Dear Sheri:
I would like to thank you in advance for the opportunity to respond to the above-
referenced referral request. Planning Staff has reviewed the resubdivision for the
redesign, addition and vacation of lots 17-30, Block P from Evans Addition. The
Town of Frederick find no conflicts with the resubdivision; however, we object to
any provisions for access onto Aspen Drive.
Pursuant to a 1998 Agreement between the Town of Frederick and various land
owners in Evanston; the Town prohibits access of the Evanston properties to
Aspen Drive until they annex into the Town of Frederick. I have attached this
agreement for your reference.

WHEREAS,these remain:rig parties have reached separate agreements with each other and
now agree that title to the "wcdg " is to be quieted in Bernard J. Wysock,Trustee of,the Bernard
James Wysock Trust;and
WHEREAS, there exists'en the eastern edge of the plat of Wolff Gardens a 30 foot wide
county road;and
WHEP'.EAS,these reamie„ng patties have reached separate agreements with each other and
have agreed to clear up title to if.30 foot wide county road by quit claiming their i*tetest to the
Town.
NOW.THEREFORE,in:.:onsideration of the mutual promises and agreements contained
herein and for other good and val sable consideration the parties agree as follows:
L. All agreement';;terms and conditions contained herein are predicated on title to
the entire "wedge" being quiet° .in Bernard J. Wysock.Trustee of the Bernard Janes Wysock
Trust. In the event that any port..un of the wedge is not quieted as described,this Agdeetnent shall
be null and void at the sole option of the Town.
2. Wysock egrets to execute, concommitantly with this Agreement, a Right of
Way Purchase and Sale Agreeme'n with the Town.
3. Wysock egret's to clean up any construction debris deposited o*t the eastern
portion of the lots in Wolff Gar(:ms on or before June 1, 1998. Such cleanup shall 1k completed
to the satisfaction of the Town at:1 the owners of lots who are parties to this Agreement.
4. The Town agrees that in the event Wysock annexes its property adjoining the
detention pond to the Town,the (own will allow at least two subdivided tors east of the pond and

a third lot if a survey shows that there is room for an additional lot as well as an access casement,
for maintenance vehicles to.tho d_tention pond.
5. The Town agrees to pay to M.ary D.Evezich,widow of John Evezich,Donaldd.
Joseph Evezich,Rocca Evezich i outs J.Evezich,Madelyn M.Evezich and Kathryn S.Evezich.,
the sum of 310,645.66 for the pu'tchase and installation of 300 feet of vinyl fencing,khe posts and
toprail for 300 feet of six foot Mill chain link fence and four yards of concrete for Mn'h Evezich's
clothesline. The fencing is to be tonstructed on the eastern boundary of their property.
6. The Town agF;zs to move the water meter currently located in the disputed area
adjacent to the Evezich pioperty':'when the west half of Aipen Drive is constructed.
7. All of the Eve:'ches agree to disclaim any interest in the"wedge"and to transfer
by quit claim deed any interest teat they may have to the 30 foot wide county road as described on
the plat of Wolff Gardens to to Town upon payment of the aforementioned $1044546. In
addition,all of the Eveziches a&ee not co construct either die chain link fence or vidyl fence until
the west half of Aspen Drive him/been completed by the Town_
S. Upon the Tkwn acquiring title to the "wedge". the Town agrees to sell to
Williams a portion of the"wedge" to be described on Exhibit A attached hereto and made a part
hereof at a cost of 313.500.00 T i t acre,reserving to the Town a 10-foot wide utility easement on
the west edge of the "wedge",;for underground utilities only. The exact description will be
determined by a metes and bean:As survey within thirty days of the date of this Agreement with a,
beginning point at the southerly'nost tip of the Williams'property.
9. In exchange i,sr being allowed to purchase the wedge-shaped pica of property.
the Williams agree to disclaim cny interest in that"wedge" upon the execution of this Agreement
and to quit claim any interest the y may have in the 30 foot wide county road to the Tdwn.
10. The Town ii4res to deed or vacate to the Williams a tract of land on the north

12. The Town 2 trees to survey.the cast boundary of the property in Wolff Gardens
up to the west edge of the comity road as described in the plat of Wol Gardens and to install a
new fence from the Montoya property to the north boundary of the Norman moped?,and from the
south boundary of the Norman .property to the north boundary of the Evezich property at such time
as the Town deems appropriate but in no event later than the construction of the west half of Aspen
Drive. The Town agrees that tl'a fence will be four strand twisted barbiess wire with steel posts set
8' apart except that every fourd post shall be wooden.
13. The Town agrees to install curbs and gutters from the extension of Aspen
Circle south to First Street u+ 'on construction of the west half of Aspen Drive! The property
owners will not be charged for he installation of the curb and gutter.

