(final plat) Review of Improvements Agreement
At your request, I reviewed the Improvements Agreement According Policies Regarding Collateral for
Improvements (public road maintenance). There were two agreements submitted, private and public. I
(' recommend that we combine the public and private improvements agreement into one due to the fact that both
areas will be county-maintained.
I have reviewed the transportation of Exhibit A for public maintenance. All quantities and unit costs appear to
be adequate to complete the project.
i The applicant needs to resubmit the Improvements Agreement utilizing the public road maintenance form, sign
it, and seal together with the corporation seal, if required. The agreement needs to be resubmitted for
verification and to secure the type of collateral being posted with Lee Morrison.
Once these two items are completed, Planning Services should verify all non-transportation items associated
with the Exhibit A portion. Then it can be scheduled for the BOCC hearing for acceptance.

Weld County Public Works Department has reviewed final plan materials and has the following development referral
comments.
Comments
d The applicant shall submit to Public Works stamped, signed and dated final plat drawings and roadway/construction&grading
plan drawings for review(with the final application)and approval. Construction details must be included. This is consistent with
County Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all
parties required."
Stop signs and street name sign locations must be shown on the final roadway construction plans.
AThe applicant shall prepare a construction detail for typical lot grading with respect to drainage for the final application. Front,
rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales shall be
considered. Building envelopes must be planned to avoid storm water flows, while taking into account adjacent drainage
mitigation.
Easements shall be shown on the final plat in accordance with County standards (Sec.24-7-60) and / or Utility Board
recommendations. "Easements shall follow rear and side lot lines whenever practical and shall have a minimum total width of
twenty(20) feet apportioned equally on abutting properties. Where front line easements are required, a minimum of fifteen(15)
feet shall be allocated as a utility easement."
B/The applicant shall dedicate a contiguous 20-foot easement across Outlot A adjoining the two sides of the development for the
final plan application.
The applicant shall dimension,label,and dedicate a 55-foot right-of-way on the final plat for CR 12. CR 12 is gravel between CR
5 and CR 7.
Cy'/The Geotechnical Engineering Report by Terracon dated June 18, 2002, states that mapping by the Colorado Geological Survey
indicates bedrock, weathered bedrock, and coluvium may have high swell potential. Additionally, the site is in an area of severe
subsidence hazard. Notes to these effects must be included on the final plat as a public notice. The report states that the
subsidence hazard should be addressed prior to development. Public Works asks the applicant to address this hazard prior to any
further county hearings.
Cl i1'he Final Drainage Report by Welsch Design Consultants, Inc. dated July 29, 2002, is acceptable, but must be stamped, signed
/and dated by a professional engineer licensed in the State of Colorado. The report shall be resubmitted to Public Works with the
final plan application. The Drainage Plan drawing shall identify the Irrigation Lateral&Storm Pipes 1 and 2.
The applicant shall submit written proof of the irrigation ditch company's acceptance of the road crossings to Pubic Works with
the final plan application.

The fmal drainage report must include a copy of the FEMA map for the flood hazard review. The engineer shall reference the
specific map panel number, including date. The development site shall be located on the copy of the FEMA map.
d❑ The applicant has submitted Improvements Agreements According to Policy Regarding Collateral For Improvements (Private &
Public Road Maintenance). These agreements are currently being reviewed by Public Works and shall be approved by the BOCC
prior to recording the final plat.
9" Longs Peak Estates will increase the traffic on CR 12 approximately 30%. A proposed off-site road improvements agreement that
will share the cost of future paving, dust control, proportional to the impact of the development will be required at final plat
application.

The Weld County Health Department has reviewed this final plat application. The resolution
/ approved by the Board of County Commissioners on October 24, 2001 requires that primary and
./ secondary septic envelopes and that specific notes be placed on the plat. The final plat materials
submitted in the application have been reviewed. The septic envelopes and plat notes have beeh
omitted from the final plat.
The application was approved with the following Department recommended conditions being placed
as notes on the plat:
y Water service shall be obtained from the Left Hand Water District .
J2/ A Weld County Septic Permit is required for each proposed septic system and shall be installed
according to the Weld County Individual Sewage Disposal System Regulations. Each septic
system shall be designed for site-specific conditions, including but not limited to maximum
seasonal high groundwater, poor soils, and shallow bedrock.
Primary and secondary septic system envelopes shall be designated on each lot. Septic system
envelopes should meet the required setbacks as described in the Weld County Individual
Sewage Disposal System Regulations.
4. Language for the preservation and/or protection of the second absorption field envelope shall be
placed in the development covenants. The covenants shall state that activities such as
landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt
mounds, etc.) are expressly prohibited in the designated absorption field site.
The applicant shall obtain a storm water discharge permit from the Water Quality Control Division
of the Colorado Department of Public Health and the Environment, if required. Silt fences shall
be maintained on the down gradient portion of the site during all parts of the construction phase
of the project.
fr. During development of the site, all land disturbance shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of the
Weld County Health Department, a fugitive dust control plan must be submitted.
i. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and practical
methods which are technologically feasible and economically reasonable in order to minimize
dust emissions.
If land development creates more than a 25 acre contiguous disturbance, or exceeds 6 months
in duration,the responsible party shall prepare a fugitive dust control plan,submit an air pollution
emissions notice, and apply for a permit from the Colorado Department of Public Health and
Environment.
ft. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be
placed on any recorded plat.

