RE: GRANT REQUEST FROM MARLIN NESS TO PREADVERTISE SITE SPECIFIC
DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1431
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Marlin Ness, 830 East 28th Street,
Greeley, Colorado 80631,for preadvertisement of an application for a Site Specific Development
Plan and Use by Special Review Permit#1431 for an RV Park and Storage and Recreation Area
in the A (Agricultural) Zone District, and
WHEREAS,said property is described as part of the N E1/4 of Section 21,Township 5 North,
Range 65 West of the 6th P.M., Weld County, Colorado, and
WHEREAS,after study and review the Board deems it advisable to grant said request,with
the hearing date to be set as January 21, 2004, at 10:00 a.m.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the request from Marlin Ness for preadvertisement of an application fora Site
Specific Development Plan and Use by Special Review Permit#1431 for an RV Park and Storage
and Recreation Area in the A (Agricultural) Zone District be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as January 21, 2004, at 10:00 a.m.

which will be heard by the Planning Commission on January 6,2004,be pre-advertised. If you wish
to approve this request,a hearing before the Board on January21,2004,will allow adequate time

SUBJECT: Request for Pre-Advertisement for USR-1431 (Marlin Ness)
Marlin Ness, on behalf of his agent Tony Evans, is requesting a pre-advertisement for USR-
1431. The pre-advertisement was originally requested on May 13, 2003. At that time
planning staff advised the applicant not to go the route of pre-advertisement because there
were proposed conditions of approval that needed to be addressed prior to the Board of
County Commissioners hearing. Planning Staff has since determined that these conditions of
approval have been addressed by the applicant and that the case could be sent to be
scheduled for a Board hearing after the Planning Commission hearing. The applicant has
provided sign-offs from mineral interest holders on the property indicating support or no
concerns with the application. The applicant's representative (Tony Evans - a registered
engineer) has provided a letter indicating that there are no commercially viable mineral
resources on the property, and the applicant has provided a proposed sign elevation for the
application. I have spoke with Barbara Spagnole on December 9, 2003 with the U.S. and Fish
and Wildlife regarding whether or not surveys and trapping studies would need to be done for
the Preble's Meadow Jumping Mouse and Ute Ladies Tresses Orchid in this area. She
indicated that the proposed location of the RV storage use would be located outside of the
riparian habitat for the South Platte River and no additional studies or verification would need to
be done.
The application was continued indefinitely on August 5, 2003 by the Weld County Planning
Commission in order for the applicant to address the issue of water and sewer service to
the site. The applicant has since revised the application to address this issue and this case
has been scheduled before the Weld County Planning Commission.
The applicant was originally told that the Planning Commission hearing could be scheduled
for December 2, 2003. However, due to a staff oversite, a new public notice in the
newspaper was not submitted in sufficient time to meet the 10-day public notice publication
deadline and the hearing had to be rescheduled for January 6, 2003.
Planning Staff is in support of the pre-advertisement request because it would be in
conformance with the original hearing timeline that was discussed with the applicant.

RE: Questions from Weld County Planning,
Dear Mr. Gathman;
Thank you for the e-mail describing your questions on the RV Park and Storage USR
request. As we discussed, I will not be able to provide all of the information that you
requested by Thursday May 15, 2003. We would like to get on the earliest possible
Planning and Zoning and County Commissioners meetings, and will provide the
information as soon as we have it. We also request pre-advertisement to expedite the
process.
Mr. Don CaroII, Weld County Department of Public Works, left me a message today that
said he had not received the information for this USR and would get back to me when he
has it. We will get a traffic study, 100-year floodplain and floodway survey for this USR,
upon Mr. Caroll's request, and forward it to you and him as soon as possible. All
roadways, tuning radiuses and accesses will be of sufficient size and grade for all types of
recreational vehicles. No commercial vehicles will be allowed internally to this property,
As stated in the USR application, we are requesting 200 RV Parking spaces and 20
storage spaces. The areas to the east and south of the proposed RV Parking and Storage
are to be reserved for recreation, Mr. Ness, the owner of the property, would like to
reserve this area for a walking trail along the river and someday a 9-hole golf course with
a driving range. In our conversations we discussed how this could be done.
We would like to request that this USR be phased as follows; Mr. Ness would like to
build the RV Parking facilities first and the Storage area second. The northwest corner of
the property is reserved for commercial. This property will have to go through the Weld
County site plan application before building on the commercial site. The walking trials

would be built when the surrounding properties have trials to connect to. There are no
plans for building the golf course and driving range at this time, but Mr. Ness would like
to keep this opportunity open. Layout and construction plans, for the golf course and
driving range, will be provided to Weld County when they are completed.
The RV Parking and Storage on this property will be managed by The Greeley RV Park
across Highway 34 to the North, which Mr. Ness owns. Mr. Ness is aware that the State Health Department may review the proposed septic system for this site. All habitable
structures and facilities will be located above the 100-year floodplain.

regarding a request of a pre-advertisement fee refund associated with the Ness RV Park, USR-
1431. The Office Manager and support staff reviewed the office receipts for all receipts dated
May 1, 2003 through the period in question and found no receipt for a pre-advertisement other
than receipt number 10108 dated December 11, 2003 signed by L. Buehler of this office.
Given this circumstance, please remit any additional receipts pertaining to your request for
action by this office on behalf of your client. Should no additional receipt be produced with the
pre-advertisement fee documented, the Department of Planning Services will consider this
issue resolved.

Dear Mr. Ogle;
In our telephone conversation yesterday, you requested that I write this letter for refund
of the Pre-advertisement fee. The fee was $35.00 for the Ness RV Park pre-
advertisement. This was the second pre-advertisement payment made for this project.
The first was made in May of 2003 for$35.00. The second was made in November of
2003 for $35.00. The advertisement was not placed on time in three separate instances
due to errors by Weld County Planning and the Newspaper the advertisement was to be
placed.
Please refund the $35.00 to Elite Consulting, Inc. at the above address. Thank you for
your help and cooperation.
