RE: APPROVE CERTIFICATE OF DESIGNATION - ESTATE OF JARRALD JAMISON AND
FAYE JAMISON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on the 22nd day of October, 2003,a public hearing was held in the Chambers
of the Board of County Commissioners of Weld County, Colorado, for the purpose of considering
whether to grant a Certificate of Designation to the Estate of Jarrald Jamison and Faye Jamison,
15721 Weld County Road 10, Fort Lupton,Colorado 80621,said site to be located on the following
described property:
Part of the S1/2 SE1/4 and Lots A and B of Recorded Exemption
#1367;being further described as the S1/2 N1/2 SE1/4 of Section 32,
all in Township 3 North, Range 65 West of the 6th P.M., Weld
County, Colorado
WHEREAS,said applicant was represented by Kenneth Lind, Esquire,Lind,Lawrence and
Ottenhoff, LLP, P.O. Box 326, Greeley, Colorado 80632 at said hearing, and
WHEREAS,said request for a Certificate of Designation was submitted in conjunction with
an application for a Site Specific Development Plan and Second Amended Use by Special Review
Permit#842 fora Solid Waste Disposal Site and Facility(Commercial Junkyard and Salvage Yard
including tire landfill, storage and recycling facility) and a Mobile Home for Housing in the
1-3 (Industrial) Zone District which was approved by the Board, and
WHEREAS, Section 30-20-104, C.R.S., requires the Board to take into account certain
factors to approve a Certificate of Designation and,having taken into account said factors,finds as
follows:
1. The Conditions of Approval and Development Standards in Second Amended Use
by Special Review Permit #842 will minimize the impacts on the surrounding
property and the area to the greatest extent possible. The Conditions of Approval
and Development Standards will also provide adequate protection of the health,
safety, and welfare of the inhabitants of the area and the County.
2. The location of the proposed solid waste disposal site will be convenient and
accessible to the potential users.
3. The applicant has demonstrated in the submitted application materials there is a
need for the proposed solid waste disposal site.
4. The applicant has demonstrated in the submitted application materials the ability to
comply with the health standards and operating procedures of the Solid Waste
Disposal Site and Facilities Act, Section 30-20-100.5, et seq., C.R.S.

5. The Colorado Department of Health and the Weld County Health Department have
reviewed this request and find, subject to conditions, the proposal will comply with
the Standards of the Solid Waste Disposal Sites and Facilities Act, Section
30-20-100.5, et seq., C.R.S.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a Certificate of Designation for the Estate of Jarrald Jamison and Faye
Jamison, on the hereinabove described real property be, and hereby is, granted subject to the
following conditions:
1. The property shall be maintained in compliance with Second Amended Use by
Special Review Permit#842, all submitted application materials on file with Weld
County,and all requirements of the Weld County Department of Public Health and
Environment and the Colorado Department of Public Health and Environment.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 22nd day of October, A.D., 2003.

In accordance with the provision of Sections 30-20-101 through 30-20-115, C.R.S., the Board of
County Commissioners of Weld County, Colorado, hereby grants a Certificate of Designation for
a Solid Waste Disposal Site and Facility (Commercial Junkyard and Salvage Yard including tire
landfill, storage and recycling facility) and a Mobile Home for Housing in the 1-3 (Industrial) Zone
District.
