HomeMy WebLinkAbout20032951.tiff HEARING CERTIFICATION DOCKET NO. 2003-78 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1415 FOR A BUSINESS PERMITTED AS AN ACCESSORY USE IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (WOODWORKING BUSINESS) IN THE A (AGRICULTURAL) ZONE DISTRICT - GENEVIEVE CLARK A public hearing was conducted on November 26, 2003, at 10:00 a.m.,with the following present: Commissioner David E. Long, Chair Commissioner Robert D. Masden, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Michelle Katyryniuk Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated November 7,2003,and duly published November 13, 2003,in the South Weld Sun,a public hearing was conducted to consider the request of Genevieve Clark for a Site Specific Development Plan and Use by Special Review Permit#1415 for Business Permitted as an Accessory Use in the Commercial or Industrial Zone Districts (woodworking business)in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney,made this a matter of record. Michelle Katyryniuk, Department of Planning Services,stated the applicant is not present at this time. Commissioner Jerke moved to table this matter until the applicant is present. Commissioner Vaad seconded the motion, which carried unanimously. Following the other hearing the Board called this matter back to order. Ms. Katyryniuk gave a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She gave a brief description of the location of the site and surrounding land uses, and stated the property includes a residence and outbuildings. She further stated thirteen referral agencies reviewed this proposal,eight responded with comments that have been incorporated into the Conditions of Approval and Development Standards, and no comments were received from surrounding property owners. Ms. Katyryniuk stated the business consists primarily of producing storage sheds and dog houses,and she reviewed various photographs of the site. In response to Commissioner Masden, Ms. Katyryniuk stated she saw five sheds during her site inspection. She added the applicant operates out of two buildings,which are approximately 100 feet from the road, and shielded from the residence. She further stated the applicant will be required to screen the site with landscaping. Responding to Commissioner Geile, Ms. Katyryniuk stated this Use by Special Review application was submitted pursuant to a violation,and she is unsure how long the business has been in operation. 2003-2951 /� PL1688 HEARING CERTIFICATION - GENEVIEVE CLARK (USR #1415) PAGE 2 In response to Commissioner Jerke, Char Davis, Department of Public Health and Environment, stated the septic system is permitted as a residential system. She stated typically this type of operation would be required to provide a commercial system; however, staff is willing to accommodate the existing conditions since there will only be one part-time employee. She stated Condition of Approval #1.E will need to be modified accordingly. Responding to Commissioner Masden, Ms. Katyryniuk stated the applicant has a contract with a lumber sales yard to construct sheds as they are ordered. She stated the applicant will not have a sales office,and the operation is not open to the public, so this application will not generate any additional traffic. Donald Carroll, Department of Public Works, indicated the locations of Weld County Roads 3 and 48. He stated the two roads meet at a "T" intersection on the west side of the applicant's property,and there is no County right-of-way east of this intersection. He stated the average daily traffic count on Weld County Road 3 is 122 vehicles, and Road 48 averages 72 vehicles per day. He further stated the site is very clean,the parcel is approximately 500 feet wide with the structures located in the center, and is approximately 250 feet from the road. Bruce Clark represented the applicant and stated Weld County Road 48 begins again two miles east of the"T" intersection. Mr. Clark stated his business is strictly wholesale, so there will be no public coming to the site. He stated he is the only resident and his sole employee is only part-time. He further stated the septic system was found to be adequate for a two-bedroom home,so it should be sufficient for him and a part-time employee. Mr.Clark stated he does not have a sales room,the sheds are visible from the road,and the dog houses are built upon request. He stated he has been doing this for 20 years, and there are several lumber managers in the area that could verify his business. In response to Commissioner Geile, Mr. Clark stated he agrees to the various items required by the Department of Building Inspections under Condition of Approval #1.1. No public testimony was offered concerning this matter. Commissioner Jerke proposed deleting Condition of Approval#1.E,and the Board concurred. Mr.Clark stated he has reviewed and agrees with all of the Conditions of Approval and Development Standards, as modified. Commissioner Jerke moved to approve the request of Genevieve Clark for a Site Specific Development Plan and Use by Special Review Permit #1415 for Business Permitted as an Accessory Use in the Commercial or Industrial Zone Districts (woodworking business) in the A (Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting Condition of Approval#1.E. The motion was seconded by Commissioner Vaad,and it carried unanimously.
