THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST BE
DENIED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the
Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-2-220 of the Weld County Code as follows:
a. Section 23-2-220.A.2--The proposed use is not consistent with the intent of the 1-3 (Industrial)
Zone District.Section 23-3-330.D.4 of the Weld County Code provides for commercial junkyards
or salvage yards as a Use by Special Review in the 1-3 (Industrial)Zone District. However, the
1-3 Zone District does not allow for mobile homes for housing of customers.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.

Should the Weld County Planning Commission choose to approve 2n° AMUSR-842 Planning staff
recommends the following be included as Conditions of Approval:
1. Prior to scheduling the Board of County Commissioners hearing:
A. The applicant shall submit to the Weld County Department of Planning Services a signed copy
of an agreement with the properties mineral owners which stipulates that oil and gas activities
have been adequately incorporated into the design of the site or submit evidence that mineral
owners concerns have been mitigated. (Department of Planning Services)
2. Prior to recording the plat:
A. All pages of the final plat shall be labeled: 2n°AMUSR-842. (Department of Planning Services)
B. Tires have been placed adjacent to all County roads to discourage trespassers from accessing
the site. The Design and Operations plan indicates that these tires will remain as post-closure
security. This is not an accepted fencing method. To ensure the facility is secure and not
accessible to unauthorized personnel,the applicant shall submit a fencing plan to the Department
of Planning Services for review and approval. (Department of Planning Services)
C. All septic systems located on the property shall have appropriate permits from the Weld County
Department of Public Health and Environment. The Environmental Health Division of the Weld
County Department of Public Health and Environment was unable to locate a septic permit for
the camper trailer currently located north of the office.Any existing septic systems(s)which is not
currently permitted through the Weld County Department of Public Health and Environment will
require an I.S.D.S.evaluation prior to the issuance of the required septic permits(s). In the event
the system(s) is found to be inadequate, the system(s) must be brought into compliance with
current I.S.D.S. regulations. Evidence of approval shall be submitted to the Weld County
Department of Planning Services.(Weld County Department of Public Health and Environment)
D. The plat shall be amended to delineate the following:
1) The specific sequence of pit construction on the new 40-acre portion of the site. (Colorado

2) The approved fencing. (Department of Planning Services)
3) County Road 41 is designated on the Road Capital Improvement plan in the County Wide
Impact Fee Code Ordinance, Section 20-1-30, as a collector status road,which requires
80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. An
additional ten feet shall be delineated on the plat as right-of-way reservation for future
expansion of County Road 41. This road is maintained by Weld County. (Department of

4) Areas used for sorting and processing tires. (Department of Planning Services)
E. The Fire Safety Evaluation and Fire Control Plan for the site shall prohibit activities such as
welding, grinding, or other spark producing sources at or near tire storage areas. Evidence of
Colorado Department of Public Health and Environment approval of the Fire Control Plan shall
be submitted to Planning Services. (Colorado and Weld County Departments of Public Health

F. The applicant shall submit evidence to the Department of Planning Services that the Platteville
Fire Protection District has reviewed and approved the Fire Safety Evaluation and Fire Control

G. Section 23-3-330.C.4 of the Weld County Code allows for one mobile home when used as living
quarters for caretakers or security personnel responsible for maintaining or guarding the property.
Additional mobile homes/travel trailers shall be removed from the site or be stored in a
designated storage area.Additional mobile homes/travel trailers shall not be used on any basis
as a dwelling or as overnight or temporary housing for any person. (Department of Planning

H. The applicant shall submit a letter requesting to withdraw USR-1361 which included only the new
tire storage area. (Department of Planning Services)
I. Above ground tire stockpiles shall not exceed 10 feet in height and shall be separated by a
minimum width of 50 feet. (Department of Public Health and Environment)
J. Spillage retention berms shall be placed around any container holding fuel or oil with a volume
greater than 50 gallons. The volume retained by the spillage berm should be greater than the
volume of the largest tank inside the berm. (Department of Public Health and Environment)
K. The portable toilet adjacent to the storage area must be removed from the site or located within
a storage area where it will not be accessible for use. (Department of Public Health and

