RE: ACCEPTANCE OF TEMPORARY CONSTRUCTION EASEMENT FOR WELD COUNTY
ROAD 3.25 AND AUTHORIZE CHAIR TO SIGN -U.S. DEPARTMENT OF COMMERCE,
NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Temporary Construction Easement for
Weld County Road 3.25 between the County of Weld,State of Colorado,by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Public Works,and the
U. S. Department of Commerce, National Oceanic and Atmospheric Administration,commencing
upon full execution,and ending upon completion of construction,with further terms and conditions
being as stated in said easement, and
WHEREAS,after review, the Board deems it advisable to approve said easement, a copy
of which is attached hereto and incorporated herein by reference.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Temporary Construction Easement for Weld County Road 3.25 between
the County of Weld,State of Colorado,by and through the Board of County Commissioners of Weld
County, on behalf of the Department of Public Works, and the U. S. Department of Commerce,
National Oceanic and Atmospheric Administration be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said easement.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 10th day of December, A.D., 2003.

TEMPORARY CONSTRUCTION EASEMENT
THIS AGREEMENT,made this day of , between the OWNER, the United States
of America, hereinafter referred to as the Government, and the County of Weld, a body corporate and
politic of the State of Colorado,by and through its Board of County Commissioners,whose address is
915 10h Street, Greeley, Colorado 80631, do hereby covenant and agree as follows:
WHEREAS, the Government is the owner in fee simple of a parcel of land situated in Weld County,
Colorado, as viewed on drawing marked"Exhibit Map A", attached hereto and made a part hereof,
which legal description is as follows:
A parcel of land located in the Northwest One-Quarter of Section 32,Township 2 North,Range
68 West of the Sixth Principal Meridian, County of Weld, State of Colorado and more fully
described as follows:
Commencing at the Northeast corner of the West One-Half of the Northwest One-Quarter of said
Section 32, from whence the Northeast corner of the West One-half of the Southwest One-
Quarter of said Section 32 bears S00 degrees 09' 37"E with all bearings contained herein relative
thereto;thence N89 degrees 56'10" W along the North line of the Northwest One-Quarter of said
Section 32 a distance of 55.00 feet to the POINT OF BEGINNING; thence continuing N89
degrees 56'10"W along said North line a distance of 65.00 feet; thence S00 degrees 09'37"E a
distance of 50.00 feet; thence S89 degrees 56'10"E a distance of 65.00 feet; thence N00 degrees
09'37"W a distance of 50.00 feet to the POINT OF BEGINNING and containing 0.075 acres,
more or less.
The above legal description was prepared by Leon Sievers, Right of Way Agent, in and for Weld
County, Colorado and is based on survey information provided by Powers Elevation Surveying
Company, Inc.,PO Box 707, Frederick, Colorado 80530.
WHEREAS, the County will reconstruct Weld County road number 3.25,which reconstruction
necessitates, and Government has granted a right-of-way and easement in perpetuity as described in
Easement No.
WHEREAS, as a result of this conveyance, the County will re-shape the Government driveway equal to
approximately 50', with a 50'turn radius; will replace the existing culvert with an 18" culvert; will
extend the culvert to accommodate the new driveway width, and will raise and grade the driveway to
meet the new roadway described above and as drawn in Exhibit"A",pages 1 and 2, at no cost to the
Government.
AT NO TIME DURING CONSTRUCTION shall the County unduly interfere with any of the
Government's activities at this site. The County will notify the Government of any periods that it is
anticipated the driveway will not be usable, and will work with the Government to accommodate this
schedule.

WHEREAS,the duration of this Temporary Construction Easement shall be from the commencement of
construction of the driveway for a period of approximately sixty (60) days. The County will notify the
Government in writing upon completion of the construction of the driveway, at which time this
Temporary Construction Easement shall terminate.
All work done at this site will be done in a good, workmanlike manner and meet all County and State
requirements.
WHEREAS, areas disturbed by the construction of the driveway, or other work at the site, including
areas not included as part of this easement, shall be promptly restored to their original condition by the
County upon completion of such work.
The Government warrants that it is the owner of the parcel of land cited in the legal description.
To the extent authorized by law, County shall indemnify and save the Government harmless from any
liability or responsibility arising from the County's negligence in conducting the work contemplated
herein.
