RE: APPROVAL OF REPLAT ON LOTS 3 AND 4 OF FAGERBERG SUBDIVISION
DUANE. AND DOROTHY ZABKA
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 19th day of May, 1982, a public meeting was
held before the Board of County Commissioners upon the applica-
tion of Duane and Dorothy Zabka for a replat of Lots 3 and 4 of
Fagerberg Subdivision located in the NE4, Section 29, T6N, R65W
of the 6th P.M. , Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard the testi-
mony and statements of those present and has studied the request
and the recommendations of the Weld County Planning Commission,
and having been fully informed, is satisfied that the proposed
replat is in compliance with Section 6-4 A. (1) of the Weld County
Subdivision Regulations. This determination is based on the
following:
A. The parcels being replatted are in com-
pliance with all applicable regulations;
B. Drainage easements or rights-of-way
reserved for drainage have not been
changed;
C. Street locations and street rights-of-
way have not been changed;
D. The plat has not been altered in any
way which would adversely affect the
character of the original subdivision
plat.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the replat of Lots 3
and 4 of Fagerberg Subdivision located in the NEa Section 29,
T6N, R65W of the 6th P.M. , Weld County, Colorado be, and hereby
is, approved.

Gentlemen: Re : Replat of Lots 3 and 4
Fagerberg Subdivision
Enclosed herewith is copy of the deed by which
Dorothy and Duane D. Zabka acquired title to Lot 4
Fagerberg Subdivision, and copy of deed by which Hoshiko
Farms , Inc. acquired title to Lot 3, Fagerberg Subdivi-
sion. Also enclosed herewith is my Affidavit of
Interest Owners Surface Estate.
The reason for the re-subdivision of the two lots
is that the Zabkas built a brick fence on what they
understood was the north boundary line of their property.
After the fence (which is a very expensive fence) was
completed Hoshiko Farms , Inc. had their property surveyed
and found that the Zabka fence encroached upon Lot 3 by
about 1.25 feet. The parties have settled their dispute
by agreement which provides that Hoshiko Farms , Inc. ,
owner of Lot 3, shall convey to Duane D. and Dorothy
Zabka the 1. 25 feet necessary to place the Zabka fence
within the boundaries of their property, which is Lot 4
of Fagerberg Subdivision and will be Lot 2 of the Replat.
Hoshiko Farms , Inc. will be the owner of Lot 1 of the Replat.
