CZ-1026 RE: Addendum to referral dated December 5, 2002 Regarding the absence of an accessible route between the antique shop and the dwelling, Appendix Chapter 11, Division II, of the 1997 Uniform Building Code lists the accessibility requirements for existing buildings. Buildings are required to meet current accessibility requirements only when the building is being altered. The existing antique shop, which has no plumbing, would be required to provide plumbing and accessible restroom facilities only if the building were altered, modified, added to, or if there was a change of occupancy. The business owners use the restroom facilities in their home which is exempt from the accessibility requirements. Providing an accessible route to restroom facilities that are not required to be accessible is not reasonable. Regarding the portable storage structures on the property, Chapter 31, Section 3103, of the 1997 Uniform Building Code states that temporary buildings or structures, such as the portable storage structures on the property, "may be erected" (placed or located) "by special permit from the building official for a limited period of time. Such buildings or structures need not comply with the type of construction or fire-resistive time periods required by this code. Temporary buildings or structures shall be completely removed upon the expiration of the time limit stated in the permit" The intent of the code is to allow temporary structures on property for the time period for which the structures are needed and used. The code does not intend to regulate the construction of the structure itself. The only concern is that the structures be removed when they are no longer needed. In the Greenman's case, the use to which the temporary structures are used on this specific property is consistent with the uses allowed for a business of this type. There are no separation requirements between the portable structures or from them to other buildings. The only building code related considerations would be that the structures meet setback (offset) requirements and to obtain an FHDP if the property is in the flood plane. The Building Inspection Department would require that the Greenmans obtain a permit for the antique shop so a permanent record of that building is placed in the County records. In addition, a permit for the temporary storage structures is required in order to record the existence of the structures and to require that they be removed from the property when the are no longer used for storage. CZ-1026 The existing structures, a single family dwelling and an antique shop with a 990 square foot retail sales area, 228 square foot storage area and a 360 square foot work shop, are both wood frame one story structures. The dwelling has no building code issues. The antique shop, as it is presently operated, poses no building code concerns. Luann Penfold from Mountain View Fire Protection District inspected the antique shop and found several discrepancies. A follow up inspection confirmed that all discrepancies were taken care of. The antique shop has no restroom facilities and depends on a restroom in the dwelling for the owners and their customers use. Because of the nature of the business and the absence of employees, this arrangement is acceptable. The use of water based, water soluble, non flammable products with no sanding of wood taking place greatly reduces the hazards normally found with a business of this type. The only concern is if the antique shop should be changed or converted to a different use, the degree of hazard may increase. For this reason, any change of use would require a change of use permit and review to evaluate the potential hazards created by the change of use. Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. COMMENTS: o The drawing plat submitted is very small and difficult to read. The applicant must submit a larger drawing plat. External Roadways: ❑ The County classifies CR 1 as an arterial roadway, which requires a 140-foot right-of- way. The applicant shall dimension the right-of-way shown on the change of zone plat. The applicant shall verify the existing right-of-way, noting the inception documents on the change of zone plat. If the right-of-way cannot be verified, it will be dedicated on the final plat. CR 1 is paved. o A professional traffic impact analysis will not be required. Internal Roadways: ❑ The Greenman drawing landscaping plat shows a utilities right-of-way / driveway. All landscaping within the triangles must be less than 3% feet in height at maturity, and noted on the change of zone plat. Drainage: ❑ The applicant shall provide written confirmation from the owner verifying the ditch easement bordering the property. The easement must be shown on the change of zone plat. ❑ The County requires a drainage report for developments. Since the owner is not proposing to change the existing development, increased runoff is not anticipated or the need for detention. Therefore, the applicant is not required to submit a formal drainage report. ❑ Even though this site contains an existing building residence, the applicant must submit proof that the property does not lie within a floodplain or flood hazard. The property is developed, and is currently served by the Longs Peak Water District and an individual sewage disposal system. The applicant submitted a letter of continued water service from Longs Peak Water District with the application materials. The septic system is permitted under permit number G19939120 (a Statement of Existing) and was evaluated for adequate size and capacity on October 21, 2002. The results of that evaluation found that the system is of sufficient size and capacity to handle the flow for a three-bedroom home. However, be aware that evaluations based on Statements of Existing relies on information the property owner provides, under oath, indicating the current status of the system, as opposed to the Department inspecting the system as a part of the installation process. According to the owners there is no plumbing fixtures in the existing retail shop. None were observed at the time of inspection. Per Section 30-2-10 of the Weld County Code adequate, convenient, sanitary toilet and sewage disposal system facilities are required where people work, live or congregate.jfhe restroom in the house could be used for patrons of the retail shop provided the existing septic system is evaluated by a registered professional engineer for the additional flows"\ The applicant indicates in the application materials that there are water-based, non-flammable restoration products available for purchase, and that all furniture refinishing is performed at separate facility under contract. With the understanding that no open containers of refinishing products are stored or used on site, the Department will not require a waste handling plan to be submitted. The Department recommends approval of this application with the following conditions: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4.
