HomeMy WebLinkAbout810221.tiff WELD COUNTY COMMUNITY CORRECTIONS PROJECT BY-LAWS ARTICLE I PURPOSE Section I It is the purpose of these By-Laws to delineate the authority, responsibilities and inter-relationships of the Board of County Commissioners (hereinafter referred to as the Commissioners) , the Community Corrections Board (hereinafter referred to as the Board) , and the Community Corrections Project; and to encourage a flexible, efficient and effective community corrections program in Weld County. • Section 2 The Community Corrections Project will operate under the procedures set forth in Colorado Revised Statute (1973) , Article 27 of Title 27, and any amendments or revisions thereto. ARTICLE II COUNTY COMMISSIONERS Section 1 The ultimate authority for the operation of community corrections projects lies with the Commissioners. Section 2 The Commissioners have, by resolution, established a Board and delegate such powers as are necessary to accomplish the purposes of community corrections as established by the above mentioned statute. fea.,.f /3064_..4 . t^h�. Section 3 The Commissioners, shall reserve the right to veto any action or resolution taken by the Board. Section 4 The Board will deliver to the Commissioners minutes of all scheduled or unscheduled meetings. Section 5 The Board will deliver to the Commissioners all "Motions for Actions" (See Article II, Section 3) . The Com- missioners shall approve or veto such motions. If such a motion is vetoed, they shall state the cause in writing and return the motion to the Board for further possible discussion. Section 6 The Board will advise the Commissioners of all "Resolutions" (See Article II, Section 2) . The Commissioners reserve the right to veto any such resolutions and will state cause for veto in writing. . Section 7 The Board shall deliver to the Commissioners all "Motions of Advisement" (See Article VI', Section 4) . These motions are considered a courtesy and require no action from the Commissioners. Section 8 The Board shall not have the power to over-ride a veto of the Commissioners. ARTICLE III BOARD MEMBERSHIP Section 1 Board members will be appointed by the Commissioners and shall serve two-year terms and may be reappointed. I/ 4. Section 2 Each Board member shall be entitled to one vote. Section -3 The recommended composition of the Board shall include: the Administrative Assistant to the Commissioners; a chief of police; a public defender; a district attorney; a judge; a probation officer; a parole officer; an educator; a vocational employment counselor; a county sheriff or deputy; a voc-tech counselor; two ex- offenders and six members of the community; and that such membership shall be representative of the various social and ethnic groups of Weld County. Section 4 The Board shall continue to serve until such time as the Commissioners do, by written resolution, order the Board to dissolve. ARTICLE IV OFFICERS Section 1 The officers of the Board shall be a chairman, vice- chairman, and a secretary, each of whom shall be elected by a simple majority of the voting members present. Such other officers and assistant officers, as may be deemed necessary, may be elected by a simple majority of the voting members present. Section 2 The term of office of the officers is one year. The officers shall be elected annually at the first and • anniversary meetings of the Community Corrections Board. Each officer shall hold office until his successor shall have been duly elected and qualified or until his death or until he shall resign or shall have been removed in the manner hereinafter stated, whichever occurs first. Section 3 Any officer elected or appointed by the Board may be removed by resolution of the Board whenever in their judgement the best interests of the Project would be served thereby. The cause for removal shall be included in the minutes and thereby become part of the public record. Section 4 A vacancy in any office because of death, resignation, removal, disqualification or otherwise, may be filled by resolution of the Board for the unexpired portion of the term. Section 5 The chairman shall be the principal officer of the Board and shall in general supervise and control all meetings and enforce these by-laws. The chairman shall have such other duties as may be prescribed by the Commissioners. Section 6 In the course of regular proceedings, in the absence of the chairman or a vacancy in that office, or where the chairperson has demonstrated an inability or refusal to act in the usual course, the vice-chairman shall perform the duties of the chairman. The vice- chairman shall perform such other duties as may be assigned to him by the chairman or the Board. Section 7 The secretary shall keep the minutes of the Board's ", Y - Article IV, Cont'd. meetings and shall insure that the Commissioners shall receive copies of all minutes, motions, resolutions, reports and any other information deemed