RECEIV ED MAY1 2 19M P.!d. atitV11►11jgl'I4lje Form PR-4-SH S Rev. 8/21/63) Project ; , S 0048(1) , County Yield Date April 22, 1964 COOPERATIVE AGREEMENT THIS AGREEMENT entered into this 22nd day of April 1964 , by and between the County of Weld , party of the first part, and THE STATE HIGHWAY COMMISSION OF COLORADO, a public corporation for the use and benefit of the STATE OF COLORADO, party of the second part, WITNESSETH that WHEREAS, The Department has constructed, or proposes to co s ruct, or provide for the construction of, a project known as Project S 0048\1) approximately 5.534 Af miles long, beginning at the Jct of SH 1 (US 287) and SH 7 in Lafayette — easterly to Interstate Route 25 on State Highway No. 7 in the County and WHEREAS, the said State Highway is part of the Federal Aid Secondary System, NOW, THEREFORE, in accordance with the Federal Aid Act of 1950, the Parties have jointly reviewed the Geometric Standards governing the type of construction for said Project and have agreed as follows: That, the 1964 Annual Average Traffic Volume, as determined froM actual vehicular count, by the Planning and Research Division of the Department is''found to be 1250 vehicles per day. Therefore, in accordance with approved and established practices, the traffic volume twenty years hence is estimated to be 2625 vehicles per day. Consequently, the type of construction shall be that designated as Type B of the Geometric Standards dated August 1, 1952, (revised November 1, 1956) , more fully described a's follor.s• The surface shall consist of Plant Mix Asphalt , 2rr feet wide on a roadway 2/ feet wide. The maximum grade shall be 5.10 percent and the curvature shall not exceed 0 degrees and 0 minutes. The rights of way shall not be less than 125 feet .in..width,. except through the .31ownXiXiXof Lafayette where the established street widths shall prevail. Bridges and Separations shall have a design load of V Those structures having a length less than sixty (60) 'feet shall have a clear roadway width, between curbs or wheel guards, of 3/ feet• and those having a length of sixty (60) feet and over shall have a clear roadway width of V feet. This Agreement shall be binding upon and inure to the benefit of the Successors and assigns of the Parties Thereto. • This Agreement is executed with reference to the signatories on behalf of the County by virtue of a Resolution passed at the meeting of the Board of County Commissioners held on April 22, 1964 a certified copy of which is attached hereto. I had spent between two and three dollars for paint materials. Upon investigation, I found that the surveyors had evidently beeneeon the inside of the fence, had staked it out and probably pulled signs up in order to make surveying easier. I called on Nr. Watts who was doing the road work, who seemed very honorable, and he informed me that he had not taken the signs. However, I believe he had a blue- print which showed that there were four signs on the premises, which is correct . One sign is worthless. Then there was a Morrison mine sign, which I believe is still there. The two wooden signs which are now missing advertised the farm for sale. One of these signs was about 2 1/2 x 3 feet , and the other about 3 1/2 x 4 1/2 feet. Mr. Mul- ford, who put the signs up, informs me that it has always been his custom to put cleats at the bottom of the posts holding the signs. It has occurred to me that nuite likely your surveyors had taken these signs down and it is possible they are keeping them to be put up again later. I certainly hopeAfor, in my opinion, it will cost from 418.00'to G2O'°2- to have signs made, lettering done by painter, and the signs again erected. If the signs were left on the premises after they were taken down, some- one has taken them away. I sincerely hope that the surveyors can give me some light on this subject. Recent inquiry as to the cost of erecting a mile of steel fencing, with, however, more substantial posts than are now on my land, I was informed on good authority would cost X450.00. In your letter of October 27th you made mention of the fact that in some instances the State Highway Department is asking for more than twenty feet, and it occurred to me that possibly you wanted more than the twenty foot strip previously asked for. Any reference to the excess over and above the twenty foot right-of-way referred to any- thing in addition to the amount originally asked for, namely, twenty feet. As to any damage done to crops, I would say that I have been informed that last year's tenant had seeded some fifty or sixty acres, part of which pro- bably was along the South line of the land. However, he was not authorized to do so and, if i find upon investigation that no crop has been planted, would not of course demand any compensation.for crop acreage. I have been extremely busy and for that reason have been unable to take up various matters of importance with tenants. Mr. Morrison, the tenant who has tan acres bordering a short distance on the South line,has no crops in along the fence and I feel very sure will not cause us any trouble by moving the fence back twenty feet by approximately two hundred feet. In conclusion, I beg to state that the amount asked for is $50.00 for the twenty foot strip and the erection of a fence, as previously described, and $15.00 for crop damage. Said $15.00 to be rebated if said crop has not been seeded along the proposed twenty feet to be used in right -of-way. This is subject to your investigation, of if left with me will receive reasonably prompt attention, and adjustment a.s outlined. Broad boulevards are nice, of course, but as present sixty foot thoroughfare is graveled and in good condition, to widen it an • additional forty feet only adds to its cost and maintenance and is unnecessary so far as my land is concerned. Furthermore , with diverted traffic will come more undesireables, an increase in thefts, tresspassing and damage by hunters and others, and please bear in mind that my quarter section is in one of the very few highest assessed school districts in Weld County and that such school taxes have been, so I am informed, paid under protest for several years back. I would, also, ask the Commissioners to consider the uncertain margin of income due to weather and other conditions as ordinarily come from dry land. With one-half this year's wheat crop of less than five hundred bushel of inferior wheat and the small rental of buildings, with $39.00 rent unpaid, I am already $160.00 in the red for this season. Add to this taxes and upkeep of improvements and $300 to $400 for painting buildings ' every four to five years, other expenses, etc. , it seems to me that I would be cooperating commensurately and with every degree of fairness by giving the County an additional right-of-way of twenty feet along the south line for the sum of $50.00, with the understanding that a new fence be erected as outlined in your letter of the nineteenth at County expense. Mr. Mulford, former owner, informs me that he was awarded $100.00 by a jury for 99/100ths of an acre ditch right-of-way and he has offered twice that some since if ditch owner would vacate. Personally, I recognize the County can take by condem- nation proceedings, pay little if anything, claim benefits, etc. , whether they exist or not--so I must submit to the inevitable. Denver County property owners have been swindled through taxation for the Moffat Tunnel. No parcel of land is free--they pay and will continue to pay for years to come for something from which they receive absolutely no benefit. . Experience has proven that larger acreage is often more profitable and easier to get a better class of tenant where suf- ficient land is available and where some grazing land is to be had, so that I should prefer to add to rather than take away a part of my holdings. la0Q.O • Mr. C. 0. Plumb, County Commissioner, ha* some correspondence with you relative to additional right of way for the "Base line" road, but the matter was never settled. I am anxious to clear up all matters pertaining to my office before my term expires and would like to make settlement for the additional right of way through your property. I have been expecting to hear from State highway Engineer, regarding ditch right of ways, but have had no word from him. As to payment for land required for this right of way, I do nod feel that $20.00 is a fair payment for this when other land is being given a nww steel fence , just because such land was not fenced at all. I think I should have $30.00 for land and $20,00 for crop damage. Also I wish a culvert palced near my Bast line so we will have a way in and put t171rard the new road from near our buildings and also an assurance that all ditch rights now existing will be protected.
