RE: APPROVE CLOSURE OF A PORTION OF THE RIGHT-OF-WAY OF WELD COUNTY
ROADS 23 AND 62.25 TO PUBLIC ACCESS, EXCEPTING ACCESS BY EMERGENCY
AND MAINTENANCE VEHICLES AND BY ADJACENT LANDOWNERS, THEIR
TENANTS AND INVITEES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a portion of the right-of-way of Weld County Roads 23 and 62.25, lying in
portions of Sections 35 and 36, Township 6 North, Range 67 West of the 6th P.M., Weld County,
Colorado, extending from the current location of a gate at the southern end of Weld County Road
23 and proceeding southeast for approximately 612 feet, to a point being approximately 50 feet
northwest of the current location of the cement pad of the Poudre River Trail, as shown on the
attached sketch and map (hereinafter referred to as "Right-of-Way"), extends from Weld County
Road 23 to the Poudre River Trail, and has been used to gain access to said Poudre River Trail by
persons desiring to recreate thereon, and
WHEREAS, such access fosters parking problems on Weld County Road 23 and provides
means for trespass onto adjoining agricultural lands, and
WHEREAS, ample and appropriate parking and trail access for those persons desiring to
recreate on the Poudre River Trail exists only a quarter-mile away in both directions (east and
west), and
WHEREAS,after review, the Board deems it advisable to close said Right-of-Way to public
access, excepting access by emergency vehicles and vehicles used in maintenance of the Poudre
River Trail, and by adjacent landowners, their tenants and invitees, until such time as the Board
determines to rescind the closure, with such closure not being intended to act as an abandonment
of the Right-of-Way by Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Right-of-Way of Weld County Roads 23 and 62.25, lying in portions of
Sections 35 and 36, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado,
extending from the current location of a gate at the southern end of Weld County Road 23 and
proceeding southeast for approximately 612 feet, to a point being approximately 50 feet northwest
of the current location of the cement pad of the Poudre River Trail,as shown on the attached sketch
and map, be, and hereby is, closed to public access, excepting access by emergency vehicles and
vehicles used in maintenance of the Poudre River Trail, and by adjacent landowners, their tenants

Dear Ms. Likarish:
On Wednesday, May 14, 2003, the Board of County Commissioners of Weld County, Colorado,
will consider approving a Resolution, entitled, "APPROVE CLOSURE OF A PORTION OF
THE RIGHT-OF-WAY OF WELD COUNTY ROADS 23 AND 62.25 TO PUBLIC
ACCESS, EXCEPTING ACCESS BY EMERGENCY AND MAINTENANCE VEHICLES
ANT) BY ADJACENT LANDOWNERS, THEIR TENANTS AND INVITEES." A copy of
the Resolution is enclosed. The Resolution is intended to reduce the incidence of persons
parking at the southern end of WCR 23 and accessing the Poudre River Trail along the right-of-
way. The Board will consider the Resolution at its regular meeting on May 14, 2003,at 9:00
a.m. The Board's meeting take place in the First Floor Meeting Room, Centennial Center
Complex, 915 10th Street, Greeley, Colorado.
