HomeMy WebLinkAbout810142.tiff • • RESOLUTION RE: APPROVAL OF REPLAT OF SEEMORE HEIGHTS FOR GUY BRALY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 6th day of May, 1981, a public meeting was held before the Board of County Commissioners of Weld County, Colorado, upon the application of Guy Braly for a replat of Seemore Heights, being more particularly described as follows: Part of the Northwest Quarter of Section 30, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board of County Commissioners heard the testi- mony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request and the recommendations of the Weld County Planning Com- mission, and having been fully informed, is satisfied that the proposed replat of Seemore Heights conforms to the requirements of the Weld County Subdivision Regulations and finds that the approval of said replat would be in the best interests of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the replat of Seemore Heights as submitted by Guy Braly be, and hereby is, approved provided that the plat be amended to include the following note: "A site specific soils investigation and an individual foundation design may be required by the Building Inspection Deivision prior to issuance of any building permits on Lots 1 and 2 . Soils in the area of consideration are Aquolls and Aquepts flooded, and Heldt silty clay, 1-3% slopes . Aquolls and Aquepts, which make up about 75% of the site, are deep, poorly drained soils that formed in recent alluvium. They are sub- - ject to excessive runoff and the water table is at or near the ' surface in spring and during the peak of the irrigation season. These soils have severe limitations for all aspects of building site developments, septic tank absorption fields , and recreation development. Soil capability class is VIw. • Heldt silty clay, 1-3% slopes , which is about 25% of the area in consideration, is a deep, moderately well drained soil . Per- meability is slow, available water capacity is high and the effective rooting depth is 60 inches or more. Surface runoff is medium, and the erosion hazard is moderate. This soil has poor potential for urban and recreational development. Slow permeability and high shrink-swell create problems in dwelling and road con- struction. Capability class is IIs irrigated, IVe nonirrigated. This soil also has severe limitations in all aspects of building site development. 2. The supporting information for this application includes a January 6, 1981 letter from this office to Mr. and Mrs. Chuck Eckenrode. This letter was written in re- sponse to a verbal request by Chuck Cunliffe for clarification of our policy with regard to maintenance of a drainage tile which was presumed to be located within State Highway right of way. The enclosed copies of S.H. 66 right-of-way plans and a property deed confirm that - the drainage tile referenced in our previous letter is not located within the high- way right of way. As shown on the right-of-way plans and verified on-site, the ex- isting right of way along most of this subdivision is 150 feet; 45 feet south of highway centerline and 105 feet north of centerline. The subdivision plat map should be changed to reflect the existing right-of-way condition. 2. Access to Lots 1 and 2 is presently obtained from Elmore Road and we see no need for direct access to S.H. 66 as a result of this replat. Although we have no con- trol over the 20-foot Access Easement along the north property line, we have a con- cern with regard to the effect of this easement on turning movements at the Elmore Road/Highway 66 intersection. If this easement were to become heavily used, con- flicts could result due to the close proximity of the access to Elmore Road in relation to S.H. 66.
