eColorado Interstate Gas an El Paso company June 19, 2003 Weld County Commissioners ,jjefQGx l -44 915 10th Street Greely, Colorado 80631 / CAA- � v� Dave Long-Chairman S a etatizo Re: Colorado Interstate Gas Company/Cheyenne Plains Pipeline Project Dear Mr. Long: This letter is to inform you that Colorado Interstate Gas Company(CIG), a subsidiary of El Paso Corporation,plans to construct the Cheyenne Plains Gas Pipeline (CPGP) in 2004. The pipeline will consist of 380 miles of 30-inch diameter interstate pipeline and appurtenant facilities for the transportation of natural gas from CIG's existing Cheyenne Compressor Station located in Weld County, Colorado to facilities located in Kiowa County, Kansas. The primary purpose of the Project is to transportation natural gas to markets in the Midwest. As a result of development of natural gas resources in the Rocky Mountains, the Project will allow CIG to deliver 540 million decatherms (MDth) of natural gas per day to those markets. CIG has evaluated relevant technical, engineering and environmental factors and has determined that the most appropriate route for the pipeline will result in it crossing property in Weld County. CIG is contacting landowners along the proposed route to negotiate with them in good faith to acquire right-of-way easements for the Project. CIG is expecting to reach amicable agreements with all of the Weld County landowners for the acquisition of the necessary right-of- way easements. In the past CIG has received questions from some counties in Colorado regarding the effect of H.B. 1041 Regulations and other state and local land use regulations on the Project. Let me explain why neither the 1041 Regulations and process nor any other local land use controls apply to this Project. There are two primary reasons. First, Colorado Law provides that CIG is not a Public Utility, and is not subject to the jurisdiction of the Colorado Public Utilities Commission. See, Public Utilities Com'n v. Colorado Interstate Gas Company 351 P.2d 241, 250 (Colo. 1960). Therefore, CIG is not subject to state or county H.B. 1041 regulations concerning areas and activities of state interest. Those regulations apply, in the context here, to the site selection and construction of major facilities of a public utility. See, C.R. S. § 24-65.1-203 (1)(b)(f). A public utility is defined in C.R.S. § 40-1103(1)(a) as being ... CIG, as noted above, is not a public utility under Colorado law and is not subject to the jurisdiction of the Public Utilities Commission. Hence, it is not subject to H.B. 1041 regulations. Second, CIG is a Natural Gas Company within the meaning of 15 U.S.C. § 717a(6) because it is engaged in the transportation of natural gas for sale or resale in interstate commerce. As a Natural Gas Company, the design, construction and operation of the Project's facilities are under the exclusive jurisdiction of the Federal Energy Regulatory Commission(FERC). Hence, it is the FERC that has the exclusive jurisdiction to determine whether an interstate pipeline can be constructed by CIG, under what conditions, and where. The FERC controls the site selection, authorization, and oversight of the construction and operation of this Project. See, Algonquin LNG v. Loqa, 79 F. Supp.2d 49 (D.R.I., 2000); and Schneidewind v. ANR Pipeline Co.,485 U.S. 293, 300 (1988). Federal law and the Supremacy Clause of the United States Constitution preempt regulation of these matters. CIG is in the process of submitting an application to the FERC for approval of the Project. Nevertheless, CIG understands that Weld County wants to be informed as to the Project's route, as well as the technical and environmental aspects of the Project. For your review, we have enclosed a brief project narrative, an exhibit depicting the Pipeline alignment and location of the Project described by section, township, and range. Also enclosed is a copy of CPGP's Section 7(c) Application to the FERC, including a copy of the Environmental Report. CPGP, by providing this information, is acting as a good neighbor. A Cheyenne Plains ep Gas Pipeline an El Paso company InE4K Pipeline Safety Information For the first time in six years, Congress has successfully completed and passed pipeline safety legislation. With the passage of the Pipeline Safety Improvement Act, Congress has completed a critical step in ensuring the safety and reliability of the nation's interstate natural gas pipeline system. This legislation reauthorizes and strengthens Federal pipeline safety programs, providing additional funding for safety enforcement and research and development efforts. It also provides for increased State oversight authority and facilitates greater public education efforts at the local community level. The President signed the legislation into law on December 17, 2002. Highlights of the "The Pipeline Improvement Act of 2002" • The Act establishes an additional pipeline integrity management program in all "high consequence" areas (population centers) requiring the inspection of all facilities in such areas within 10 years to establish a base line. These facilities will be re-inspected every seven years thereafter, unless the Secretary waives the requirement. Fifty percent of the riskiest pipeline segments must be inspected in the first 5 years of the 10-year baseline period. The Secretary will review the programs and may order revisions. States will be forwarded a copy of the programs. States can make recommendations. The Secretary will conduct a rulemaking on security measures to protect pipes from terrorism. • The legislation improves the states' "one-call notification systems" to avoid damage to pipelines by a third party. This improves the ability of contractors to conduct their activities without the danger of digging up gas lines or other underground infrastructure. • The bill establishes "whistle blower" protection for pipeline employees. Previously there were no"whistle blower"protections for pipeline workers. • The bill improves the authority under which the Secretary of the Department of Transportation (DOT) can order an operator to fix a pipeline that has a potentially unsafe condition. • The penalties that can be sought against operators who violate regulations are increased and the regulations are expanded to broaden the safety requirements on operators. At the request of the DOT, the Attorney General may bring a civil suit to enforce certain safety regulations. • The bill allows the Secretary of Transportation to award technical assistance grants to community groups for engineering and scientific analysis of pipeline safety issues and to promote the participation in official DOT processes. Grants cannot be used for lobbying or lawsuits. • The bill requires the study of land use practices and zoning ordinances to limit encroachment on existing pipeline rights-of-way, prevent risks to the public, and raise awareness. This study is to be completed within one year. • The bill authorizes $100 million for research and development to improve pipe quality, materials inspection, security, information control, improve excavation and repair technologies. • Operators will be required to develop and adopt additional qualification programs that ensure individuals are qualified to conduct the tasks they are assigned. The Secretary will review and approve these programs. The Secretary can order an operator to revise its program. • The bill establishes a streamlined process for obtaining permits to make repairs to pipelines. This is necessary to expedite the process of permitting for the repair of damaged pipelines, in order to limit the potential risk to the public and the environment. • The bill improves State oversight over the framework within which States may participate in oversight of interstate pipelines. • The bill provides for grants to emergency responders who are the first-on-the-scene of a pipeline accident to improve their preparation in the event of an emergency, as well as the coordination of accident responses.