3. Prior to the use of the new 40-acre portion of the site:
A. The applicant shall forward a copy of the final Use by Special Review Plat Map to the Colorado
Department of Public Health and Environment. (Colorado Department of Public Health and

B. Financial assurance for the entire facility shall be finalized by the Colorado Department of Public
Health and Environment. Evidence that the Colorado Department of Public Health and
Environment has accepted the financial assurance shall be submitted to the Department of

C. All fencing shall be in place. (Department of Planning Services)
D. All tires placed along road rights-of-way shall be removed. (Department of Planning Services)
4. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the
property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and

1. The Site Specific Development Plan and Special Use Permit is for Commercial Junkyard and Salvage
Yard (tire landfill, storage and recycling facility) along with a Certificate of Designation and a mobile
home for housing of tire purchasers in the 1-3 (Industrial)Zone District, as indicated in the application
materials on file and subject to the Development Standards stated hereon. (Department of Planning

2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County
Code. (Department of Planning Services)
3. Storage cells shall be constructed for tire storage as follows:
A) Before construction of each cell, a 10-foot deep hole shall be excavated near the center of the
proposed trench area and shall be left open for a minimum of three days to determine
groundwater depth. A minimum of 2 feet separation shall be maintained between the lowest
elevation of the cell and the highest elevation of the groundwater. (Department of Public Health

B) Storage cells will be constructed in accordance with the facilities Design and Operations Plan and
Fire Safety Evaluation and Fire Control Plan dated April 28, 2003 and accompanying

C) No more than eight(8)cells shall be excavated and exposed or filled at a time. (Department of

D) A minimum of 50 feet shall be maintained between the top of each cell to allow for an adequate
firebreak and access. (Department of Public Health and Environment)
4. Fire equipment access roads shall be a minimum of 50 feet wide, capable of providing access in all
weather conditions and capable of supporting fire equipment of 50,000 pounds. (Department of Public

5. Tires in the cells shall be stacked a maximum of 4 feet above the fire lane surface elevation. An
additional 1-foot will be allowed for unevenness of the tire surfaces. Steel posts will be installed to a
height of 5 feet above ground elevation adjacent to and at the North-South center point on both sides
of each cell. The top 1-foot (from 4 to 5 feet) will be painted a bright color to allow for easier

6. Volume records shall be maintained which include number of incoming tires, tires placed in storage
trenches, tires recycled on site, and tires recycled off site. These counts shall be recorded daily and
accumulated monthly and annually. An annual report shall be submitted to the Weld County Health
Department of Public Health and Environment and the Colorado Department of Public Health and
Environment beginning May 1 of each year. (Department of Public Health and Environment)
7. Tires received at the facility shall be placed into cells upon receipt. Tires stockpiled above ground for
processing and/or recycling shall be stockpiled for a time not to exceed 30 days. Above ground tire
stockpiles shall not exceed 10 feet in height and shall be separated by a minimum width of 50 feet.

8. The facility shall comply with the facility's Fire Safety Evaluation and Fire Control Plan and the
requirements of the Platteville Fire Protection District at all times. (Department of Public Health and

10. The property owner or facility operator shall notify the Weld County Department of Public Health and
Environment, Department of Planning Services, Colorado Department of Public Health and
Environment, and Platteville Fire Protection District in the event of a change in the availability of
equipment or soil identified for fire protection,or changes in the Fire Control Plan.(Department of Public
Health and Environment)
11. A copy of the recorded plat and development standards will be forwarded and filed with the Colorado
Department of Public Health and Environment. (Department of Public Health and Environment)
12. No permanent disposal of wastes, other than waste tires, shall be permitted at this site. (Department

13. Any liquid or solid wastes(as defined in the Regulations Pertaining to Solid Waste Disposal Sites and
Facilities",as promulgated by the Solid Waste Disposal Sites and Facilities Act,Title 30,Article 20,part
1,C.R.S.,as amended)shall be stored and removed for final disposal in a manner that protects against

14. The facility shall be constructed and operated to ensure that contamination of soil and groundwater
does not occur. (Department of Public Health and Environment)
15. Fugitive dust and fugitive particulate emissions shall be controlled on this site. (Department of Public

16. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured
according to Section 25-12-102, CRS. (Department of Public Health and Environment)
17. The property shall be maintained in compliance at all times with the soil conservation plan approved by
Platte Valley Soil Conservation Service. (Department of Public Health and Environment)
18. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department
of Public Health & Environment, Water Quality Control Division. (Department of Public Health and

19. Surface drainage shall be directed away from the active cells and will be allowed to flow off of the facility
into the natural drainage ways. Stormwater runoff from the facility shall not exceed the rate of historic
runoff.The need for stormwater discharge permit will be evaluated in the event stormwater runoff from
the facility disrupts normal flows off of the facility. (Department of Public Health and Environment)
20. A safe and adequate sewage disposal system shall be available on the facility premises. (Department

21. A safe and adequate fresh water supply shall be available on the facility premises. (Department of

22. In the event that the facility closes permanently, and tires are not used for recovery or recycling
operations within 10 years after closure,filled tire cells containing tires will be covered with a minimum

of 2 feet of soil. Cells that are either partially filled or unused shall be filled to grade with soil. The 10
year limit may be extended with approval from the Colorado Department of Public Health and

23. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control
Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste
Division, and any other applicable agency. (Department of Public Health and Environment)
24. Activities such as welding, grinding, or other spark sources shall not be permitted near tire storage
areas. (Colorado Department of Public Health and Environment)
25. Off-street parking spaces including the access drive circulation through the cell area shall be surfaced
with gravel or the equivalent and shall be graded to prevent drainage problems. (Department of Public

26. The historical flow patterns and run-off amounts will be maintained on site in such a manner that will
reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off. (Department of Public Works)
27. In the event that any area is proposed to be leased to another party in the future, the applicant shall
submit a copy of the lease agreement and information regarding the proposed use of the leased portion
to the Weld County Attorney's office, Weld County Building Inspection Department, Platteville Fire
Protection District and the Department of Planning Services for review. Based upon the proposed use
and/or impacts of the leased portion, the Department of Planning Services may require a new Use by

28. The existing mobile home on site shall be used as living quarters for caretakers or security personnel
responsible for maintaining or guarding the property in accordance with Section 23-3-330.C.4 of the
Weld County Code. (Department of Planning Services)
29. No Trespassing" signs shall be posted and maintained on the perimeter to clearly identify the
boundaries of the site. (Department of Planning Services)
30. The property owner or operator shall be responsible for complying with the approved Certificate of
Designation. (Department of Planning Services)
31. The property owner or operator shall be responsible for complying with the approved Design and
Operations Plan. (Department of Planning Services)
32. The applicant shall be allowed one thirty six square foot entrance sign as well as a sixteen square foot
sign for the leased portion of the site. (Department of Planning Services)
33. The property owner or operator shall be responsible for complying with the Design Standards of Section
23-2-240, Weld County Code.
34. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 23-2-250, Weld County Code.
35. Weld County personnel shall be granted access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with the Development Standards stated herein
and all applicable Weld County regulations.

36. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Board of County Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall be filed in the office of the Department
of Planning Services.
37. The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
5.1 Issuance of Certificates of Designation for new facilities for solid waste disposal:
Certificates of Designation are issued by Boards of County Commissioners in accordance
with requirements for the consideration of applications contained in Sections 30-20-104
and 30-20-105, of the Act.
5.1.1 Factors to by considered:
1) In considering an application for a Certificate of Designation, the Board of County
Commissioners shall take into account:
A) The effect that the solid wastes disposal site and facility will have on the
surrounding property, taking into consideration the types of processing to be
used, surrounding property uses and values, and wind and climatic conditions;
The expansion of the tire storage area is bordered on the north and south by
existing tire storage. The proposal should have little, if any, additional impact
on surrounding properties.

