RESOLUTK74OF THE WELD COUNTY PLANNING COOlISSION Moved by Stephen Mokray that the following resolution be introduced for passage by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: CASE NUMBER: USR-1434 APPLICANT: Town of Eaton PLANNER: Michelle Katyryniuk LEGAL DESCRIPTION: Part NW4 Section 2, T6N, R66W of the 6th P.M., Weld County, Colorado. REQUEST: Site Specific Development Plan and Special Review Permit for a Major Facility of a Public Utilities or Public Agencies (2.6 MG Water Tank). LOCATION: East of and adjacent to CR 33; '/z mile south of CR 74. The Planning Commission approves this request for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Planning Commission staff that the applicant has shown compliance with Section 23-2-400 of the Weld County Code as follows: A. Section 23-2-400.A. -- Reasonable efforts have been made to avoid irrigated crop land or to minimize the impacts on such lands in those cases where avoidance is impractical. The subject site is designated Prime Irrigated Farmlands by the USDA Soil Conservation Services. The small size of the lot (2 acres)severely limits its agricultural value. B. Section 23-2-400.B. --The facility will not have an undue adverse effect on existing and future development of the surrounding area as set forth in applicable Master Plans. The subject property lies within the three-mile referral area of the Town of Eaton and the Town of Greeley,both municipalities stated in their referrals received June 16,2003 and July 11, 2003 that they had no conflicts with the request. C. Section 23-2-400.C.--The design of the proposed facility mitigates negative impacts on the surrounding area to the greatest extent feasible. The proposed facility will be compatible with surrounding land uses. While there are predominantly agricultural uses in the area,the proposed structure will use landscaping to buffer the residence to the south. D. Section 23-2-400.D. --The site shall be maintained in such a manner so as to control soil erosion, dust, and the growth of noxious weeds. The Conditions of Approval and Development Standards will ensure that there is no fugitive dust or erosion and will ensure the control of noxious weeds. E. Section 23-2-400.E. --The applicant has agreed to implement any reasonable measures deemed necessary by the Planning Commission to ensure that the health, safety, and welfare of the inhabitants of Weld County will be protected and to mitigate or minimize any potential adverse impacts from the proposed facility. F. Section 23-2-400.F. --All reasonable steps have been taken by the applicant to minimize negative impacts on agricultural uses and lands. The proposal will not require additional water demands on the site. The proposed facility will be unmanned and will not require water or sewage disposal. The Conditions of Approval and Development Standards minimize negative impacts on the existing agricultural uses and lands of the area. G. Section 23-2-400.G. -- All reasonable alternatives to the proposal have been adequately assessed and the proposed action is consistent with the best interests of the people of Weld County and represents a balanced use of resources in the affected area. Section 23-2-400.H. -- This application will create limited, if any, demand for additional government services. Section 23-2-400.1. --The Conditions of Approval and Development Standards will ensure that the nature and location of the facility will meet Colorado Department/of Health and Weld County air quality standards. J. Section 23-2-400.J.—Adequate electric,gas,telephone,water,sewage, and other utilities exist or can be developed to service the site. K. Section 23-2-400.K. -- The nature and location or expansion of the facility will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, historic landmark or archaeological sites within the affected area.There will be no significant impact on wildlife habitat. The Division of Wildlife indicated that they had no conflicts with the project, as stated in their referral received June 20, 2003. L. Section 23-2-400.L.--The proposed use will not significantly impact drainage of residential property, crop land or other land. M. Section 23-2-220.A.7— The proposed use has no associated housing requirements. This recommendation is based, in part,upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission recommendation for approval is conditional upon the following: 1. Prior to scheduling a Board of County Commissioners hearing: A. The applicant shall submit to the Weld County Department of Planning Services a signed copy of an agreement with the properties mineral owners which stipulates that oil and gas activities have been adequately incorporated into the design of the site or submit evidence that mineral owners concerns have been mitigated. (Department of Planning Services) 2. Prior to recording the plat: A. The plat shall be labeled USR-1434 (Department of Planning Services) B. The applicant has not delineated any on-site sign(s). If any on-site sign(s)are desired,the signs shall adhere to Section 23-4-90.A and .B of the Weld County Code. One identification sign per principal use shall be allowed, provided that the sign does not exceed sixteen(16) square feet in area per f ace. F urther, the location o f the sign, i f a pplicable s hall b e delineated on the Landscape/Site Plat. All structures, including signs,on site must obtain the appropriate building permits. (Department of Planning Services ) C. The plat shall meet all the requirements of Section 23-2-380 of the Weld County Code. (Department of Planning Services) D. The applicant shall submit a Screening/Landscape Plan for review and approval. The plan shall address all issues stated in the referral from Kim Ogle, Department of Planning Services dated July 11, 2003 as well as the following: 1. The applicant shall demonstrate how the proposed plant material will be irrigated. 2. The applicant shall delineate on-site lighting,including security lighting if applicable. Existing plants shall be delineated as a circle with a dot in the middle, proposed shall be delineated as a circle with a"+" in the middle. 4. The Landscape Plan shall indicate a site for a trash collection that is sufficiently screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. 