15. As to the ptc;ierty owned by Sharon Ann Norman,the town atkieipases that it
will have no present need to ph;;iically use or occupy the 30 feet that it is acquiring,from Sharon
Ann Norman tinder this Agrees.:tent. the Town agrees that her existing pole fend shall not be
moved from its existing tocatiof:;, except as may be necessary to accommodate the improvements
that will be done in the future te-Aspen Circle and Aspen Drive. During the comae:of the actual
construction of Aspen Cirdic ar.d Aspen Drive, the Town agrees that it will be sebsitive to-the
needs of Sharon Ann Nomran:•a access the property from the east. and 8 to mate such
accommodations as arc neceasar i to allow her to continue to use her access. The Town agrees that
it will not damage the ground,including the 30 feet which it is acquiring,which constitutes Sharon
Ann Norman's arena, and will' take such steps as are.reasonable to protect the arena from
construction equipment and debars.
16: The Town at tees that Sharon Ann Norman and Prank J.Fiori shell continue to
have access to their properties itom the east aide of their properties subject to the obtaining a
private easement for Tim L.ant; Pamela IC Williams. The Town agrees that it wig place gravel
and stone on the east side of Shi:eon Ann Norman's gate to accommodate vehicular entry and exit
through her gates to the private easement on the property owned by Tim L. and Pamela K.
Williams to the north.
17. As furtherss nsideration for executing this Agreement,the Town agrees that it
will grant to Sharon Ann Neaten a license,and by these presents,does grant a liceftse to Sharon
Ann Norman to allow her to ust;'the portion of the 30 feet that the Town is acquiring froth Sharon
Ann Norman for her horse arenrt Said license shall be revocable by tither Sharon Ann Norman or
the Town upon forty-five days t:ritten notice to the other. In the event that Sharon Ann Norman's
right to use the 30 feet on the f;ar of her property,or any.portion thereof,is revolted, the Town
agrees that it will relocate the ez,sting fence,including gates,at its expense.

Aspen Drive, that the roadway•:ad curb and gutter shall be engineered and constructed in a way

19. At such time;as the properties owned by the parties in the Evanston subdivision
are developed and annexed to i tc Town, the Town agrees to allow access to Aspeh Drive at the
developer's expense. subject to-The zoning,subdivision and building ordinances of the Town of
Frederick
20. The Town agrees to pay Georgia Mattingly, Conservator of;the Estate of
Alfred Leroy Irwin,the stun of`;1,000.00 in exchange for the execution of the disclaimer as to the
"wedge" and a quit claim deed as to the 30-foot county road as described on the iplat of Wolff

COMMENTS:
The Weld County Public Works Department has reviewed the re-subdivision for the redesign,
addition, and vacation of Lots 17 through 30, Block P from Evans Addition. The vacated lots will
be combined with Wolfe Gardens and Wolf Gardens will be redesigned.
Access: All existing and proposed lots except the most northeastern lots shall access to
Johnson Street within the Evans Addition.
REQUIREMENTS:
Access: The two northeastern most lots front Park View Estates on the east side of the re-
designed Wolfe Gardens. The applicant shall show proof of verification of access or any
additional requirements that may be necessary to obtain or upgrade an access permit from the
Town of Frederick.
Parcel 1311 30 314019 fronts Johnson Street on the west and Park View Estates on the east.
The applicant shall indicate on the plat drawing the approximate location for the proposed
residential access. If the applicant chooses to access from the east, an access
verification/permit will be required.
Utilize the existing oil, gas, and ditch roads that are necessary for your agricultural operation.
Noxious Weeds: Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious
weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds.
Utility Easement: The applicant shall indicate on the plat drawing the existing and new utility
easements or note requirements set forth from the Utility Board hearing.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on
site in such a manner that will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.

The Weld County Health Department has reviewed this proposal. The applicant requests a