B) The convenience and accessibility of the solid wastes disposal site and facility
to potential users;
The site is easily accessed by paved roads from all directions.
C) The ability of the applicant to comply with the health standards and operating
procedures provided for in the Act and such rules and regulations as may be
prescribed by the Department;
Conditions of Approval and Development Standards include requirements from
both Weld County and the State of Colorado Departments of Health and
Environment.
D) Recommendations by local health departments.
Both Weld County and the State of Colorado Departments of Health and
Environment have recommended approval of the proposal dependant upon the
attached Conditions of Approval
2) Except as provided in the Act, designation of approved solid wastes disposal sites
and facilities shall be discretionary with the board of County Commissioners, subject
to judicial review by the district court of appropriate jurisdiction.
3) Prior to the issuance of a Certificate of Designation, the Board of County
Commissioners shall require that the report which shall be submitted by the
applicant under section 30-20-103 of the Act be reviewed and a recommendation as
to approval of disapproval made by the Department and shall be satisfied that the
proposed solid waste disposal site and facility conforms to the comprehensive
county land use plan, if any. The application, report of the department,
comprehensive land use plan, and other pertinent information shall be presented to
the Board of County Commissioners at a public hearing to be held after notice. Such
notice shall contain the time and place of the hearing and shall state that the matter
to be considered as the applicant's proposal for a solid waste disposal site and
facility. The notice shall be published in a newspaper having general circulation int
eh county in which the proposed solid wastes disposal site and facility is located at
least ten but not more than thirty days prior to the date of the hearing.
5.1.2 If the Board of County Commissioners deems that a Certificate of Designation
should be granted to the applicant, it shall issue the certificate, and such certificate
shall be displayed in a prominent place at the site and facility. The Board of County
Commissioners shall not issue a Certificate of Designation if the department has
recommended disapproval pursuant to Section 30-20-103 of the Act.
5.1.3 The County Board of Commissioners shall forward a copy of the Certificate of
Designation to the Department

This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
Should the Weld County Planning Commission choose to approve 2n° AMUSR-842 Planning staff
recommends the following be included as Conditions of Approval:
1. Prior to scheduling the Board of County Commissioners hearing:
A. The applicant shall submit to the Weld County Department of Planning Services a signed
copy of an agreement with the properties mineral owners which stipulates that oil and gas
activities have been adequately incorporated into the design of the site or submit evidence
that mineral owners concerns have been mitigated. (Department of Planning Services)
2. Prior to recording the plat:
A. All pages of the final plat shall be labeled: 2n°AMUSR-842. (Department of Planning Services)
B. Tires have been placed adjacent to all County roads to discourage trespassers from
accessing the site. The Design and Operations plan indicates that these tires will remain as
post-closure security. This is not an accepted fencing method. To ensure the facility is secure
and not accessible to unauthorized personnel, the applicant shall submit a fencing plan to the
Department of Planning Services for review and approval. (Department of Planning Services)
C. All septic systems located on the property shall have appropriate permits from the Weld
County Department of Public Health and Environment. The Environmental Health Division of
the Weld County Department of Public Health and Environment was unable to locate a septic
permit for the camper trailer currently located north of the office. Any existing septic
systems(s)which is not currently permitted through the Weld County Department of Public
Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the
required septic permits(s). In the event the system(s) is found to be inadequate, the
system(s) must be brought into compliance with current I.S.D.S. regulations. Evidence of
approval shall be submitted to the Weld County Department of Planning Services. (Weld

D. The plat shall be amended to delineate the following:
1) The specific sequence of pit construction on the new 40-acre portion of the site.

2) The approved fencing. (Department of Planning Services)
3) County Road 41 is designated on the Road Capital Improvement plan in the County
Wide Impact Fee Code Ordinance, Section 20-1-30, as a collector status road, which
requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-
way. An additional ten feet shall be delineated on the plat as right-of-way reservation for
future expansion of County Road 41. This road is maintained by Weld County.

