It is my understanding that the restaurant now has its temporary certificate of occupancy. You have mentioned at the February 26, 2003,hearing to grant the hotel and restaurant license that upon its issuance, you would move to dismiss Case Number 02-CV-400. That case is now moot. I have not yet received any paperwork from you regarding such a motion. Please submit the motion to the Weld District Court within ten days of receiving this letter.
