HomeMy WebLinkAbout20032404.tiff RESOLUTION RE: CONSENT TO THE ENFORCEMENT BY THE MILLIKEN FIRE PROTECTION DISTRICT OF THE 1997 UNIFORM FIRE CODE AND STANDARDS, WITH AMENDMENTS, WITHIN THE DISTRICT'S UNINCORPORATED PORTIONS OF WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 32-1-1002(1)(d), C.R.S., provides that a fire code promulgated by a fire district may be enforced in the unincorporated portions of a county only with the consent of the Board of County Commissioners of such county, and WHEREAS, the Milliken Fire Protection District has presented a resolution, dated January 13, 2000, adopting and promising to enforce the 1997 Edition of the Uniform Fire Code and Standards, with certain amendments set forth in said resolution and in subsequent resolutions dated September 14, 2000, and January 10, 2002, within the District's unincorporated portions of Weld County, and WHEREAS, after review, the Board deems it advisable to consent to the enforcement by the District of the 1997 Edition of the Uniform Fire Code and Standards, with certain amendments set forth in said resolutions, within the District's unincorporated portions of Weld County. Barker Weld County Attorney pc: Jeff Reif Clerk to the Board 70 3-39/ 7 MILLIKEN FIRE PROTECTION DISTRICT A RESOLUTION ADOPTING THE UNIFORM FIRE CODE, AND THE UNIFORM FIRE CODE STANDARDS PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE, HAZARDOUS MATERIALS OR EXPLOSION. PROVIDING FOR THE ISSUANCE OF PERMITS FOR HAZARDOUS USED OR OPERATIONS; AND ESTABLISHING THE BUREAU OF FIRE PREVENTION AND PROVIDING OFFICERS THEREFORE AND DEFINING THEIR POWERS AND DUTIES. Be it ordained by the Milliken Fire Protection District SECTION 1: ADOPTION OF THE UNIFORM FIRE CODE AND UNIFORM FIRE CODE STANDARDS. There is hereby adopted by the Milliken Fire Protection District, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire, hazardous materials or explosion, that certain Code known as the 1997 Uniform Fire Code, together with Appendices Division I, Appendix I-A, Division II, Appendix II-A, II- B, II-E, II-G, II-H, Division III, Appendix III-B, III-C, III-D, Division IV, Appendix IV- A, Division V, Appendix V-A,Division VI, Appendix VI-A, VI-B, VI-C, VI-E, and VI-F, and the Uniform Fire Code Standards, published by the International Fire Code Institute, being particular to the 1997 edition thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended by this Resolution of which said Code and Standards are now filled in the offices of the Milliken Fire Protection District, and the same are hereby adopted and incorporated as fully as ii'set forth herein. The date on which Resolution shall take effect within the incorporated municipalities within the Milliken Fire Protection District shall be the date of approval by the governing body of said municipality and the date on which it shall take effect within the unincorporated portions of Weld County shall be the date of approval by the Board of County Commissioners in and for the County of Weld, Sate of Colorado. This code shall be in effect within the territorial limits of the Milliken Fire Protection District. SECTION 2: ESTABLISHMENT AND DUTIES OF THE FIRE PREVENTION INSPECTORS. The Uniform Fire Code and related Standards as adopted and amended herein shall be enforced by the Fire Prevention Inspectors in the Fire Department of the Milliken Fire Protection District which is hereby established and which shall be operated under the supervision of the Chief of the Milliken Fire Department. The Chief of the Milliken Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. SECTION 3: DEFINITIONS: Wherever the word "jurisdiction" is used in the Uniform Fire Code, it is meant to be inclusive of the current boundaries of the Milliken Fire Protection District. Where the term "Chief of the Bureau of Fire Prevention" is used, it shall be held to mean the Chief of the Milliken Fire Department. Where the term"Bureau of Fire Prevention" is used, it shall be held to mean those members and employees designated by the Chief of the Fire Department to carry out enforcement duties related to the prevention of fires and the suppression of arson Whenever the term "Uniform Building Code" is used, it shall be held to mean the Uniform Building Code as amended and incorporated into the Weld County Building Code, except for the incorporated areas of the Town of Milliken, which shall use the uniform Building Code as amended, enforced by the agency contracted to perform inspections within it's respective corporate limits. SECTION 4: ESTABLISHMENT OF LIMITS OF DISTRICT IN WHICH STORAGE OF FLAMMABLE OR COMBUSTIBLE LIQUIDS IN OUTSIDE ABOVEGROUND TANKS IS PROHIBITED. The limits referred to in Sections 7902.2.2.1 and 7904.2.5.4.2 of the Uniform Fire Code in which the storage of flammable or combustible liquids is restricted are hereby established as follows: 1. As addressed by any ordinance or zoning regulations adopted by the Town of Milliken. 