E. The Fire Safety Evaluation and Fire Control Plan for the site shall prohibit activities such as
welding, grinding, or other spark producing sources at or near tire storage areas. Evidence of
Colorado Department of Public Health and Environment approval of the Fire Control Plan
shall be submitted to Planning Services. (Colorado and Weld County Departments of Public
Health and Environment)
F. The applicant shall submit evidence to the Department of Planning Services that the
Platteville Fire Protection District has reviewed and approved the Fire Safety Evaluation and
Fire Control Plan. (Department of Planning Services)
G. Section 23-3-330.C.4 of the Weld County Code allows for one mobile home when used as
living quarters for caretakers or security personnel responsible for maintaining or guarding the
property. Additional mobile homes/travel trailers shall be removed from the site or be stored in
a designated storage area. Additional mobile homes/travel trailers shall not be used on any
basis as a dwelling or as overnight or temporary housing for any person. (Department of

H. The applicant shall submit a letter requesting to withdraw USR-1361 which included only the
new tire storage area. (Department of Planning Services)
I. Above ground tire stockpiles shall not exceed 10 feet in height and shall be separated by a
minimum width of 50 feet. (Department of Public Health and Environment)
J. Spillage retention berms shall be placed around any container holding fuel or oil with a volume
greater than 50 gallons. The volume retained by the spillage berm should be greater than the
volume of the largest tank inside the berm. (Department of Public Health and Environment)
K. The portable toilet adjacent to the storage area must be removed from the site or located
within a storage area where it will not be accessible for use. (Department of Public Health and
Environment)
3. Prior to the use of the new 40-acre portion of the site:
A. The applicant shall forward a copy of the final Use by Special Review Plat Map to the
Colorado Department of Public Health and Environment. (Colorado Department of Public

B. Financial assurance for the entire facility shall be finalized by the Colorado Department of
Public Health and Environment. Evidence that the Colorado Department of Public Health and
Environment has accepted the financial assurance shall be submitted to the Department of

C. All fencing shall be in place. (Department of Planning Services)
D. All tires placed along road rights-of-way shall be removed. (Department of Planning Services)
4. The Special Review activity shall not occur nor shall any building or electrical permits be issued on
the property until the Special Review plat is ready to be recorded in the office of the Weld County

Yard (tire landfill, storage and recycling facility) along with a Certificate of Designation and a mobile
home for housing of tire purchasers in the 1-3 (Industrial)Zone District, as indicated in the application
materials on file and subject to the Development Standards stated hereon. (Department of Planning

2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County
Code. (Department of Planning Services)
3. Storage cells shall be constructed for tire storage as follows:
A) Before construction of each cell, a 10-foot deep hole shall be excavated near the center of the
proposed trench area and shall be left open for a minimum of three days to determine
groundwater depth. A minimum of 2 feet separation shall be maintained between the lowest
elevation of the cell and the highest elevation of the groundwater. (Department of Public Health

B) Storage cells will be constructed in accordance with the facilities Design and Operations Plan and
Fire Safety Evaluation and Fire Control Plan dated April 28, 2003 and accompanying

C) No more than eight (8)cells shall be excavated and exposed or filled at a time. (Department of

D) A minimum of 50 feet shall be maintained between the top of each cell to allow for an adequate

4. Fire equipment access roads shall be a minimum of 50 feet wide, capable of providing access in all
weather conditions and capable of supporting fire equipment of 50,000 pounds. (Department of Public

5. Tires in the cells shall be stacked a maximum of 4 feet above the fire lane surface elevation. An
additional 1-foot will be allowed for unevenness of the tire surfaces. Steel posts will be installed to a
height of 5 feet above ground elevation adjacent to and at the North-South center point on both sides
of each cell. The top 1-foot (from 4 to 5 feet) will be painted a bright color to allow for easier

6. Volume records shall be maintained which include number of incoming tires, tires placed in storage
trenches, tires recycled on site, and tires recycled off site. These counts shall be recorded daily and
accumulated monthly and annually. An annual report shall be submitted to the Weld County Health
Department of Public Health and Environment and the Colorado Department of Public Health and
Environment beginning May 1 of each year. (Department of Public Health and Environment)
7. Tires received at the facility shall be placed into cells upon receipt. Tires stockpiled above ground for
processing and/or recycling shall be stockpiled for a time not to exceed 30 days. Above ground tire
stockpiles shall not exceed 10 feet in height and shall be separated by a minimum width of 50 feet.

