6Z RE: APPROVE PARTIAL VACATION OF SPECIAL REVIEW PERMIT #1124 TO PARK
AND STORE CONSTRUCTION EQUIPMENT IN THE A (AGRICULTURAL) ZONE
DISTRICT - HARLAN WALL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated October 9, 1996, the Board did approve Special Review
Permit #1124 to park and store construction equipment in the A (Agricultural) Zone District for
Harlan Wall, 310 South 22nd Avenue, Brighton Colorado 80601, on the following described real
estate, to-wit:
Part of the E1/2 of Section 29, Township 1 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current owners of said property,
Bruce and Bonnie Reed, c/o Kirk Gobel, The Bell 5 Land Company, 1928 9th Street, Suite A,
Greeley, Colorado 80631, to vacate that portion of said Special Review Permit#1124, described
as follows:
Part of the E1/2 of Section 29, Township 1 North,
Range 65 West of the 6th P.M., Weld County,
Colorado, beginning at the NE cor sec 29 S3267'
W1683' N12D00'E 3334' to N LN of sec N89D42'E
990' to beg (100.11A) exc UPRR res (3R1 D) and
except everything lying south of the Neres Canal %
Situs: 1831 41 CR Weld
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Review Permit#1124 be, and hereby is, partially vacated,
as described above.

SUBJECT: Partial Vacation of USR-1124
The Department of Planning Services has received the attached letter dated September 12,
2003 from Kirk Goble, Authorized Representative for Bruce and Bonnie Reed. Mr. Goble is
requesting a partial vacation of USR-1124 in accordance with Section 23-2-200.G of the Weld
County Code.
Background information:
Legal Description: Pt. E2 Section 29, Ti N, R64W of the 6th P.M., Weld County, CO.
Location: West of and adjacent to County Road 41; north of County Road 4.
USR-12o ha USR- is to park and store construction equipment.
The original boundaries of the USR were separated by a ditch right of way and sold to separate
owners. The portion of the property no longer owned by the Reeds has recently applied for a
Recorded Exemption. Vacating the USR from their lot was a condition of approval for RE-3670.

Amended USR-1124 (Wall)
Dear Planners,
Applications have been submitted to the Department of Planning Services for
Recorded Exemption and Subdivision Exemption as captioned above. The
property has been split at the Burlington Extension Ditch and the portion lying
south of the Burlington Extension Ditch has been sold from Wall to Reed subject
to the existence of USR-1124. USR-1124 originally encompassed the entire Wall
property by legal description, though the area of activity was and is limited only
to the area lying south of the Neres Canal.
As a requirement of RE-3571 and SE-981 (Wall) and in anticipation of the same
requirement for RE-3670 (Reed), this letter constitutes a request for amendment
of USR-1124 to more accurately reflect the current uses and affected area of
activity. Accompanying this letter is a mylar plat setting forth said amendment.
The applicants, by their authorized representative, hereby request the
amendment of USR-1124 as shown on the plat of AM USR-1124.

RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT#1124 FOR TO PARK AND STORE CONSTRUCTION EQUIPMENT IN
THE A(AGRICULTURAL)ZONE DISTRICT-HARLAN WALL
WHEREAS,the Board of County Commissioners of Weld County,Colorado,pursuant to
Colorado statute and the Weld County Home Rule Charter,is vested with the authority of
administering the affairs of Weld County,Colorado,and
WHEREAS,the Board of County Commissioners held a public hearing on the 9th day of
October, 1996,at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of Harlan Wall, 310 South 22nd Avenue, Brighton,Colorado 80601,for
a Site Specific Development Plan and Special Review Permit#1124 to park and store
construction equipment in the A(Agricultural)Zone District on the following described real
estate,to-wit:
Part of the E1/2 of Section 29,Township 1 North,
Range 65 West of the 6th P.M.,Weld County,Colorado
WHEREAS,Harlan Wall,applicant,was present at said hearing,and
WHEREAS,Section 24.4.2 of the Weld County Zoning Ordinance provides standards
for review of said Special Review Permit,and
WHEREAS,the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed,finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as
follows:
A. Section 24.3.1.1 —This proposal is consistent with the Weld County
Comprehensive Plan,as amended. The 100-acre site is currently being
used for agricultural production with the exception of the south 1.5 acres
separated off from the site by the Neres Ditch. This 1.5-acre portion is
the area in which the Special Review activity is currently being
performed. The 1.5 acres are not an agriculturally productive portion of
the site due to its separation from the remainder of the property by the
ditch. By containing the Special Review activity to the 1.5 acres,the
proposal attempts to preserve the remainder of the site(98 acres)for
agricultural purposes which foster the economic health and continuance
of agricultural and is consistent with A.Goal 1 of the Weld County
Comprehensive Plan.
