CODE ORDINANCE 2003-8
IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5
APPENDICES, OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY
OF WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of
Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with
the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld,
including the codification of all previously adopted ordinances of a general and permanent nature
enacted on or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirement therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be,
and hereby are, repealed and re-enacted, with amendments, and the various Chapters are
revised to read as follows.

BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby
is, directed to arrange for Colorado Code Publishing to supplement the Weld County Code with
the amendments contained herein, to coincide with chapters, articles, divisions, sections, and
sub-sections as they currently exist within said Code; and to resolve any inconsistencies
regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions,
sections, and sub-sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph,
sentence, clause, or phrase of this Ordinance is for any reason held or decided to be
unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The
Board of County Commissioners hereby declares that it would have enacted this Ordinance in
each and every section, subsection, paragraph, sentence, clause, and phrase thereof
irrespective of the fact that any one or more sections, subsections, paragraphs, sentences,
clauses, or phrases might be declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 2003-8 was, on motion duly made and
seconded, adopted by the following vote on the 22nd day of December, A. D., 2003.

RATES FOR CLERK TO THE BOARD
TRANSCRIPTS FROM TAPES:
IF TRANSCRIBED IN-HOUSE: $60.00/hour for time spent on the transcription, plus
$2.50 per page. (Provides two certified copies of transcript to requestor.) Minimum
charge of $60.00, with a deposit of three times the clock time of the tape to be paid in
advance, with balance payable prior to receipt of transcript. Transcripts will be completed
as staff time is available. Fee non-refundable. No deadline will be assured.
IF TRANSCRIBED BY OTHER THAN CLERK TO BOARD STAFF: Actual cost of
services performed, including postage and delivery charges, with one paper copy of
transcript and one copy on diskette provided for County. Minimum charge of $60.00, with
a deposit of estimated costs figured at $4.00 per page and 45 pages per hour, plus $20.00
for postage and handling.
COPIES OF TAPES/USE OF RECORDING EQUIPMENT:
$30.00 machine set-up fee plus $10.00/hour for use of equipment and $19.50/hour for
clerk's salary for time spent copying tapes, pro-rated to half-hour segments, based on
estimated time of hearing; and $5.00 per tape. Estimated cost or minimum charge of
$60.00 (whichever is highest) to be paid in advance. No unsupervised use of equipment
will be allowed. Copies of tapes will be completed as staff time is available. No deadlines
will be assured.
SENDING RECORDS BY FAX:
Cost of research of public records, as listed in Appendix 5-D, #6 plus long distance
charges, as estimated by Phone Services Manager.

REQUIRED BID AMOUNT
Pursuant to Article XIV, Section 14-9, Section 5 of the
Weld County Home Rule Charter,
written, sealed bids and a ten-day period
for consideration and investigation of the bids is required
for purchases in excess of an amount set annually
by the Board of County Commissioners by Ordinance.
Through repeal and re-enactment of this Appendix,
the amount set for the year 2004 is $10,000.00.