2. Any area within the unincorporated parts of Weld County within the Fire District which are not zoned Industrial Districts or Agricultural as defined by the Weld County Zoning Ordinance. This provision shall not be interpreted so as to conflict with the provisions of Colorado Revised Statutes 1973 Title 8, Article 20 or Title 34, as amended. Section 5: ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF LIQUIFIED PETROLEUM GASES IS TO BE RESTRICTED. The limits referred to in Section 8204.2 of the Uniform Fire Code, in which the storage of Liquified Petroleum Gas is restricted, are hereby established as follows: 1. ., As addressed by any ordinance or zoning regulations adopted by the Town of Milliken. 2. As addressed by any ordinance or zoning regulations adopted by Weld County. This provision shall not be interpreted so as to conflict with the provisions of Colorado Revised Statutes 1973, Title 8 Article 20 or Title 34 as amended. Section 6: ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF EXPLOSIVES AND BLASTING AGENTS IS TO BE PROHIBITED. The limits referred to in Section 7701.7.2 of the Uniform Fire Code, in which the storage of Explosives and Blasting agents is prohibited, are hereby established as follows: 1. As addressed by any ordinance or zoning regulations adopted by the Town of Milliken. 2. Any area within the unincorporated parts of Weld County within the Fire District which are,notzoned Industrial Districts as defined by the Weld County Zoning Ordinance. Section 7: ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF COMPRESSED NATURAL GAS IS TO BE PROHIBITED. The limits referred to in Section 5204.5.2 of the Uniform Fire Code, in which the storage of Compressed Natural Gas is prohibited, are hereby established as follows: 1. As addressed by any ordinance or zoning regulation adopted by the Town of Milliken. 2. Any area within the unincorporated parts of Weld County within the Fire District which are not zoned Industrial Districts as defined by the Weld County Zoning Ordinance. Section 8: AMENDMENTS MADE IN THE UNIFORM FIRE CODE. 1. Section 103.1.4 amended -Appeals. Section 103.1.4 of the Uniform Fire Code is amended to read as follows: Sec 103.1.4 Appeals Appeals from an order of the Chief or any designated member of a fire department requiring the removal or remedy of conditions dangerous to the safety of persons or property, or to determine the suitability of alternate materials and types of construction and to provide reasonable interpretations of the provisions of this code as more fully set forth in Colorado Revised Statutes 1973 § 32-1-1001(3), as amended, shall be according to the procedures setforth therein. The Board of Appeals shall be the same board utilized by the Milliken Fire Protection District, as approved by the District Board. 2. Section 103.2.1.2 amended - Fire Prevention Bureau personnel and Police. Section 103.2.1.2 of the Uniform Fire Code is amended to read as follows: Sec 103.2.1.2 Fire Prevention Bureau personnel and police The chief and members of the fire prevention bureau shall have the powers of a police officer in performing their duties under this code, shall only extend as far as the authority set forth in Colorado Revised Statutes 1973, § 32-1-1002 as amended, or other applicable state statute. When requested to do so, the Sheriff or the Chief of Police is authorized to assign such available police officers as necessary to assist the fire department in enforcing the provisions of this code. 3. Section 103.3.2.2 amended - Inspection Requests. Section 103.3.2.2 of the Uniform Fire Code is amended to read as follows: Sec 103.3.2.2 Inspection Requests. It shall be the duty of the person doing the work authorized by a permit to notify the chief that such work is ready for inspection. The chief is authorized to require that every request for inspection be filled not less than two (2) working days before such inspection is desired. Such requests may be in writing or by telephone at the option of the chief. It shall be the duty of the person requesting any required inspections to provide access to and means for proper inspection of such work 4. Section 103.4.3.4 is added - Conflicts With State Requirement. Section 103.4.3.4 of the Uniform Fire Code is added to read as follows: Sec 103.4.3.4 Conflicts With State Requirement This section shall be interpreted to be consistent with the provisions of Colorado Revised Statues 1973, § 32-1-1002(3), as amended. 5. Section 105.8 amended - Permits Required. Section 105.8 of the Uniform Fire Code is adopted and amended to read as follows: Sec. 105.8 Permits Required A permit shall be obtained from the Bureau of Fire Prevention prior to engaging in the following activities, operations, practices or functions: c.1. Candles and open flames in assembly areas. To use open flame or candles in connection with assembly areas. For definition of Assembly, see Article 2. See Article 25 for open flame and candles. e.1. Explosives or Blasting Agents. For permits for explosives or blasting agents, see Article 77. £2. Fireworks.For permits for fireworks, see Article 78. f.3. Flammable or combustible liquids. See Article 79. A. To install, construct, alter or operate equipment, tanks, plants, terminals, wells, fuel dispensing