RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#391 - KRISTI
WEIMER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
a
WHEREAS, by Resolution dated July 18, 1979, the Board did approve the request of
Virgil Ottinger for Use by Special Review Permit#391 for a swine farrowing and finishing _ I
operation on the following described real estate, to-wit: 'aaa

WHEREAS, the Board of County Commissioners heard all of the testimony and = c
statements of those present, studied the request of the applicant and the recommendations of .No C
the Department of Planning Services staff and all of the exhibits and evidence presented in this =r°
matter and, having been fully informed, deems it advisable to approve said vacation.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of �'
Weld County, Colorado, that Use by Special Review Permit#391 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 30th day of June, A.D., 2003.

SUBJECT: Vacation of SUP-391
The Department of Planning Services has received the attached letter dated June 17, 2003
from Kristi Weimer. Ms. Weimer is requesting that SUP-391 be vacated from their parcel,
0801 22 000083, since the use, a hog farm, is no longer being performed on the property. The
Weimer's parcel was created by a recorded exemption, RE-2612, on November 10, 1999
approved by the Department of Planning Services. The Weimer's have applied for a use by
special review permit which will be presented to the Planning Commission on August 5, 2003.
Background information:
Legal Description: Lot A PT SE4 Section 22, T6N, R64W of the 6th P.M., Weld County, CO.
Location: North of and adjacent to Carlton Road/Weld County Road 66 and
approximately 1/4 mile west of Weld County Road 57.