8. The facility shall comply with the facility's Fire Safety Evaluation and Fire Control Plan and the
requirements of the Platteville Fire Protection District at all times. (Department of Public Health and

10. The property owner or facility operator shall notify the Weld County Department of Public Health and
Environment, Department of Planning Services, Colorado Department of Public Health and
Environment, and Platteville Fire Protection District in the event of a change in the availability of
equipment or soil identified for fire protection,or changes in the Fire Control Plan.(Department of Public
Health and Environment)
11. A copy of the recorded plat and development standards will be forwarded and filed with the Colorado
Department of Public Health and Environment. (Department of Public Health and Environment)
12. No permanent disposal of wastes, other than waste tires, shall be permitted at this site. (Department
of Public Health and Environment)
13. Any liquid or solid wastes (as defined in the Regulations Pertaining to Solid Waste Disposal Sites and
Facilities",as promulgated by the Solid Waste Disposal Sites and Facilities Act,Title 30,Article 20,part
1,C.R.S.,as amended)shall be stored and removed for final disposal in a manner that protects against
surface and groundwater contamination. (Department of Public Health and Environment)
14. The facility shall be constructed and operated to ensure that contamination of soil and groundwater
does not occur. (Department of Public Health and Environment)
15. Fugitive dust and fugitive particulate emissions shall be controlled on this site. (Department of Public
Health and Environment)
16. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured
according to Section 25-12-102, CRS. (Department of Public Health and Environment)
17. The property shall be maintained in compliance at all times with the soil conservation plan approved by
Platte Valley Soil Conservation Service. (Department of Public Health and Environment)
18. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department
of Public Health & Environment, Water Quality Control Division. (Department of Public Health and
Environment)
19. Surface drainage shall be directed away from the active cells and will be allowed to flow off of the facility
into the natural drainage ways. Stormwater runoff from the facility shall not exceed the rate of historic
runoff.The need for stormwater discharge permit will be evaluated in the event stormwater runoff from
the facility disrupts normal flows off of the facility. (Department of Public Health and Environment)
20. A safe and adequate sewage disposal system shall be available on the facility premises. (Department

21. A safe and adequate fresh water supply shall be available on the facility premises. (Department of
Public Health and Environment)
22. In the event that the facility closes permanently, and tires are not used for recovery or recycling
operations within 10 years after closure,filled tire cells containing tires will be covered with a minimum

of 2 feet of soil. Cells that are either partially filled or unused shall be filled to grade with soil. The 10
year limit may be extended with approval from the Colorado Department of Public Health and

23. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control
Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste
Division, and any other applicable agency. (Department of Public Health and Environment)
24. Activities such as welding, grinding, or other spark sources shall not be permitted near tire storage
areas. (Colorado Department of Public Health and Environment)
25. Off-street parking spaces including the access drive circulation through the cell area shall be surfaced
with gravel or the equivalent and shall be graded to prevent drainage problems. (Department of Public

26. The historical flow patterns and run-off amounts will be maintained on site in such a manner that will
reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off. (Department of Public Works)
27. In the event that any area is proposed to be leased to another party in the future, the applicant shall
submit a copy of the lease agreement and information regarding the proposed use of the leased portion
to the Weld County Attorney's office, Weld County Building Inspection Department, Platteville Fire
Protection District and the Department of Planning Services for review. Based upon the proposed use
and/or impacts of the leased portion, the Department of Planning Services may require a new Use by

28. The existing mobile home on site shall be used as living quarters for caretakers or security personnel
responsible for maintaining or guarding the property in accordance with Section 23-3-330.C.4 of the
Weld County Code. (Department of Planning Services)
29. No Trespassing" signs shall be posted and maintained on the perimeter to clearly identify the
boundaries of the site. (Department of Planning Services)
30. The property owner or operator shall be responsible for complying with the approved Certificate of
Designation. (Department of Planning Services)
31. The property owner or operator shall be responsible for complying with the approved Design and
Operations Plan. (Department of Planning Services)
32. The applicant shall be allowed one thirty six square foot entrance sign as well as a sixteen square foot
sign for the leased portion of the site. (Department of Planning Services)
33. The property owner or operator shall be responsible for complying with the Design Standards of Section
23-2-240,Weld County Code.
34. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 23-2-250, Weld County Code.
35. Weld County personnel shall be granted access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with the Development Standards stated herein
and all applicable Weld County regulations.

36. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Board of County Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall be filed in the office of the Department
of Planning Services.
37. The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

1. On a regular basis, discuss fire prevention with all employees.

Thus the dirt available in the built up fire lanes is totally adequate for final cover.
The original design height of fire lanes is seven(7) feet. The top four(4) feet of that
7-foot embankment would be used to provide the desired cover over the stored tires.
Based upon the 4-foot depth of cut and the calculated 136.71 sq.ft. end area, the top
width(w) of the fire lane excavation, as shown above, is 42.19 feet and the bottom
width is 42.19 ft.- 16 ft. =26.19 ft. when cut to the prescribed 2:1 side slopes. A 3.9-
foot horizontal ledge remains at each side of the excavated fire lane which will be the
support or base for the tire cover dirt that is to be placed on the sloped tire pile.
4. The cost to move the soil from the adjacent fire lanes onto the stored tires is based
upon the estimated cost of a bulldozer at year 2023. That cost is estimated to be
$2.09 per cu. yd. according to the letter quote given to the Colorado Department
of Health and Environment by Mountain Constructors dated June 11, 2003. A

moving is 195,664 cu.yd. x $2.09=$408,938. The total cost for final cover at
year 2023 is estimated as follows:

5. The financial assurance for final cover at year 2023 can be provided in various
methods or a combination of methods. Some suggestions follow:
a. Cash setasides such as CD's which become a company asset.
b. Adding equal annual deposits to the existing escrowed funds of$40,034.
c. Surety bond of increasing value on an annual basis.
As an example for(a) above, $12,000 set aside annually at a 5%rate compounded
for 20 years is $416,631, an amount nearly equal to the total estimated cost. As
an example for(b) above, $40,034 deposited at 5%rate compounded annually for
20 years is $106,222, leaving$312,716 to equal the estimated cost of closure 20
years hence. An amount or$9,457 deposited annually at a 5%rate compounded
is equal to $312,716.
Other financing options could be explored that would meet the agreed upon
criteria.

Financial Assurances for fire fighting and final closure.
This letter is to confirm our availability to perform emergency work, such as fire fighting and
dirt replacement as a result of its use for temporary cover to smother fire and to cover filled
tire pits are to be filled to grade with soil at that same time. A Caterpillar D7 and a
Caterpillar 623 Scraper is available for emergency dirt movement. The Caterpillar D7 is
available for final cover that is anticipated in 2023, which is 20 years hence. In an
emergency such as a fire, the dozer will be used to push dirt over the tires from the adjacent
fire lanes while the scraper will be used to replace the used fire lane dirt from the available
dirt replacement locations as shown on the plans. For final cover in 2023, the dozer will be
used to push dirt from the existing fire lanes onto the top of the tires.
It is estimated that the dozer has a production rate of about 76 cubic yards per hour. At its
current rate of$130.00 per hour, the cost of material moved is $1.70 per cubic yard. It is
estimated that the scraper has a production rate of about 90 cubic yards per hour. At its
current rate of $150.00 per hour, the cost of material moved is $1.50 per cubic yard. The
above rates are expected to rise as time passes due to inflationary influences. Based upon
an estimated inflation rate of 2% per year, the rate 20 years hence would be $158.47 per
hour for the dozer and $193.17 per hour for the scraper. Based on that predicted cost for
the dozer, the cost for moving cover dirt onto the tires in 2023 would be $2.09 per cubic
yard. Costs for intervening years would be increased in accordance with the inflation rate for
that time.

situations utilizing OSHA "Hazardous Waste Operations and Emergency
Response" regulations