stations, refineries, distilleries and similar facilities where flammable and combustible liquids are produced, processed, transported, stored, dispensed or used. B. To install, alter, remove, abandon, place temporarily out of service, close or otherwise dispose of any flammable or combustible liquid tank. See Article 79. h.1. Hazardous materials. To store, dispense, use of handle hazardous materials in excess of the amounts listed in Table 105-C or to install, repair abandon, remove, place temporarily out of service, close or substantially modify a storage facility or other area regulated by Article 80 when the hazardous materials in use or storage exceed the amounts listed in Table 105-c. i.1. Liquified petroleum gases. See Article 82. To install or maintain LP-gas containers where a single container is 125-gallon water capacity or more, or the aggregate capacity of the containers is 125-gallon water capacity or more, the installer shall submit plans for such permits. 6. Section 1002.1 amended - General. Section 1002.1 of the Uniform Fire Code is adopted amended for to read as follows: Sec. 1002.1 General. Portable fire extinguishers shall be installed in occupancies and locations as set forth in this code and as required by the chief. Portable extinguishers shall be in accordance with U.F.C. Standard 10-1, but in no case shall be rated less than 2A-10BC minimum. 7. Section 7802.3 amended - Prohibition. Section 7802.3 of the Uniform Fire Code is adopted in amended form to read as follows: Sec. 7802.3 Prohibition The sale, purchase, possession, and use of permissible fireworks shall be in accordance with 1991 Colorado Revised Statues § 12-28-101, et seq., as amended. 8. Section 7901.1.1.2 is added - Storage Tanks Section 7901.1.1.2 of the Uniform Fire Code is amended to add this section to read as follows: Sec. 7901.1.1.2 Storage Tanks Storage tanks used for flammable and combustible liquids shall be no larger than allowed by Colorado Department of Labor and Employment, Oil Inspection Section, Storage Tank Regulations, 7 C.C.R. 1101-14. 9. Section 7904.3.2.3 amended -Buildings Section 7904.3.2.3 of the Uniform Fire Code is adopted in amended form to read as follows: Sec. 7904.3.2.3 Buildings Wells shall not be drilled within 350 feet of buildings not necessary to the operation of the well, including buildings used as educational facility, assembly building, hospital, nursing home, board and care facility or jail. When wells are existing, building permits shall not be issued for, and buildings shall not be constructed within 350 feet from ant well head, production tanks, and/or associated on site production equipment. 10 Section 7904.3.6 amended - Storage tanks Section 7904.3.6 of the Uniform Fire Code is adopted in amended form to read as follows: Sec. 7904.3.6 Storage tanks Storage of flammable or combustible liquids in tanks shall be in accordance with Section 7902, except that production tanks, and/or associated on site production equipment shall be located at least 350 feet from any building not necessary to the operation of the well. Production tanks, and/or associated on site production equipment shall be located at least 500 feet from buildings used as an educational facility, assembly building, hospital, nursing home, board and care facility or jail. Each oil storage tank or group of tanks shall have posted in a conspicuous place on or near such tank or tanks an approved sigh with the name of the owner or operator, name or number of lease and the telephone number where a responsible person can be reached at any time. Section 9: APPEALS Whenever the Chief disapproved an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the Code do not apply or that the true intended meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief to the Board of Appeals, Milliken Fire Protection District, P.O. Box 41, Milliken, Co 80543, within 30 days from the date of the decision appealed. Appeals from an order of the Chief or any designated member of the Fire Department requiring the removal or remedy of conditions dangerous to the safety of persons or property, or to determine the suitability of alternate materials and types of construction and to provide reasonable interpretations of the provisions of this code as more fully set forth in Colorado Revised Statutes 1973, § 32-1-1002(3), as amended, shall be according to the procedures set forth therein. Section 10: PENALTIES 1. Any owner, lessee, agent or occupant of any building or premises maintaining any condition likely to cause fire, or to constitute an additional fire hazzard, or any condition which impedes or prevents the egress of persons from such buildings or premises, or violates any of the provisions of the Uniform Fire Code as adopted and amended herein, or fails to comply therewith, or who fails to comply with any order made - thereunder, in violation of the provisions of the Colorado Revised Statutes 1973 §32-1- 1002(3) shall be deemed to be maintaining a fire hazzard. Any person who violates any provision of said subsection 3 is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than $50.00 or no more than $250.00. Each day in which such violation occurs shall constitute a separate violation of§32-1-1002(3). 