The Weld County Public Works Department has reviewed this proposal; this project fall primarily under the purview of the Use by Special Review Standards, Weld County Code, Section 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 18 is designated on the Transportation Plan Map as collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. WCR 25 is designated on the Transportation Plan Map as local paved road,which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. WCR 18 has an average daily traffic (ADT) count of 355 vehicles taken 12/10/1996, and WCR 25 had an ADT of 200 vehicles per day taken 1/1/2000. There are two existing gravel pits in the vicinity that utilize both WCR 18 and WCR 25. REQUIREMENTS: Traffic Impact Study: All new commercial developments that have ADT count over 200 will be required to submit at traffic study as a part of the review process. The state requires that the traffic study is completed if the designated haul route is within two miles of any state highway. The study shall include: • a description of the project • vehicle trip generation and distribution • verification of adequate acceleration, deceleration, and storage facilities at all impacted intersections • review of bridge capabilities • interjection level of service • analysis for existing and proposed conditions • recommendations for the need of upgrades of transportation infrastructure to support the development. Page 2 •Improvements Agreement: The Weld County Public Works Department shall require a long-term Road Maintenance and Improvements Agreement for the designated haul route. L-Access: The applicant identified the existing access point to the new facility. The access point including the access to the scale house shall be paved a minimum 24 feet in width to accommodate two-way traffic. The access point should have an adequate sight distance in both directions. Set Backs: The set backs in a mining operation are measured from future right-of-way lines plus the standard set back in the agricultural zoned area to the edge of the gravel pit berm, which is considered a structure. US Highway 85 Access Control Plan: CDOT has jurisdiction over any access to US Highway 85; therefore, CDOT should review the traffic impact study to determine any additional needs that may be required. Intersection improvements to accommodate truck turning movements may be required at the intersections of WCR 18 and WCR 25, and WCR 18 and US Highway 85. Additional right-of-way may be required. The traffic study should determine any improvements needed to accommodate the traffic level of service. Miscellaneous: In the questionnaire, the applicant indicated that 75 acres of this site will be mined. The mining will take place in seven phases over 10 to12 years. The thickness of the mining deposit is 30 feet with 1 to 2 feet of overburden. In doing the calculations, 75 acres at approximately 28 to 30 feet in depth will generate 6,000,000 ± tons of product. Question: Is the applicant going to utilize private haulers to move the product from the site. We have received a traffic impact study prepared by Erick Bracke, P.E., Traffic Engineering and Planning. The staff reviewed and forwarded a copy to Gloria Hice-Idler, CDOT. On November 25, 2002, I received CDOT's recommendation for improvements to U.S. Highway 85 Corridor. I have forwarded a copy to be added as a part of the conditions of approval and development standards. Our staff evaluated WCR 18 and WCR 25 for pavement structural conditions. WCR 18 has an additional two-inch overlay this year and does not require additional overlay to accommodate the proposed USR at this location. WCR 25 between WCR 18 and WCR 20 was upgraded and paved in 1993. The Public Works Department recommends an additional three-inch overlay placed from the pit entrance south to WCR 18 to accommodate the additional heavy hauling associated with your USR. Having reviewed the study,these are my recommendations: • If any of the lanes impacted by this proposal are substandard(do not meet current State Highway Access Code criteria for an EX highway),they should be made standard if possible. 1. The left turn deceleration lane needs to be 1150' (300'taper+800' decel length+approximately 50' storage) 2. The right turn deceleration lane needs to be 1,100 feet(300'taper+800' decel length) 3. The right acceleration lane needs to be 1,680' (300' taper+ 1,380'accel length).. • A"free-right"condition should be considered for trucks on WCR 18 traveling westbound to southbound SH 85. • Right-of-way constraints may not make it possible to construct the lanes to standards. Waivers will need to be written documenting any deficiencies. CO p F • DATE: JULY 22, 2002 COLORADO CC: Environmental Health Services has reviewed this proposal for a mineral resource development facility (dry open pit mining for sand and gravel). We have concerns about the proposal presented. The application materials propose that portable toilets and bottled water will be utilized. We do not believe that bottled water is an "adequate" source of water for this type of operation. The facility plans to operate at this location for 10 to 12 years, thus we - believe a permanent water supply, i.e. well, community system, etc. is more appropriate to serve the sanitary needs of the staff and visitors to the facility. Additionally, the proposed sewage disposal facilities (portable toilets) do not comply with Weld County Code 30-2-10. The Weld County Code states that the owner of any structure where people live, work, or congregate shall insure that the structure contains an adequate, convenient, sanitary toilet and sewage disposal system in good working order. We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. If applicable, the applicant shall apply for an Underground Injection Control (UIC) Class V Injection Well permit, for the shop building, through the Environmental Protection Agency (EPA) or provide evidence that the applicant is not subject to the EPA Class V requirements. 