Dear Ms. Roseman,
Your application for a Site Specific Development Plan and Use by Special Review Permit #1407
as a Use by Right, Accessory Use, or Use by Special Review, in the Commercial and Industrial
Zone Districts (towing, storage, sales, rental of motorcycles, cars, recreational vehicles,
noncommercial junkyard and auto pawn) in the A (Agricultural) Zone District, was recommended
unfavorably to the Board of County Commissioners by the Planning Commission. The legal
description of the property involved is shown as Lot A of Recorded Exemption #2012; part of the
E1/2 NE1/4 of Section 30, Township 2 North, Range 66 West of the 6th P.M., Weld County,
Colorado.
If you wish to be heard by the Board of County Commissioners, it will be necessary for you to
indicate your request by signing the bottom of this letter and returning it to this office. Regular
hearing procedures will then be followed.
In order to proceed as quickly as possible, we must receive your reply by November 13, 2003. If
we are not in receipt of your request by that date, the matter will be considered closed.

SUBJECT: Recommended conditions of approval and development
standards for USR-1407 (Roseman)
Planning Staff is recommending the following conditions of approval and development
standards be added to the resolution for USR_1407 (should it be approved):
1) Condition 1.Q (subsequently renumber): The applicant shall submit a copy of a
recorded easement agreement with oil & gas interests to provide access to existing oil &
gas facilities located immediately west of the property or submit evidence that an
adequate attempt had been made to address oil & gas access issues to the satisfaction
of the applicants and oil & gas operators. (Department of Planning Services)
2) Condition 1.R: The applicant shall submit a copy of an agreement with Kerr McGee
regarding their gas line along the northern property line or submit evidence that an
adequate attempt has been made to address their concerns. (Department of Planning

3) Condition 1.S: The applicant shall either submit to the Weld County Department of
Planning Services a copy of an agreement with the properties mineral owners/operators
stipulating that the oil and gas activities have adequately been incorporated into the
design of the site or show evidence that an adequate attempt has been made to mitigate
the concerns of the mineral owners. (Department of Planning Services)
4) Condition 1.T: The applicant shall submit a plan detailing how landscaping will be
irrigated and how sufficient water will be provided for landscaping. (Department of

5) The following sentence should be added to Development Standard #5: "Parking and
access areas located above the existing gas line near the north property line shall be
gravel only."

Dear Ms. Roseman
Your request for an extension of time to complete the referenced wells has been
received and reviewed.
You are hereby given notice that an extension of one year to September 12, 2004 has
been approved by the State Engineer pursuant to Colorado Revised Statute 37-90-137(3)(a)(II).
Copies of the amended well permits are enclosed.
Once the wells are completed a Notices of Completion must be filed by the well owner
prior to the expiration dates. Well completion and pump installation reports, including well and
permanent pump test data, must be submitted to this office by the contractors. After water from
the wells have been put to beneficial use, notices of Commencement of Beneficial Use must be
submitted to this office within 30 days by the well owner. Forms are available from well
contractors, pump installers, and Colorado Division of Water Resources offices.
Pursuant to the Statewide Nontributary Ground Water Rules, if the names and license
numbers of the licensed water well contractor or name of the private driller who will drill the well
was not known at the time the permit applications were submitted, or the listed licensed water
well contractors or private drillers who will drill the wells are changed prior to construction, the
permittee shall notify the State Engineer in writing of the names and license numbers of the new
water well contractors or names of the private drillers ten days prior to the commencement of
construction of the wells. Also, if any of the information provided in the application changes, the
permittee shall inform the State Engineer within 30 days.

PERMIT TO CONSTRUCT A WELL Northing: Easting:
ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIOIIOF APPROVAL.
1) This well shall be used in such a way as to cause no material kitty to existing water rights. The issuance of this permit does not assure the
applicant that no injury wit occur to another vested water right or preclude another owner of a vested water right from seeking relief fn a civil
cart action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2,unless approval of a valiance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(4)and the findings of the State Engineer dated, ti s 200 2 .
4) The maximum pumping rate of this well shall not exceed 15 GPM.
5) The average annual emoted of ground water to be appropriated shall not exceed 0.75 acre-feet
6) Production Is rotted to the Laramie-Fox Hills aquifer which is located 420 feet below land surface and extends to a depth of 680 feet Plain
casing must be Installed end Grouted to prevent the withdrawal of ground water from other aquifers and the movement of ground water
between aquiers.
7) The depth to the top of the Laramie-Fox Hilts aquifer is approximate. To ensure the exclusion of poor quality water from zones immediately
above the aquifer,plain casing and grout shall extend through the lowermost opal and/Or carbonaceous shale that overlies the Laramie sand
portion of the aquifer.
8) The entire length of the hole shall be geophyslcaay logged as required by Rule 9 of the Statewide Nonfrtbutary Ground Water Rules prier to
installing casing.
9) The owner shall mark the welt in a conspicuous place with well perm number(s),name of the aquifer,and court case number(s)as
appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be Metalled on this well and maintained in good waking order. Permanent records of all diversions must be
maintained by the well owner(recorded at least annually)and submitted to the Division Engineer upon request
11) This well shall be constructed at least 600 feet from any existing well,completed In the same aquifer,that is not owned by the applicant
12) This welt shall be constructed not more than 200 feet from the location specified on this permit.
13) Pursuant to CRS 37-30-137(9)♦b)and the Denver Basin Rules,no more than 98%of the nonbibutary ground water withdrawn annually shall
be consumed and the well owner shall demonstrate to the reasonable satisfaction of the State Engineer that no more than 98%of the water
withdrawn we be consumed.
14) This well is subject to administration by the Division Engineer In accordance with applicable decrees,statutes,rides,and regulations.
NOTE:The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer may be less than the 100 years
upon wtnidi the amount of water in the aquifer is allocated,due to anticipated water level declines.
NOTICE:This permit has been approved with a change to the permit application form from that applied for by the applicant. You are hereby
notified that you have the right to appeal the issuance of this permit,by filing a written request with this office within sixty(60)days of the date
of issuance,pursuant to the State Administrative Procedures Act.(See Section 24-4-104 through