Pursuant to a telephone conversation which I had on April 4, 2002 with a
representative of the Colorado Department of Public Health& Environment, it is necessary
that the Planning Commission hearing scheduled for May 20, 2003 be vacated. Based
upon the above referenced phone conversation, the State is requiring that the applicant
provide some additional information as well as make modifications to items already
submitted. It is my expectation that the additional documentation and modifications will be
finalized on or before April 21, 2003. All such documents and modifications will be
forwarded both to the Department of Planning Services as well as the Colorado
Department of Public Health & Environment. Upon our submission of the new and
modified documentation, then it would be appropriate to schedule the Planning

addressed to you by Doug Ikenberry and Glen Mallory on behalf of the Colorado
Department of Public Health and Environment. Copies of these letters have been provided
to Mr. Jamison, Vern Nelson, P.E. and Pickett Engineering.
Based upon the State's letters dated October 4, 2002; the letter dated January 8,
2003; and attached comments, please be advised that Tire Mountain has instructed
engineering staff to revise and complete a new design and operations plan, a fire control
plan, and prepare modifications to the preliminary USR plat. Engineering staff has
informed me that the two plans and revised USR plat will be completed not later than the
last week of February, 2003.
Upon completion of the plans and plat,the same will be forwarded to you and made
a part of the Second Amended USR application. We presume that you will then forward
these documents to the Colorado Department of Public Health and Environment for further
review and comment. At that time it would also be our suggestion that you forward the
complete (as revised) application packet to your other referral agencies for review.
It would also be our request that a meeting be scheduled shortly thereafter involving
the Colorado Department of Public Health and Environment, Weld County and Tire

Dear Ms. Etcheverry:
We are in receipt of your letter dated August 14, 2002. Obviously, some confusion
still exists. At our meeting on April 15, 2002, Tire Mountain was required to submit
additional plans, specifications and information to the Colorado Department of Public
Health & Environment and this was required to be submitted on or before June 15, 2002.
It was our understanding that the submission was then going to be reviewed by the County
and State.
My records indicate that such information was submitted to both State and County
entities by Verh Nelson, P.E. on or about June 10, 2002.
We have been awaiting some type of response concerning Mr. Nelson's submission
and the first response we received was your letter dated August 14, 2002.
Based upon your letter of August 14, 2002, we presume that Mr. Nelson's
submission of June 10, 2002 was acceptable to both the State and County. Accordingly,
your listed Items 1 and 2 will be completed under the direction and supervision of Mr.
Nelson. Tire Mountain has instructed Mr. Nelson to immediately commence such items
and we will advise both you and the State upon their completion. It is contemplated that
all such work will be completed by November 1, 2002.

As to your Item 3, both Tire Mountain and Mr. Nelson are in agreement that this soil
in the fire lanes can be replenished within the allotted six months.
In reviewing Item 4 in your letter of August 14, 2002, I can advise you that Tire
Mountain does not need to enter into a lease for soil replenishment on site as there is more
than adequate space and soils on site for replenishing the fire lanes. Tire Mountain will
use on-site soils for replenishment and absolutely has no intention of bringing in soil from
another location to"replace on-site soil." I was under the impression that Mr. Nelson's and
plans of June 10, 2002 explained this. I can further advise you that the Amended Use By
Special Review(see below)to the be filed at a later date will specifically identify these sites
as certain areas on the Tire Mountain properties will not be used for any purpose other
than to be available for soil replenishment of the fire lanes. Additionally, Mr. Nelson's plan
and report of June 10, 2002 did take into account necessary financial review for relocating
soils on-site to replenish the fire lanes.
As to the Certificate of Designation and Use by Special Review, there was
absolutely no intention on the part of Tire Mountain to submit an amendment by June 15,
2002. It would not make sense to submit an Amended USR concerning Tire Mountain as
to existing operations and the middle forty acres until the issues the subject of the April 15,
2002 meeting; Mr. Nelson's submission of June 10, 2002; and your letter of August 14,
2002 were finalized. Now that those items have been finalized, Tire Mountain has
instructed this firm to proceed with submission of a new USR application which will take
into account the existing and approved USR as well as the additional acreage (the middle
forty acres) that will also be included under the new and amended USR. I do not expect
to have that new application completed until November or December of 2002. As soon as
the same is completed, it will be filed in accordance with State and County procedures and
regulations. If you have any further questions or comments, please contact the
undersigned.