5. The specific location of the native seed mix shall be delineated on the Landscape Plan. (Department of Planning Services) E. County Road 33 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance,Section 20-1-30 as a collector road,which requires 80 feet of right-of-way at full build out.There is presently 60 feet of right-of-way.A total of 40 feet from the centerline of County Road 33 shall be delineated right-of-way on the plat. This road is maintained by Weld County. (Department of Public Works) F. The o ff-street parking including t he a ccess d rives hall b e s urfaced with g ravel o r the equivalent and shall be graded to prevent drainage problems. (Department of Public Works) G. The West Greeley Soil Conservation District has provided information regarding the soils on the site. The applicant shall review the information and use it to positively manage on site soils. (West Greeley Soil Conservation District) H. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all required materials. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. (Department of Planning Services) The applicant indicated that a 16-inch drain line will be installed from the tank to Montgomery Reservoir approximately 150 feet east of the tank site. Adequate written documentation should be included by the adjacent landowner or the reservoir company, authorizing permission to utilize this facility for any draining or surface run-off. (Department of Public Works) J. The applicant shall delineate on the plat an easement for the drainage line into Montgomery Reservoir. (Department of Planning Services) K. The plat shall be amended to delineate the following: 1. The attached Development Standards. (Department of Planning Services) 2. The approved Landscape/Screening Plan. (Department of Planning Services) L. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. The applicant shall contact the Department of Building Inspection to determine appropriate Building permits that may be required for all future construction associated with this facility. Upon completion of 1. and 2. above the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within thirty(30)days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department of Planning Services) 5. The Department of Planning Services respectively requests the surveyor provide a digital copy of this Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be sent to maps(dwo.weld.co.us. (Department of Planning Services) 6. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. (Department of Planning Services) OITE SPECIFIC DEVELOPMENT PLAN • SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Town of Eaton USR-1434 1. The Site Specific Development Plan and Special Use Permit is for a Major Facility of a Public Utility (2.6 MG Water Tank) in the A(Agricultural)Zone District, as indicated in the application materials on file and subject to the Development Standards stated hereon.(Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100.5, C.R.S.,as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) 4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S, as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. (Department of Public Health and Environment) 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. (Department of Public Health and Environment) 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. (Department of Public Health and Environment) 8. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. (Department of Public Health and Environment) 9. Bottled water shall be utilized for drinking and hand washing during construction, maintenance and/or inspection of the water storage tank. (Department of Public Health and Environment) 10. Adequate toilet facilities (port-a-potty)shall be provided during the construction of the water storage tank. (Department of Public Health and Environment) 11. The approach to the gated access point should be located far enough back that a vehicle can pull off from County Road 33 entirely before opening the gate to access the facility. No staging or parking will be allowed on County Road 33. Utilize on site parking and circulation. (Department of Public Works) 12. The historical flow patterns and run-off amounts will be maintained on site in such a manner that will reasonably preserve the natural character of the area and not prevent property damage of the type generally attributed to run-off rate and velocity i ncreases, diversions, concentration and / o r unplanned ponding of storm run-off. The applicant indicated that a 24-inch water line will be extended from the tank location eastward along the one-half section line to County Road 35 and north to County Road 74. If any of this line is located within Weld County's right-of-way,Weld County Public Works,to acquire the appropriate right-of-way permits. (Department of Public Works) 14. Landscaping material as indicated in the approved Landscape Plan shall be maintained at all times. Dead or diseased plant material shall be replaced with material of similar quantity and quality at the earliest possible time. As stated in the application materials, earthtone paint shall be applied to the proposed tank and surrounding security fence. (Department of Planning Services) 16. A building permit shall be obtained prior to the erection of the water tank. A plot plan shall be submitted showing all structures with accurate distances between structures,and from structures to all property lines. (Department of Building Inspection) 17. An engineered foundation, based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer, is required for the water tank. Check with a plans examiner for possible plan review requirements. (Department of Building Inspection) 18. The water tank shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 1997 Uniform Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. (Department of Building Inspection) 19. Building height shall be measured in accordance with the Building Code for the purpose of determining the maximum building height. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the water tank. (Department of Building Inspection) 20. The property owner or operator shall be responsible for complying with the Design Standards of Section 23-2-240, Weld County Code. 21. The property owner or operator shall be responsible for complying with the Operation Standards of Section 23-2-250, Weld County Code. 22. Weld County Government Personnel shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County regulations. 23. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 24. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners . A building permit shall be obtained prior to the erection of the water tank. An engineered foundation, based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer, is required for the water tank. Construction on the site will include the tank itself along with an 11' X 11' vault to house valves and monitoring equipment. The tank is required because of growth in the town necessitating additional potable water storage capacity. The tank will be supplied and emptied by means of a 24 inch water line which will extend from the tank location eastward along the half-section line to WCR 35 then north to WCR 74 and east approximately 'A mile where it will connect with existing town water lines. Because of elevation requirements there are few sites that would be appropriate for the location. One other site was considered, at approximately the intersection of WCR 76 and WCR 31, but the cost of additional transmission line made that site less desirable. The tank site will be fenced for security and will be landscaped using a tree boundary to minimize the visual impact. In addition, the tank will be painted in a manner to reduce visibility. After construction there will be no work force at the site. The tank will be monitored using SCADA technology and only routine maintenance will be performed at the site itself The only utility requirement for the site is availability of electrical power to operate the monitoring equipment. A 16" drain line will be installed from the tank to Montgomery Reservoir approximately 850 feet east of the tank site so that the tank can be drained without effecting surface runoff. s Town of Eaton Water Tank Project Detailed Report Following is the detailed report on the proposed water tank storage facility for the Town of Eaton. A. The proposed facility will include a 2.6 million gallon water storage tank and a concrete vault building to house valves and monitoring equipment. A detailed site plan is included in this document for your consideration. The 2-acre site has been designed to allow for construction of this tank and vault as well as for another similar tank in the future, should it be required. A 24" water transmission line will connect the tank to existing water lines within the town and a 16" drain line will be constructed which will allow the tank to be drained into the Montgomery reservoir if the tank needs to be emptied for any reason. Both lines will run east from the tank site along the half-section line and will avoid other utility easements. B. A second site was considered for the facility. This site, located at approximately WCR 76 and WCR 31, has the desired elevation to match with the existing tank on the water system but would require nearly 1/2 mile additional transmission line. In addition, the alternate location would have required easements along WCR 76 where there would be a greater potential for conflict with other utilities. C. The two locations listed were the only sites near to the town that would have provided the correct elevation without significant ground work or construction of a tower facility. D. Use of this site for a utility purpose will remove 2 acres from crop production. The elevation at the west end of the field is such that,by choosing to locate the site there,the remainder of the field can be farmed without any additional difficulty. The irrigation ditch can be easily moved to the east of the tank site and farming can continue with minimal disruption. E. The alternative site would increase cost significantly since additional transmission line would be needed and the transmission line would have to be installed along WCR 35 necessitating additional easements. Additionally, regardless of which location was chosen, 2 acres would be removed from crop production. F. There will be no impact on mineral resources. The town does not wish to purchase the mineral rights to the property and locating the tank on this site would not prevent oil or gas exploration in the area. s G. No impact is expected on wildlife habitat. H. Historical, archeological and scenic resources will not be affected. I. There will be some visual impact because the location of the tank is west of the town, in the direction of the mountains. The tank is on a hill and will be visible from town, however it will not prevent a view of the mountains from any existing or planned residential areas. We will landscape the site and will paint the tank in a manner that will minimize the visual effect. J. No geological or flood hazard is anticipated. Any surface runoff will flow into the existing irrigation system. K. There is no particular advantage to the alternate location at WCR 76 and WCR 31 except that the elevation is appropriate. The disadvantage is the additional cost for transmission lines and the additional distance from existing town limits. L. The chosen location for the water transmission line, directly east from the site to WCR 35, was preferred over an alternative route—north along WCR 33 to WCR 74 then east—because the chosen route would avoid other utility easements, would not cause congestion during construction and would be less expensive than putting the line along an existing roadway. M. Installation of the transmission line will take place after crops have been harvested in the fall and the land will be available for crop production the following spring. Where possible the line will follow existing roadways between fields. N. Construction should begin in August if approval is granted by that time. The project will be completed by February of 2003, weather permitting. As soon as construction of the tank and pipeline are complete the site will be put into operation. O. No public meetings have been held but all landowners who will be effected by the tank have been contacted and have approved the project. P. There are no hazards to the public because of this