2. The application of the above penalty shall not be held to prevent the enforced removal of the prohibited conditions. Section 11: REPEAL OF CONFLICTING ORDINANCES OR RESOLUTIONS. All former ordinances or resolutions enacted by the Fire District or parts thereof conflicting or inconsistent with the provisions of this resolution or of the Code of Standards hereby adopted are hereby repealed. Section 12: VALIDITY. The Milliken Fire Protection District Board of Directors hereby declares that should any section, paragraph, sentence, or word of this resolution or of the Code or Standards hereby adopted be declared for any reason to be invalid, it is the intent of the Milliken Fire Protection District Board of Directors that it would have passed all other portions of this resolution independent of the elimination here from of any such portions as may be declared invalid. It is further the declaration of the Milliken Fire Protection Board of Directors that no provision of this resolution or the Code or Standards adopted herein be interpreted in conflict with existing State law. In the event there is a conflict between State law and this Code, State law shall take precedent. Section 13: DATE OF EFFECT. Minutes of the Meeting of the Board of Directors of the Milliken Fire Protection District January 13, 2000 Members Present: Members Absent: Gerald Jenniges Scott Fish Jerry Kilgore Margaret Prather--Bookkeeper Robert Onorato Lloyd Prather Guests: Dave Meyer--Chief Chuck Ashbaugh--Assistant Chief Dean Prather Kelly Pierson The meeting was called to order by President Gerald Jenniges at 7:00 p.m. with the above people present. Audience with Individuals: Kelly Pierson and Dean Prather reported on price quotes for the replacement of Squad I from Garnsey& Wheeler Ford, Champion Dodge and Super Vac. Pierson gave copies of the quotes to the Board for the minutes. Dean Prather reported on the airpacks which were reflected on the bills from Casco. The minutes of the December 13, 1999, meeting were read and approved. Business,: Property Lines at Station#2: This was tabled as there was no information from the attorney. Adoption of the Fire Code: Dean Prather talked about the "97" fire codes as per booklet he gave to the Board Members. He explained'how fire code works in connection with the town of Milliken and Weld County. Kilgore moved and Lloyd Prather seconded a motion to adopt the "97" fire code as amended. Motion carried. Telephone: Prather reported on the long distance calls on bill for Station #1. Board is to have Luke McDonald pay the cost of the calls. Margaret is to check on getting PIN numbers for the long distance calls. Board directed the Chief to contact Luke McDonald. Fire Chief: - New Firefighters/Quit: _ The Chief reported there were no new firefighters and that none had left the Department. Kilgore asked if 4 new pagers ever came in. Assistant Chief Ashbaugh is to check on the pagers. Ashbaugh reported the Relhm 2-way went to the factory for repair. Assistant Chief Ashbaugh reported on the new 2-way system the County is putting in place. Kilgore expressed some concerns over it. Chief Meyer asked the Board for funds to help cover the cost of the food for the Northern meeting next Tuesday. The department is to give the cost to Prather to present at the next Board meeting. Chief Meyer reported on Arrowhead and the Union Colony Fire Authority. Approval of Bills: - Kilgore moved and Onorato seconded a motion to accept the bills for payment. Motion carried. Section I: Add Appendix III-A. Section 8 Number 9: Section 7904.3.2.3 of the Uniform Fire Code as adopted is amended to read as follows: Sec. 7904.3.2.3 Buildings: Wells shall not be drilled within 350 feet of buildings not necessary to the operation of the well, including buildings used as educational facility, assembly building, hospital, nursing home, board and care facility or jail. When wells are existing, building permits shall not be issued for , and buildings shall not be constructed within ISO feet from any well head, 200 feet from production tanks, commonly referred to as tank batteries, separator units and/or other associated on site production equipment. If grease extractors are installed, they shall be operated when the commercial-type cooking equipment is used. Hoods, grease-removal devices, fans ducts and other appurtenances shall be cleaned at intervals necessary to prevent the accumulation of grease. Cleanings shall be recorded, and records shall state the extent, time and date of cleaning. Such records shall be maintained on the premises. Extinguishing systems shall be serviced at least every six months or after activation of the system. Inspection shall be by qualified individuals, and a Certificate of Inspection shall be forwarded to the fire prevention bureau upon completion. Fusible links and automatic sprinkler heads shall be replaced at least annually, and other protection devices shall be serviced or replaced in accordance with the manufacturer's instructions. , Exception: