The Department of Planning Services staff is requesting that the Board review the individual cases and determine whether or not to authorize legal action to remedy the violations. Weld County Zoning Violation Cases: VI-0300090, Mr. Ross Early Chapter 23, Article 111(3), Division 2 of Sections 23-3-150, 23-3-150.6 and 23-3-150.C of the Weld County Code. The Noncommercial Junkyard consisting of derelict vehicles, metal/iron, trash, automobile parts, wood and miscellaneous debris shall be restored or removed from the property. VI-0300137, Ms. Rosalie Kline Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30 and 23-3-30.1 of the Weld County Code. The Noncommercial Junkyard shall be restored, removed or completely screened from all adjacent properties and all public rights-of-ways. VI-0300128, Mr. Earl Bergland Chapter 23, Article 111(3), Division 2 of Sections 23-3-110, 23-3-110.8, 23-3-110.C, 23-3-110.D, 23-3-160 and 23-3-160.H of the Weld County Code. The number of horses shall be reduced to two (2)as allowed as a Use by Right in the R-1 Zone District or a Change of Zone application can be completed and submitted to the Department of Planning Services. VI-0200618, Mr. Erich Helm and Mr. & Mrs. James Barclay Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30 and 23-3-30.1 of the Weld County Code. The Noncommercial Junkyard shall be removed, restored or completely screened from all adjacent properties and public rights-of-ways. Additionally, the derelict mobile home (ZPMH-1670) shall be repaired from its derelict condition or removed from the property. VI-0200517, Mr. James Stepanek Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30, 23-3-30.D, 23-3-40, 23-3-40.O and 23-3-40.R of the Weld County Code. Should the Board of County Commissioners determine that this use meets the intent of the "Home Occupation" definition, then a"Home Occupation" application shall be completed and submitted to the Department of Planning Services. Should the Board of County Commissioners determine that the use does not meet the intent of the"Home Occupation" definition, then the business shall be removed or a Use by Special Review application shall be completed and submitted the Department of Planning Services. VI-0200449, Mr. & Mrs. Peter Downs and Mr. Tony Rosario Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30, 23-3-30.1, 23-3-40, 23-3-40.O and 23-3-40.R of the Weld County Code. All business activities and equipment shall be removed from the property or a completed Use by Special Review application shall be submitted to the Department of Planning Services. Service,Teamwork,Integrity,Quality Violation Hearing Memorandum(October 14, 2003) Weld County Combined Zoning and Building Violation Cases: VI-0300098, Ms. Dorothy D Elia Chapter 23, Article 111(3), Division 2 of Sections 23-3-110, 23-3-110.B, 23-3-110.6.1, 23-3-110.C and 23-3-110.D and Chapter 29, Article 111(3) of Sections 29-3-10 and 29-3-320 of the Weld County Code. The Noncommercial Junkyard shall be removed. Additionally, it was brought to our attention that Ms. D Elia and other individuals are residing in the garage. This is not an allowed use per the R-1 (Residential)Zone District. The garage shall be returned to its original use or a PUD (Planned Unit Development) application shall be completed and submitted to the Department of Planning Services. VI-0300166, Mr. & Mrs. Scott Hopp Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30, and 23-3-30.F and Article IV(4), Division 3 of Section 23-4-160 and Chapter 29, Article Vll(7)of Section 29-7-10 of the Weld County Code. The mobile home shall be removed or a Zoning Permit for a Mobile Home (ZPMH)shall be completed and submitted to the Department of Planning Services for the"Temporary Storage of a Mobile Home". VI-0300177, Mr. Robert Pennington Chapter 23,Article 111(3), Division 1 of Sections 23-3-20, 23-3-30, 23-3-40 and 23-3-40.R of the Weld County Code. The"temporary' structures shall be removed from the property or a Use by Special Review application shall be completed and submitted to the Department of Planning Services. VI-0300101, Mr. & Mrs. Selustriano Salazar Chapter 23, Article 111(3), Division 2 of Sections 23-3-110, 23-3-110.B, 23-3-110.C, 23-3-110.D, 23-3-160 and 23-3-160.H of the Weld County Code. The number of animal units shall be reduced to fall within the guidelines established per the R-1 Zone District or a"Nonconforming Use"application shall be completed and submitted to the Department of Planning Services. Additionally, the"Ag Exempt" structures shall be removed, building permits obtained or "Nonconforming Structures" application(s) shall be completed and submitted to the Department of Planning Services.