facility. There are no sources of fire or potential for explosion from the site. The site will be fenced to prevent access and all doors and gates will be locked to prevent individuals from climbing on entering the tank or the vault. • Q. In case of emergency the tank can be drained to the Montgomery reservoir through a 16" line. No action would be required of officials other than town maintenance workers if a failure were to occur. R. As described earlier, the site will remove 2 acres from crop production, but the site is located at the end of a field and the remainder of the field can be farmed without changes. The construction process will be timed to minimize the effect on crop production and will be completed before crops are planted in the spring. S. This proposal conforms to the guidelines of the Weld County Comprehensive Plan. The proposal recognizes private property rights because the landowner was compensated at the"highest, best use" rate for his property and there is a reversion clause in the deed guaranteeing that the property will revert to agricultural use if and when the use of the property for a utility is abandoned. The proposal recognizes the agricultural tradition since the timing of the project is set to minimize interference with crop production and the site is situated in such a way as to minimize the effect on the current use of the remainder of the land. As the population of our community grows it is essential that we expand our infrastructure to provide basic services, but we have attempted to do so without having a negative impact on the agricultural use of the surrounding land. T. The Town of Eaton will maintain the site. Road base will be used around the tank and the site will be fenced and landscaped. Weed control will be done by the town maintenance crew. U. Surface runoff from the site will be contained by the existing irrigation system. Any other drainage will flow through the drain system to the Montgomery reservoir. I • Town of Eaton Water Tank Project Item#5 There will be no negative effect on other local governments or special districts caused by the installation of this facility. The only effect of note is that the Eaton Fire Protection District will find increased fire-flow water supply potential during peak use hours. The site has been designed so that set back requirements will be met even if Weld County chooses to increase the width of the right of way on WCR 33. This project falls primarily under the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: This proposed USR will fall under a major facility of a public utility for a private agency (2.6 MG Water tank) Access: The applicant indicated a proposed access on to WCR 33, which is designated as a collector status, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article Ill, Section 23-3-50, the required setback is measured from the future right-of-way line. Average Daily Traffic Count: Our most current ADT count for WCR 33 between WCR 72 and WCR 74 reflects 323 vehicles taken in a 24-hour period on 5/1/2003. REQUIREMENTS: Access: The approach to the gated access point should be located far enough back that a vehicle can pull off from WCR 33 entirely before opening the gate to access the facility. No staging or parking will be allowed on WCR 33. Utilize on site parking and circulation. Off-Site Parking and Circulation: The off-street parking including the access drive shall be surfaced with gravel or the equivalent and shall be graded to prevent drainage problems. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off Right-of-Way: The applicant indicated that a 24-inch water line will be extended from the tank location eastward along the one-half section line to WCR 35 and north to WCR 74. Section 23-3-250.A.5.a states "No more than eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped." Section 23-3-250.A.5.a states "That portion of a Lot which abuts a public or private street right- of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the Lot line towards the interior of the Lot. Driveways may pass through the required landscaped areas." The plant material list delineates a limited diversity of plant material, although the size is not specified, staff approves the species selection of an evergreen type species as delineated on the Plat. Staff will require additional plantings to be delineated on the plat for screening from adjacent road rights-of-way. The use of vertical plant material is highly suggested. Staff will require additional information regarding the offset from road rights-of-way for the proposed plantings. Staff will also require a note addressing the size of plant material proposed at time of installation. Substitutions in plant material species shall be approved by this office prior to installation. The applicant has not called out a selection of ground cover, including turf, if applicable on the Site drawings, Future submittals shall address the type of plant material proposed for the ground plane. Landscaping materials as indicated in the Approved Landscape Plan shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring adequate growth and established of the feeder root system. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. Staff has reviewed this site plan and related documents and feels that the Town has adequately addressed our issues of buffering, screening and color of the tower. The tower will most likely be visible from the north side of Greeley. It does not appear that it will be out of character with the grain elevators and other various agricultural uses that dot the landscape in the area. We recommend that Weld County approve the water tower with conditions listed in the applicant questionnaire. The site is outside the Greeley Urban Growth Area and should not negatively impact future development within the City of Greeley. The Greeley Master Transportation Plan identifies CR 33 as a Minor Arterial south of Highway 392. Future development in the area could see increased traffic north of Highway 392 necessitating the need for additional right-of-way on CR 33 up to CR 74. Although this area is outside the scope of the Greeley Master Transportation Plan, staff thought it would be beneficial for you to know the future status of CR 33.
