologists will obtain a certificate in
nuclear medical technology.
B. Payment Schedule:
1. Aims will be provided a total of Sixty-six Thousand Dollars ($66,000.00)
to pay for personnel's instructional salary, fringe benefits, curriculum
development and travel costs associated with this Agreement. These
funds will be paid in three installments.
a. The first installment, for curriculum development and program
design, will be provided in April 2003, for a total of Twenty-three
Thousand Dollars ($23,000.00).
b. The second installment, upon written verification of program design
and development and the beginning of training, will be made October
1, 2003, for Twenty-one Thousand and Five Hundred Dollars
($21,500.00).
c. The third installment, upon written verification of class continuation,
student achieving competencies and the structure to finish the project
is in place, will be made on April 1, 2004, for Twenty-one Thousand
and Five Hundred Dollars ($21,500.00).

2. Aims shall submit an itemized quarterly billing to Employment Services
for all costs incurred pursuant to this Agreement. Aims shall submit all
itemized billings to Employment Services no later than the fifteenth (15)
day of the month following the end of the quarter [the first quarter ending
June 30, 2003]. Billing statements must be signed by Aims.
3. Reimbursement of costs incurred pursuant to this Agreement is expressly
contingent upon the availability of funds to Employment Services of
Weld County.
C. Financial Management
At all times, from the effective date of this Agreement until completion of
this Agreement, Aims shall comply with the administrative requirements, cost
principles and other requirements set forth in the Financial Management
Manual adopted by the state of Colorado. The required annual audit of all
funds expended under General Assistance must conform to the Single Audit
Act of 1984 and OMB Circular A-133.
D. Payment Method
Unless otherwise provided in the Scope of Services and Payment Schedule:
1. Aims shall provide proper verification of services performed for costs
incurred in the performance of the Agreement.
2. Employment Services may withhold any payment if Aims has failed to
comply with the Financial Management Requirements, program
objectives, contractual terms, or reporting requirements.
E. Employment Services
1. Employment Services will provide assistance as necessary in the
development of the project.
2. Employment Services will coordinate quarterly reports with Aims for the
Office of Workforce Development.

IV Required Contract Clauses For Contracts And Purchase Order:
The Required Contract Clause for Contract and Purchase Orders for Workforce
Investment Act funds is attached as Exhibit I of this Agreement.
V Modification of Agreement:
All modifications to this Agreement shall be in writing and signed by all parties.
VI Severability:
If any term or condition of this Agreement shall be held to be invalid, illegal, or
unenforceable, this Agreement shall he construed and enforced without such
provision to the extent that this Agreement is then capable of execution within the
original intent of the parties hereto.
VII No Third Party Beneficiary Enforcement:
It is expressly understood and agreed that the enforcement of the terms, and
conditions of this Agreement and all rights of action relating to such enforcement,
shall be strictly reserved to the undersigned parties and nothing contained in the
Agreement shall give or allow any claim or right of action whatsoever by any other
person not included in this Agreement. It is the express intention of the undersigned
parties that any entity other than the undersigned parties receiving services or
benefits under this Agreement shall be an incidental beneficiary only.
VIII Entire Agreement:
The parties hereby agree that none have made or authorized any Agreement with
respect to the subject matter of this instrument other than expressly set forth herein,
and no oral representation,promise, or consideration different from the terms herein
contained shall be binding on any party, or its agents or employees, hereto. This
Agreement embodies all Agreements between the parties hereto and there are no
promises, terms, conditions, or obligations referring to the subject matter whereof
than as contained herein.
DC No Waiver of Immunity:
No portion of this Agreement shall be deemed to constitute a waiver of any
immunities the parties or their officers or employees may possess, nor shall any

portion of this Agreement be deemed to have related a duty of care which did not
previously exist with respect to any person not party to this Agreement. The parties
hereto acknowledge and agree that no part of this Agreement is intended to
circumvent or replace such immunities.
X Non-Appropriation:
None of the parties hereto shall be required to expend its public funds for any of the
undertakings set forth herein, without the express prior approval of its governing
body or director. Any financial obligations of the parties resulting from the
promises, covenants and/or terms set forth therein shall be subject to annual
appropriations as provided by law.
IN WITNESS WHEREOF the parties hereto have duly executed the Agreement as of this
day, month and year first above written.

Required Contract Clauses For
Contracts And Purchase Orders
The type of agreement entered into by a grantee or subgrantee may be fixed price or cost
reimbursement, depending on the method of procurement and goods or services being procured.
Each agreement funded by ETA grant programs must contain the specific clauses referred to in 29
CFR 97.36. These clauses are listed below.
1. Administrative, contractual or remedies in instances where contractors violate or breach
contract terms and provide for such sanctions and penalties as maybe appropriate.
(Contracts more than the simplified acquisition threshold).
2. Termination for cause and for convenience by the grantee or sub-grantee including the
manner by which it will be effected and the basis for settlement. (All contracts in excess of
$10, 000)
3. Compliance with Executive Order 11246 of September 24, 1965 entitled"Equal
Employment Opportunity," and as supplemented in Department of Labor regulations (41
CFR chapter 60). (All construction contracts awarded in excess of$1000 by grantees and
their contractors or sub-grantees).
4. Compliance with the Copeland"Anti-Kickback" Act (18 U.S.C. 874) as supplemented in
Department of Labor regulations (29 CFR part 3). (All contracts and sub-grants for
construction or repair).
5. Compliance with the Davis-Bacon Act (40 U.S.C. 276a to 276a-7) as supplemented by
Department of Labor regulations (29 CFR part 5). (Construction contracts in excess of
$2000 awarded by grantees and sub-grantees when required by Federal grant program
legislation).
6. Compliance with Sections 103 and 107 of the Contract Work Hours and Safety Standards
Act (40 U.S.C. 327-330) as supplemented by Department of Labor regulations (29 CFR Part
5). (Construction contracts awarded by grantees and sub-grantees in excess of$2000, and in
excess of$2500 for other contracts which involve the employment of mechanics or laborers).
7. Notice of awarding agency requirements and regulations pertaining to reporting.
8. Notice of awarding agency requirements and regulations pertaining to patent rights with
respect to any discovery or invention which arises or is developed in the course of or under
such contract.

9. Awarding agency requirements and regulations pertaining to copyrights and rights in data.
10. Access by the grantee, the sub-grantee, the Federal grantor agency, the Comptroller General
of the United States, or any of their duly authorized representatives to any books, documents,
papers, and records of the contractor which are directly pertinent to that specific contact for
the purpose of making audit, examination, excerpts, and transcriptions.
11. Retention of all required records for three years after grantees or sub-grantees make final
payments and all other pending matters are closed.
12. Compliance with all applicable standards, orders, or requirements issued under section 306
of the Clean Air Ac (42 U.S.C. 1857 (h), section 508 of the Clean Water Act (35 U.S.C.
1368), Executive Order 11738, and Environmental Protection Agency regulations (40 CFR
part 15). (Contracts, subcontracts, and sub-grants of amounts in excess of$100,000.
13. Mandatory standards and polices relating to energy efficiency which re contained in the state
energy conservation plan issued in compliance with the Energy Policy and Conversation Act.
(Pub. Law 94-163, 89 Stat. 871).

COLORADO SUBJECT: Agreement with Aims Community College
Enclosed for Board approval is an Agreement with Aims Community College to continue the
implementation of the Nuclear Medicine Technologist Training Program.
The Agreement is for the period beginning March 1, 2003 through October 31, 2004. Aims
Community College will be provided a total of$66,000 to develop curriculum and a partnership
model for training sites at Banner North Colorado Medical Center and other northern area
hospitals.