Dear Ms. Hatch:
I have reviewed the submitted material pertaining to the final plat for the Longs Peak Estates
Subdivision, located south of and adjacent to Weld County Road 12, between Weld County
Roads 5 and 7 in Weld County. The Fire District approves of the plat based on the following
comments and stipulations:
• Buildings shall be designed and constructed in accordance with the provisions the Uniform
Fire Code, as ratified by the Weld County Commissioners.
• All fire hydrants, water mains and access roads must be approved before construction may
begin on any lot. Fire hydrants must be tested as soon as installation is complete so the
District is made aware of available fire flow. Fire apparatus access must be designed and
maintained to support the imposed loads of fire apparatus (60,000 pounds) and must have a
surface that provides all-weather driving capabilities.
Nothing in this review is intended to authorize or approve of any aspect of this project that does
not comply with all applicable codes and standards. We appreciate being involved in the

t✓ Building permits shall be obtained prior to the construction of any building.
2. A plan review is required for each building. Two complete sets of plans are required when
applying for each permit.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 Uniform Building Code,
1998 International Mechanical Code, 1997 International Plumbing Code, 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
Property lines shall be clearly identified and all property pins shall be staked prior to the first
inspection. Approved building and foundation plans shall be on the site and available to
inspectors for each inspection.

7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.

Reference is made to the above-mentioned project located in Section 9, Township 1 North,
Range 68 West, Weld County, Colorado.
If any work associated with this project requires the placement of dredged or fill material, and
any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the
United States at this site, this office should be notified by a proponent of the project for proper
Department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean
Water Act. Waters of the U.S. includes ephemeral, intermittent and perennial streams, their surface
connected wetlands and adjacent wetlands and certain lakes,ponds, drainage ditches and irrigation
ditches that have a nexus to interstate commerce.

RE: Recommendation to oppose the Long's Peak Estates Final Plat{NW%.and the NE ''A of Section 9,Ti N, R68W}
Dear Jacqueline:
Thank you for referring the Long's Peak Estates Final Plat to the School District. The District has reviewed the
development proposal in terms of future student impacts and available school capacity and has the following
RECOMMENDATION: the District is OPPOSED to the approval of this application due to this development's impact on
already overcrowded school facilities.
The Board of Education has established a District-wide policy of opposing new developments that add to the student
enrollment of schools projected to be at or above 125% of their capacity. This particular application, which is currently
located in the Erie Elementary, and Erie Middle/Senior High Feeder, will add 7 new single-family dwelling units with a
potential student impact of 4 additional students in this feeder. The District opposes this development because, as
indicated in the chart below, Erie Elementary and Erie Middle/Senior High Schools will exceed 125% of their capacity
with the addition of students from this development.

The School District's current opposition to this proposal may be modified should the developer come to an agreement
with the School District regarding capacity concerns. School District policy acknowledges two possible ways to
accomplish this. The first is for the developer to agree to mitigate the development's potential student impact on
capacity by agreeing to a voluntary, per unit contribution to the School District (in addition to cash-in-lieu funds noted
below). Funds collected under this policy would most likely add classroom space within the subject feeder or, in
situations where additional capacity is known to be eminent, provide portables. The second way to resolve capacity
concerns would be for the developer to commit to not constructing any residential prior to the availability of school
capacity. Should agreement be reached on either of these possibilities,this office will write a new letter to Weld County
updating this referral.The developer can contact this office directly to discuss either of these possibilities further.
The recommendation of the District noted above applies to the attendance boundaries current as of the date of this
letter. The 2002 approved school bond allows for a high school and an elementary school within the next few years.
These facilities will likely require a boundary change at the elementary level, which could affect the attendance are of
this development in the future. Capacity at the elementary and secondary levels will also likely change, however, the
impact of the new facilities on capacity projections is still uncertain and will remain undetermined until a construction
schedule is finalized. Under current attendance boundaries,transportation would most likely be provided.
Should the County decide to recommend approval of this development proposal, the School District's cash-in-lieu
and/or land dedication requirements would still need to be satisfied. This requirement involves the dedication of land
with the adjacent infrastructure or payment of an equivalent cash-in-lieu fee based on the student yield of the
development. Since this property is not a likely future school site, the fee would be assessed per the attached chart.

Dear Ms Hatch:
Thank you for sending the Master Site and Utility Plan(sheet 3 of 12 of the construction drawings) for
Longs Peak Estates, prepared by Welsch Design Consultants (December 12, 2001) and the copy of the
Geologic Hazard Overlay District Application. The building envelopes for lots 6 and 7 as shown on this
plan do not conform to those agreed upon by CGS in response to studies by Western Environment and
Ecology and Dr. John Abel. Both of these parties produced building envelopes for the lots, and John
Rinko combined their work in Figure 3 (Recommended Building Envelopes per John F. Abel &Western

Environment Reports) in a letter to CGS dated June 20,2001. However the Welsch drawing shows the
building envelopes for lots 6 and 7 as devised only by John Abel,which includes areas where multiple
seams were mined;these areas were excluded by Western Environment and Ecology. It is recommended
that the building envelopes on lots 6 and 7 be restricted to those shown on the referenced Figure 3. I will
send you a copy of this drawing in the mail.
The building envelopes should appear on the final plat to be recorded by the county. The plat notes
should state that lots 3 through 7 are located in a geohazard zone over a shallow coal mine.
Your draft comments for Longs Peak Estates look fine(there is a typo on page 7, comment B, cole to
coal.)