necessary. The secretary shall perform other duties as may be assigned by the chairman or the Board. ARTICLE V MEETINGS Section 1 The time and place for the Board meetings shall be determined by the chairman. Meeting agendas shall be mailed to members 10 days prior to the meetings. Section 2 The Board will meet at least once each month. Section 3 A quorum shall be deemed formed when there are present one-third (1/3) of the then presently constituted voting membership. However, in no case shall less than six (6) voting members present constitute a quorum. Section 4 Robert 's Rules of_ Order, as revised, shall govern the conduct of the Board meetings , except where modified by a majority vote of the Board. Section 5 All meetings, scheduled or unscheduled, shall be public meetings unless otherwise determined by a two- thirds (2/3) majority of the present voting members. ARTICLE VI MOTIONS AND RESOLUTIONS Section 1 If a quorum is formed, a simple majority vote of those present shall be considered a favorable vote upon all • motions or resolutions considered by the Board. Section 2 A motion for a "Resolution" shall be used or made for all procedural matters of concern to the Board, or matters concerning the operating procedures of the Community Corrections Project. Section 3 A "Motion for Action" shall be used or made when matters directly related to Project modifications or budget revisions, or Project success are of major concern to the Board. Such motions shall be delivered 'to the Commissioners, as soon as possible, for their approval or veto. Sectj,on 4 A "Motion for Advisement" shall be used or made for all other matters which are of concern to the Board and upon which they have no delegated authority to act. Such motions of advisement will be delivered to the Commissioners as a courtesy. Section 5 Any voting member of the Board may cast a dissenting or assenting opinion to all motions or resolutions for further clarification or convenience for the Commissioners. Section 2 The Commissioners will accept from the Board, all motions of advisement concerning the hiring and firing of the Director. Section 3 The Director shall attend all meetings of the Board, and shall not be considered a voting member. Section 4 The Director shall deliver monthly progress and budget reports to the Board, and shall be prepared to answer questions concerning the Project 's current status. Section 5 The Board agrees that all other staff personnel shall be hired through the standard county hiring procedures. Section 6 The Board agrees that all staff personnel problems including appeals, shall be handled through the standard county grievance procedures. Section 7 The Board may request any staff person to be present at a Board meeting, and to answer all proper and relevant questions concerning the staff member's duties or progress. ARTICLE VIII DELEGATED POWERS Section 1 The Commissioners delegate to the Board the authority to oversee the efficient and effective operation of the Community Corrections Project. Section 2 All budgeted items will be subject to monthly review by the Board. Section 3 All budget revisions shall be reviewed by the Board with recommendations delivered to the Commissioners and the funding source. Section 4 The annual budget and program plan shall be approved by the Board and the Commissioners. Section 5 All revisions of the stated Project objectives, methods, and evaluation shall be subject to review by the Board, with recommendations delivered to the Commissioners. Section 6 All major Project modifications not previously mentioned are subject to review by the Board. ARTICLE X AMENDMENT OF THE BY-LAWS Section 1 These by-laws may be amended at any scheduled meeting of the Board by a majority vote consisting of ten (10) votes from the voting membership, and subject to approval by the Commissioners. Section 2 At least ten (10) days notice in writing shall be given to the voting members and the Commissioners, of any proposed amendments to these by-laws. The written notice shall also include the proposed amendments. Article ,X, Cont 'd. Section .3 Amendments to these by-laws shall take effect when they have been approved and approval is acknowledged by the signatures of the chairman, the secretary, and the chairman of the Governing Board of County Commissioners. ARTICLE XI APPROVAL OF THE BY-LAWS Section 1 These by-laws will be in effect upon approval of the Board and the Commissioners with such approval acknowledged by the dated signatures of the chairman and secretary of the Board and the chairman of the Governing Board of County Commissioners. ARTICLE IX RELATIONSHIP WITH THE 19th JUDICIAL DISTRICT Section 1 These by-laws in no way alter the ability of the Chief Judge of the Judicial District to contract with the Commissioners and/or Board as to the specific operation of the Community Corrections Project consistent with existing state law. • • rs _ a`aAbk �. `.y54M A.