Frangible bulbs need not be replaced annually. Be it ordained by the Milliken Fire Protection District There is hereby required for the purpose of minimizing property damage and allowing for the rapid entry of firefighters into a structure•other than a residence, the Knox Box Rapid Entry System. With the exception of a residence and associated buildings, all new buildings including but not limited to retail, commercial and industrial buildings shall have a Knox Box Rapid Entry System located on the property. The mounting location shall be approved by the Fire Chief or appointed designee. Within the first 3 days of a new school year, an announcement shall be made on the public address system of the school. This announcement shall state that the fire alarm system will now be activated so all persons within the building will recognize the sound of the fire alarm system in that facility. The alarm shall not be silenced until a minimum of 20 seconds has elapsed. At the end of the test session,the alarm system shall be reset and an announcement on the public address system shall be made notifying all persons within the facility that the test has been concluded. The minutes of the July 10, 2003, meeting were read and approved. Audience with Individuals: Jim Brock went over the audit for 2002. Board had no questions. Carl Potts with AFLAC insurance presented a brief informational program on the types of insurance available. He left information for the paid staff to look at and was to get back with more information on costs. Adele Rieser and Troy Bemberg presented the information and the forms needed to go ahead with putting the bond issue for the new station on the ballot in November. Adele informed the Board the only area that could be changed on the ballot question was the bullet point. Flack moved and Prather seconded a motion to approve the resolution for the ballot issue on the bond after adding the phrase"including land"to the ballot question. Motion carried. Business: Station#2: Director Flack was doing preliminary checking on cost of concrete and such for the addition of 2 bays at Station#2. Board members are to get more bids by September. p.4 Fire Code: There were no public questions or comments on the fire code when the meeting was opened for discussion. Insurance--Paid Staff Director Flack reported the health insurance coverage was the same as the prior year. Flack moved and Ashbaugh seconded a motion to renew the contract with Anthem Blue Cross-Blue Shield for another year. Motion carried. Fire Code Amendment: Dean Prather asked the Board to approve an amendment to the Fire Code by adding Section 1303.3.3.2#5. After hearing the amendment as read, Ashbaugh moved and Prather seconded a motion to accept the amendment as part of the Fire Code. Motion carried. Equipment: T-11: Chief Knaub reported T-11 was to go to Super Vac on Friday for the communication system. While at Super Vac,the pressure relief valve light was to be checked. Chief Knaub reported once the communication system is in, they will get the certification on the ladder from Underwriters Laboratories. Chief Knaub reported a Milliken hydrant adapter was needed for T-11. Flack moved and Ashbaugh seconded a motion to by the adapter for$145.00 as soon as possible. Motion carried. Squad#1: Chief Knaub, Assistant Chief Howe and Prather reported Squad#1 needed 6 compartment lights. Prather moved and Ashbaugh seconded a motion to spend $150.00 on the purchase of the lights. Motion carried. Brian Eckstine is to wire them. Ladder Tests: Chief Knaub reported the ladder tests need to be done. He is hoping to get a group rate of$1.25/foot. If not,the cost will be$1.95. Sign: This was tabled for freighters to bring back prices at the September meeting. • Fans: Caillouette moved and Ashbaugh seconded a motion to purchase 2 pedestal fans for use by paid personnel at Station#2. Motion carried. Chief p. 5 New Firefighters/Ouit: Chief Knaub reported there were no new firefighters and that William Finch, Tom Schraeder and Drew Dresen had left the department. Staff Reports: Garrett Flack reported there had been one call which was all smoke and no fire. He also reported the number of fire calls in 2001 for fire was 65, including ground cover and cars, the number in 2002 was 114,most of which were wound cover, and 2003 didn't appear to be going to break any of the numbers. Dean Prather reported he was working on the fire codes and doing the school inspections. He is requesting$1131.44 for fire prevention supplies for 700 students in K-2 for fire prevention week Chief Knaub asked Betty Caillouette to express the opinion if the firefighters on the new station. Betty said the department members would like to have input into the developing of the plans by having Chief Knaub involved with the planning of the station. Chief Knaub reported he felt it would be better to stay with Aims on the fire training at this point than to do it in house. Approval of Bills: Flack moved and Ashbaugh seconded a motion to accept the bills for payment. Motion carried. Correspondence: There was no correspondence to be read.
