HomeMy WebLinkAbout820608.tiff RESOLUTION RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 484 - WILLARD AND OPAL TROSTEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 25th day of February, 1981, the Board of County Commissioners approved Recorded Exemption No. 484 for Willard and Opal Trostel concerning property described as part of the SET, Section 35, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Willard and Opal Trostel are requesting that Re- corded Exempiton No. 484 be amended to increase the size of Lot "B" from 19. 378 acres, more or less, to 20. 203 acres, more or less, and WHEREAS, the Board of County Commissioners has studied said request to amend Recorded Exemption No. 484 and deems it advis- able to approve the amendment. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove amend- ment to Recorded Exemption No. 484 for Willard and Opal Trostel, be, and hereby is , approved. BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) That the submitted Recorded Exemption Plat be amended by deleting Lot "A". as shown and to amend the legal description by excluding that area shown as Lot "A" ; 2) The title oh the Recorded Exemption Plat shall read, "Amended Lot B of Recorded Exemption No. 484" ; and 3) The above stated conditions shall be approved by the Department of Planning Services staff before recordation of the Recorded Exemption Plat by the Office of the Clerk and Recorder. 820608 Page 2 RE: AMENDED RE #484 - TROSTEL The above and foregoing Resolution was, on,.'motion duly made and seconded, adopted by the following vote on the 24th day of November, A.D. , 1982. Dear Commissioners: The above described case was tabled by the Board at the public hearing held on November 17, 1982, for the following reasons: 1. To allow the Weld County Health Department to review the application to determine if any problems would arise by reducing the affected lot to less than one (1) acre in size; and 2. To allow the applicant to explain their situation and answer questions from the Board. The Weld County Health Department has reviewed this request and concludes the following: 1. The existing septic system is adequate and that no problems should arise if the affected lot is reduced to less than one (1) acre. Based upon the additional information submitted, the Department of Planning Services staff remains with the recommendation of approval for the requested amendment with the same recommended conditions. COLORADO } November 17, 1982 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 Re: Amended Recorded Exemption #484 Dear Commissioners: The attached application, plat and related items are in reference to a request to amend Recorded Exemption No. 484 from Willard and Opal Trostel. The property is described as part of the SEA, Section 35, Township 1 North, Range 68 West of the 6th P.M. , weld County, Colorado. The land is located four miles east of Erie on Weld County Road 11. The request is to amend Recorded Exemption #484 by increasing the size of Lot "B" from 19.378 acres, more or less, to 20.203 acres, more or less. The applicant wishes to include a one (1) acre addition to Lot B from the parcel that is located at the east central portion of Lot B for personal reasons. Based upon the information submitted, the Department of Planning Services staff recommends approval of this requested amendment for the following reasons: 1. The impact on surrounding agricultural land uses would not appear to be any different than the original request, which has been approved. 2. This request is in compliance with Section 9_2 E. of the Weld County Subdivision Regulations with the exception of 9-2E. (e) . Approval of this request will result in a parcel being under one (1) acre in size. Sections 9-2 E. (e) and 12-1 of the Weld County Sub- division Regulations allows the Board to grant a variance or exempt a parcel from the one (1) acre minimum size if the enforcement of the regulation is impracticable or will exact undue hardship. The request must be considered reasonable and within the 820608 Board of County Commissioners Page 2 November 17, 1982 general purpose and intent of the Subdivision Regulations. The staff recommends that the parcel be exempted from the one (1) acre minimum requirement because there is currently an existing single family dwelling unit located on the parcel in question. Enforcement of this provision of the Regulations would be impracticable because of the existing improvements located on the parcel. The Department of Planning Services staff's recommendation for approval is conditional upon the following: 1. That the submitted Recorded Exemption Plat be amended by deleting Lot "A" as shown and to amend the legal description by excluding that area shown as Lot "A". 2. The title on the Recorded Exemption Plat shall read "Amended Lot B of Recorded Exemption No. ". 3. The above stated conditions shall be approved by the Department of Planning Services staff before recorda- tion of the Recorded Exemption Plat by the office of the Clerk and Recorder.
