HomeMy WebLinkAbout20030500.tiff HEARING CERTIFICATION DOCKET NO. 2003-19 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT #1411 FOR A CHURCH IN THE A(AGRICULTURAL) ZONE DISTRICT - CHRIST COMMUNITY CHURCH A public hearing was conducted on March 12, 2003, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner Robert D. Masden, Pro-Tem - EXCUSED Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated February 21, 2003, and duly published February 27, 2003, in the South Weld Sun, a public hearing was conducted to consider the request of Christ Community Church for a Site Specific Development Plan and Use by Special Review Permit #1411 for a Church in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair Long advised Fred Becker, applicant representative, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Masden will listen to the record and make the determining vote. Mr. Becker indicated he would like to proceed today. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She gave a brief description of the location of the site and surrounding uses, and stated the site currently contains no improvements. Ms. Lockman stated nine referral agencies reviewed this proposal and eight responded favorably, and staff has received no correspondence from surrounding property owners. She stated the applicant has not submitted evidence of an adequate water supply; however, they have indicated they intend to transfer the well permit servicing the existing church. She stated at this time the Division of Water Resources foresees no problem with the proposal; however, it was unwilling to commit in writing at this time. She further stated a well permit will be required prior to building, which means the existing church must be closed prior to the new church being available to service the congregation. Ms. Lockman stated if the Board agrees to waive the water requirement prior to building, staff recommends Development Standard #15 be amended to replace "Building Permits"with "Certificate of Occupancy." Responding to Commissioner Geile, Ms. Lockman clarified staff's intent of Condition #1 is to ensure the applicant includes the row of proposed 2003-0500 PL1652 HEARING CERTIFICATION - CHRIST COMMUNITY CHURCH (USR#1411) PAGE 2 cedar trees to screen the adjacent home, that the trash area is screened, and the lighting does not shine toward the adjacent home or right-of-way. She further stated the applicant will also be required to include a landscape cover, and natural grasses would be allowed. Commissioner Jerke expressed concern with the requirements listed under Conditions#1.C.1 through #1.C.3 due to the drought situation. He stated the State Water Engineer may not approve a permit allowing for outdoor watering, and there also needs to be some flexibility in requiring a plant material lists. In response to Commissioner Geile, Char Davis, Department of Public Health and Environment, stated there is a well connected to, and approved for, the existing church. Ms. Lockman stated the Division of Water Resources has indicated the current well permit will be transferable; however, only one well permit can be issued under the same organization name at one time. Don Carroll, Department of Public Works, stated Weld County Road 73 is designated as a collector status road, and staff is requesting the applicant reserve an additional 10 feet of right-of-way for future expansion of the road. He stated the applicants have indicated agreement with the request. He further stated the application proposes a circle drive for good circulation, which will be surfaced with crushed concrete, and will accommodate Americans with Disabilities Act (ADA) parking spaces. Mr. Becker submitted a copy of the well monitoring permit and a letter from the Division of Water Resources, marked Exhibit H. In response to Mr. Morrison, Mr. Becker stated Well Permit#245751 is a monitoring well that has not yet been drilled. Mr. Morrison stated this is a temporary well, and once the other parcel is sold and ownership changes the applicant will be allowed to commence using the well. No public testimony was offered concerning this matter. Commissioner Vaad commented Condition of Approval #1.C.3 could be amended to add to the end, "as allowed by authorities of competent jurisdictions." Mr. Becker stated the site has highly erodible soil; however, a majority of the church board consists of professional farmers who understand how to properly maintain the land. Ms. Lockman suggested Condition #2.A be stricken and moved to Condition #4.C, and that Development Standard #15 be amended to replace "Building Permits"with "Certificate of Occupancy." Commissioner Jerke suggested Conditions of Approval #1.C.1 and #1.C.2 be deleted regarding landscaping requirements and the remaining items renumbered accordingly. The board concurred. In response to Chair Long, Mr. Becker stated he has reviewed and agrees with the Conditions of Approval and Development Standards as modified. Commissioner Vaad moved to approve the request of Christ Community Church for a Site Specific Development Plan and Use by Special Review Permit#1411 for a Church in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting Conditions #1.C.1 and #1.C.2, amending #1.C.3 to add, "as allowed by authorities of appropriate jurisdictions," deleting Condition #2.A and moving that language to become Condition #4.C, amending Development Standard #15 to replace "Building Permits"with "Certificate of Occupancy," and renumbering or relettering as appropriate. The motion was seconded by Commissioner Geile, and it carried unanimously.
