RESOLUTION
RE: APPROVAL OF REPLAT OF SEEMORE HEIGHTS FOR GUY BRALY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 6th day of May, 1981, a public meeting was
held before the Board of County Commissioners of Weld County,
Colorado, upon the application of Guy Braly for a replat of
Seemore Heights, being more particularly described as follows:
Part of the Northwest Quarter of Section 30,
Township 3 North, Range 68 West of the 6th
P.M. , Weld County, Colorado
WHEREAS, the Board of County Commissioners heard the testi-
mony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request and the recommendations of the Weld County Planning Com-
mission, and having been fully informed, is satisfied that the
proposed replat of Seemore Heights conforms to the requirements
of the Weld County Subdivision Regulations and finds that the
approval of said replat would be in the best interests of Weld
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the replat of Seemore
Heights as submitted by Guy Braly be, and hereby is, approved
provided that the plat be amended to include the following note:
"A site specific soils investigation and an individual foundation
design may be required by the Building Inspection Deivision prior
to issuance of any building permits on Lots 1 and 2 . " , and further
provided that the plat be amended to reflect the existing right-
of-way for State Highway 66, as identified by the State Highway
Department.

changed.

4. The St. Vrain Valley School District, the Weld County Health Department,
the Weld County Engineering Department, the Longmont Fire Protection

a drainage tile located within State Highway 66 right of way. We have no
objection to the repair or maintenance of this tile as long as it is done
safely and does not result in any damage to the highway itself.
Before:agy routine maintenance wort is performed, permission must be
obtained from the District IV Maintenance Superintendent: Mr. David N. Fraser,
P. O. Box 850, Greeley, Colorado 80632. This will ensure that the local
maintenance foreman is aware of the work and that proper safety measures
are taken. In an emergency repair situation, an effort should be made to
notify either the Maintenance Superintendent or the Boulder area Maintenance
Foreman. Bob Sperling. Ills office is in Boulder, and the telephone number
is 442-4382.

the Board indicated that when resources of the system become

The Board of Directors, at its November 6, 1980'meeting, approved the
issuance of a limited number of water taps, subject to the following
conditions:
1. Request for tap must have been made prior to October 1, -
1980;
2. Applicant shall be limited to a single tap for use in a
single family residence; •
3. Applications must be received, accompanied by current tap
fee on or before December 31, 1980. Membership fee as -of
this date is $4,000 or $1,600 plus one unit of Big T water:--
Each membership tap must receive Board approval and is subject to
applicant' s compliance with rules, regulations and requirements of the
Association. Any line extension or oversizing necessary for service . -
would be the responsibility of the applicant.
If you wish to apply for a tap, please complete and submit the enclosed
application form, along with your check for $4,000 in order that the Board
may consider same at the December 4th meeting or the January 8th meeting.
Meetings are held at 7:00 p.m. at the Liberty Hall Grange, Corner of
Weld County Road #5 and Colorado Highway #66. If you wish, you may attend
the meeting or leave your application at the office and it will be presented
to the Board.
Minimum monthly billing ($15.00) commences 45 days after approval of the
application and issuance of membership whether or not water is used.

Regarding the proposed action, we have no conflicts. The only question we have
is relative to the remaining 4.63 acre parcel (from which the two 3 acre parcels
are being subdivided) and whether or not it has access to a public right-of-way.

Our staff has reviewed the above resubdivision application and the
following information is submitted:
1. Soils in the area of consideration are Aquolls and Aquepts flooded,
and Heldt silty clay, 1-3% slopes .
Aquolls and Aquepts, which make up about 75% of the site, are deep,
poorly drained soils that formed in recent alluvium. They are sub-
- ject to excessive runoff and the water table is at or near the '
surface in spring and during the peak of the irrigation season.
These soils have severe limitations for all aspects of building
site developments, septic tank absorption fields , and recreation
development. Soil capability class is VIw.
• Heldt silty clay, 1-3% slopes , which is about 25% of the area in
consideration, is a deep, moderately well drained soil . Per-
meability is slow, available water capacity is high and the
effective rooting depth is 60 inches or more. Surface runoff is
medium, and the erosion hazard is moderate. This soil has poor
potential for urban and recreational development. Slow permeability
and high shrink-swell create problems in dwelling and road con-
struction. Capability class is IIs irrigated, IVe nonirrigated.
This soil also has severe limitations in all aspects of building
site development.
2. Recommendations - There needs to be a site-specific soils investi-
gation prior to building to design foundations and septic tank
absorption fields.

Dear Ms. Traxler:
We have reviewed the application from Guy Braly for a Replat of Lots 1 and 2,
Seemore Heights - First Addition, and we ask for your consideration of the following
comments.
1 . The supporting information for this application includes a January 6, 1981 letter
from this office to Mr. and Mrs. Chuck Eckenrode. This letter was written in re-
sponse to a verbal request by Chuck Cunliffe for clarification of our policy with
regard to maintenance of a drainage tile which was presumed to be located within
State Highway right of way.
The enclosed copies of S.H. 66 right-of-way plans and a property deed confirm that
- the drainage tile referenced in our previous letter is not located within the high-
way right of way. As shown on the right-of-way plans and verified on-site, the ex-
isting right of way along most of this subdivision is 150 feet; 45 feet south of
highway centerline and 105 feet north of centerline. The subdivision plat map
should be changed to reflect the existing right-of-way condition.
2. Access to Lots 1 and 2 is presently obtained from Elmore Road and we see no need
for direct access to S.H. 66 as a result of this replat. Although we have no con-
trol over the 20-foot Access Easement along the north property line, we have a con-
cern with regard to the effect of this easement on turning movements at the Elmore
Road/Highway 66 intersection. If this easement were to become heavily used, con-
flicts could result due to the close proximity of the access to Elmore Road in
relation to S.H. 66.
