FINDINGS AND RESOLUTION RE: FINDINGS AND RESOLUTION CONCERNING THE 3.2% BEER APPLICATION OF FLORINDA MARTINEZ, D/B/A PESINA'S CAFE The application of Florinda Martinez, d/b/a Pesina's Cafe, Gill, Colorado, for a 3.2% beer application, for consumption on and off the premises, came on for hearing on the 9th day of January, 1980 at 2:00 o'clock p.m., and the Board of County Com- missioners of Weld County, Colorado, having heard the testimony and evidence adduced upon said hearing, and having considered the testimony, evidence, petitions and remonstrances filed with said Board, and having carefully weighed the same, now makes the fol- lowing findings: 1. The evidence discloses that the applicant has sus- tained the burden of proof as to the reasonable requirements of the neighborhood. 2. That no question was raised nor objection offered as to the applicant concerning the standing, character or motives of said applicant. 3. The applicant has proven a prima facie case as to the reasonable requirements of the neighborhood. RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has considered the application of Florinda Martinez, d/b/a Pesina's Cafe, Gill, Colo- rado, for a County Retail License for the sale of fermented malt beverages, containing not more than 3.2% of alcohol by weight for consumption on and off the premises, and WHEREAS, pursuant to Weld County Ordinance No. 6, Section I., A., applicant has paid the sum of $350.00 to the County of Weld for a new license, and g 6033 WHEREAS, the applicant has paid to the County of Weld the sum of $50.00, pursuant to Section 12-46-110, CRS 1973, as amended, of which sum, $42.50 has been paid over to the State of Colorado, Department of Revenue for credit to the Old Age Pension Fund, pursuant to the requirements of Section 12-46-110, CRS 1973, as amended, and said applicant has produced a State Retail License for for consumption on limits of any town the sale of 3.2% fermented malt beverages and off the premises, outside the corporate or city in the County of Weld at the location described as follows: Lots 15, 16 and 17, Block 7, Gill, Colorado NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, having examined the applica- tion and the other qualifications of the applicant, does hereby grant License Number 80-2 to said applicant to sell 3.2% fermented malt beverages for consumption on and off the premises, only at retail at said location, and does hereby authorize and direct the issuance of said license by the Chairman of the Board of County Commissioners of Weld County, Coloradp, attested to by the County Clerk and Recorder of Weld County, Colorado, which license shall be in effect from the 30th day of January, 1980 to the 29th day of January, 1981, providing that said place where the licensee is authorized to sell the 3.2% fermented malt beverages, for consumption on and off the premises, shall be conducted in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, hereto- fore passed by the Board of County Commissioners of Weld County, Colorado, and any violation thereof shall be cause for revocation of the license. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 9th day of January, A.D., 198O. Mr. Frank Martinez, a friend of Mrs. Martinez, was also present and translated some questions for Mrs. Martinez. Commissioner Dunbar stated she had made an on site/inspection of the applicants establishment and found no apparent problems. The operators seem to conduct a neat, clean and orderly business. Following discussion Commissioner Calsdn made a motion to approve the 3.2% beer license for Florinda Martinez dba Pesina's Cafe in the Town of Gill. Commissioner Dunbar seconded the motion and it carried unanimously.
