RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JOHN ADAMS FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, John Adams, VI #0000095, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of December, 2003, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, John Adams was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until January 9, 2004, to allow adequate time for the property owner to
completely screen the noncommercial junkyard and finalize the Building Permits.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000095 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against John Adams to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until January 9, 2004, to allow
adequate time for the property owner to completely screen the noncommercial junkyard and
finalize the Building Permits.

Currently the property is in violation of Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30

REMEDY
To bring the property into compliance, the"Noncommercial Junkyard"shall be restored, removed or
completely screened from all adjacent properties and public rights-of-ways. Additionally, the 2 (two)

RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

Dear Mr.Adams:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on December 9, 2003,at 10:00 a.m.,to consider the violations occurring
on the property. The above mentioned property remains in violation of the following Section(s) of the
Weld County Code:
Chapter 23,Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
Chapter 29,Article Ill "Building Permits."
Section 29-3-10 "Building permit required."
-No building or structure regulated by this Building Code shall be erected,constructed,enlarged,
altered, repaired, moved, improved, removed, converted or demolished unless a separate
building permit for each building or structure has been first obtained from the Building Inspection
Department. (Before any demolition permits are issued, approval must be given by the
Department of Public Health and Environment.)
Section 29-3-230 "Expiration of plan review."
Applications for which no permit is issued within one hundred eighty(180)days following the date
of application shall expire by limitation, and plans and other data submitted for review may
thereafter be returned to the applicant or destroyed by the Building Official. The Building Official
may extend the time for action by the applicant for a period not to exceed one hundred eighty
(180)days upon request by the applicant showing that circumstances beyond the control of the
applicant have prevented action from being taken. No application shall be extended more than
once. In order to renew action on an application after expiration,the applicant shall resubmit
plans and pay a new plan review fee.
To bring the property into compliance:

(BC-9800642). This permit is for a 20 x40 area within a pole bam for a bathroom and
office. My records indicate that you recently obtained an inspection. Please make all

you.
• Lastly,please be advised that your newest building permit(BCS-020158)has not had
activity for almost 5 (five) months. If this permit remains inactive, it to will face
expiration. Please call for an inspection.

Center,915 10th Street,Greeley,Colorado. It is recommended that you or a representative be in attendance to
answer any questions the Board of County Commissioners might have about the violations.

business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attomey to proceed with legal action to remedy the violation. Our records,indicate that you

The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on July 8,2003,at 10:00 a.m.,to consider the violations occurring
on the property. The above mentioned property is in violation of the following Section(s)of the Weld
County Code:
Chapter 23,Article Ill, Div 1 "A (Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
Chapter 29,Article Ill "Building Permits."
Section 29-3-10 "Building permit required."
-No building or structure regulated by this Building Code shall be erected,constructed,
enlarged,altered,repaired,moved,improved,removed,converted or demolished unless
a separate building permit for each building or structure has been first obtained from the
Building Inspection Department. (Before any demolition permits are issued, approval
must be given by the Department of Public Health and Environment.)
Section 29-3-230 "Expiration of plan review."
Applications for which no permit is issued within one hundred eighty (180) days
following the date of application shall expire by limitation, and plans and other data
submitted for review may thereafter be returned to the applicant or destroyed by the
Building Official. The Building Official may extend the time for action by the applicant
for a period not to exceed one hundred eighty(180)days upon request by the applicant
showing that circumstances beyond the control of the applicant have prevented action
from being taken. No application shall be extended more than once. In order to renew
action on an application after expiration, the applicant shall resubmit plans and pay a
new plan review fee.
To bring the property into compliance:
The Noncommercial Junkyard shall be restored, removed or screened from
all adjacent properties and public right-of-ways.

expiration (BC-9800642). This permit is for a 20 x 40 area within a pole barn
for a bathroom and office. My records indicate that you recently obtained an
inspection. Please make all corrections as indicated and call for another

the phone, he told me that the building is a 80 x 40. In our computer, we show it is a 20 x
40. As per our conversation this morning, he is going to get a new permit. In that new permit,
we need to make sure that we get the right size of the building. I also told him that we could
save him a little bit of time, by letting him transfer the information (warranty deed) from the
old permit into the new permit. He does need to understand that the NCJY needs to be taken
care of before the new permit will be issued. There will be a new violation number for the
building Tuesday afternoon. I will inform the new number to everyone needing that
information.

SCREENED: Construction and maintenance of fences,earth berms or the USE of LANDSCAPING materials or other materials USED with
the approval of the Department of Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding USES.