2. The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Health and Environment for emissions of criteria, hazardous or odorous air pollutants. 3. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 4. Any existing septic system(s) located within the USR boundary which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s) or provide evidence that the system(s) has been properly abandoned. In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. 5. An individual sewage disposal system is required for the proposed scale house and/or repair shop and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 6. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain policy. 7. The applicant shall provide evidence that the facility has an adequate water supply. (i.e. commercial well, community water system, etc.) 8. If applicable, the applicant shall provide evidence that any vehicle washing area will be designed and constructed to capture all effluent and prevent any discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission and the Environmental Protection Agency. 9. A NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 10.In accordance with the Above Ground Storage Tank Regulations (7 CCR 1101- 14) a spillage retention berm shall be constructed around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. Alternative protective measures may be allowed provided they comply with the Above Ground Storage Tank Regulations. 11.The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. "3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. ,/5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. A. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 8. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 9Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 4.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 3 4-'(Adequate toilet facilities (port-a-potty) may be utilized on sites that are temporary location of the working face and portable processing equipment, etc. for up to six months at each location. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 13.The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals and Geology. . Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Weld County Code, the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 15.The applicant shall comply with the requirements of the Air Pollution Control Division, of the Colorado Department of Public Health and Environment. A separate building permit for each building shall be obtained prior to any construction. Portable buildings will need an electrical permit. A building permit will be required for the scale. 2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 1997 UBC, 1998 IMC, 1997 IPC, 1999 NEC and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. The sheriffs office requests that gravel trucks transporting materials out of the area on county roads assure that their loads are covered, thus reducing loose materials on the roadway and the amount of damage to vehicles. 2. The Sheriffs Office also requests that gravel trucks and other vehicles leaving the site do not bring foreign materials on to the roadways on their tires. This may be accomplished by paving a short distance prior to entering the public roadway. 3. The sheriffs office would however be willing to provide a program entitled Crime Prevention Through Environmental Design to the developer. This program reduces the likelihood of criminal activity at a specific location by "hardening" it to crime. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. NCCI Pit#1 M-2001-107 In consultation with the NRCS, we have reviewed this request for a mining permit to extract sand and gravel as well as operate a concrete batch plant.Norman Wells,District Conservationist, with NRCS made an on site visit on November 29, 2001.Based on information provided,we have the following comments regarding this application: 1. While the plan(page 15)indicates that undisturbed areas will be managed as irrigated pasture or other appropriate crop cover,there are no signs of any of the area having been irrigated previously. If this is the case,does the applicant own adjudicated water rights for irrigation purposes?If the area is to be irrigated it appears that land smoothing would be necessary and that the choice of crops will be limited due to the proximity to the water table. 2. One of the anticipated uses indicated in the reclamation plan is for irrigation water storage.The question of water rights would again be raised. Since the final ponds will be into and below the water table,pumping water out;this would allow additional ground water to enter the pond to which the owner may not be entitled 3. The reclamation plan calls for topsoil to be placed on slopes at a maximum of 4:1.The slopes should be a MINIMUM of 4:1 with flatter slopes being more desirable from an erosion standpoint. Equipment becomes very unstable when working on slopes steeper than 4:1.All foreign water should be diverted around and not allowed to run down these slopes.Topsoil should be ripped or otherwise worked into the base soil to assure a good bond and to eliminate any chances of a hardpan developing. 4. While the seeding mix looks adequate, it is doubtful if some of the species will survive or not. The seeding dates should not be earlier than November 1". Grass planted in September can often times germinate but not attain enough growth prior to the first frosting and will die.Plantings in November will generally not germinate until the following spring. 5.
