A review of the mineral exception and reservation language in the
documents for the tracts in the NE/4 reflects that the disputed 50%
mineral interest in Tract 2 is vested in Martin T. Hart. By the Hart
Deed, Kenneth Walter Weng conveyed to Martin T. Hart all of the NE/4
"except that part conveyed by Warranty Deed in Book 1577, Page 260, and
except one-half of all oil gas and mineral rights as previously reserved
by Neal R. Sandlin and Marie Sandlin." The prior Warranty Deed cited
as an exception in the Hart Deed is the Adkisson Deed which conveyed
surface rights only, therefore, this document vests into Martin T. Hart
one-half of the mineral rights under the entire NE/4 . The subsequent
conveyance from Hart, the Premium Turkey Farms Deed, specifically
excepted out the metes and bounds description of Tract 2 (which would
then include all minerals) and excepts out the mineral interest
previously reserved by Neil and Marie Sandlin.
In the examiners' opinion, the above referenced deeds are not
ambiguous, and the interest appears to have vested into Martin T. Hart.
The materials examined reflect that Lease C, obtained by Amoco
Production Company from Martin T. Hart, has been properly extended and
properly pooled.
