The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

or Industrial Zone Districts, (Vehicle Service Repair) in the A (Agricultural) Zone District.
USR-1433
Building permit BC-9800754 was issued for the construction of the residence and attached
garage. Building permit BC-9901157 was issued for the construction of the 1440 square foot
pole frame building to be used as a shop and for storage, without electric. All required
inspections were conducted and approved for both permits.
1. A building permit will be required for the conversion of the garage that is attached to the
dwelling into a kennel. The Building Code requires that the dwelling is separated from the
kennel by a wall that is constructed as a one-hour fire resistive occupancy separation wall.
2. A separate building permit will be required for the interior remodel/finish of the shop and
storage building into a repair garage. The Building Code considers the repair garage to be an
H-4 (Hazardous Type 4) building if the repair work is more than just the exchange of parts or
maintenance, or if there is a need for open flame or any welding. If the repair work is limited to
the exchange of parts or maintenance with no open flame or welding, the building is considered
a S-3 (Storage Type 3) repair garage.
3. A separate building permit will be required for the kennel that was added to the property. If
any portion of this building adjoins the residence, that portion of the adjoining buildings will need
to be separated by an occupancy separation wall as described in paragraph number 1.
4. A plan review is required for each building. Two complete sets of plans are required when
applying for the permit.
5. Buildings shall conform to the requirements of the 1997 Uniform Building Code, 1998
International Mechanical Code, 1997 International Plumbing Code, 2002 National Electrical
Code and Chapter 29 of the Weld County Code.

6. The foundation for the kennel that is described in paragraph number 3 needs to be
evaluated to determine if it is adequate for the intended purpose. A site inspection by an
inspector from this Department or a report from a Colorado registered engineer is acceptable.
If the inspection is done by an inspector from this Department, a portion of the foundation to the
bottom of the foundation will need to be uncovered prior to the inspection.
7. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by Chapter 23 of the Weld
County Code.

This is a follow up to our conversation in my office on September 29, 2003. A plan review can only be
completed after the Building Department receives blueprints. The blueprints may consist of floor plans
for each building requiring a building permit. To assist you, the following items are generally required for
buildings used a repair garage or kennel. More precise requirements will be given after an evaluation of
the buildings at the site.
Repair garage:

4. Employee bathroom

Kennel:

5. Occupancy separation between the house and the garage.
One bathroom may be used for employees.
The above are building code requirements. These are in addition to any other requirements included in
USR 1433.
The above requirements are based only on the information in USR 1433. There may be other items that will
need to be addressed when we receive the building permit applications and blueprints. To assist you, an
on site inspection by The Building Department maybe conducted.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 54 1/4 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code
Ordinance, Section 20-1-30, as a collector status road, which requires 80 feet of right-of-way at full build out.
There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition
of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is
measured from the future right-of-way line.
Traffic Count: We do not have any current counts at this location presently. This road is classified as a
collector status road and is paved with adequate shoulders to accommodate traffic exceeding 200 vehicles per
day.
REQUIREMENTS:
Future Right-of-Way: The applicant should reserve an additional ten feet of property parallel to WCR 541/4
right-of-way for future build out.
Access: The applicant shall utilize the existing access drive to WCR 54 '/4.
Off-street Parking: The off-street parking spaces including the access drive shall be surfaces with gravel,
asphalt, concrete or equivalent, and shall be graded to prevent drainage problems
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that will reasonably preserve natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding
of storm run-off.
I'm referring some of the storm water drainage issues to the Department of Health and Environment as it deals
with animal units and a vehicle service repair garage.

Upon review of my computer and files, a Zoning Violation (VI-0200172) was noted. The violation was
originally for a kennel and an auto repair shop without a Use by Special Review"USR"as required per the
Weld County Code.
Please be advised that this violation was presented to the Board of County Commissioners through the
Violation Hearing process on March 11, 2003. At that time,the Board of County Commissioners referred this
case to the County Attorney's office for legal action, but delayed action for 90 days. While this case is
currently at the County Attorney's Office,we have not proceeded to the point of filing a case in District Court.
If this"USR"is approved,and once the plat is recorded,the violation (VI-0200172)will be closed. If the"USR"
is denied,a time frame will be established to allow the property owner adequate time to bring the property into
compliance.

The Kersey Planning and Zoning Commission met on August 5, 2003 to consider the
referral on the above named case. The Planning Commission instructed me to forward
the following comments to you.
• The referral Application is written so vague and all encompassing that if approved
as written we really don't understand what we would have approved.
• If the County Planning Commission should work toward granting a Use By
Special Review and/or a Use Permitted as a Use by Right and/or an Accessory
Use, the Kersey Planning and Zoning Commission would strongly urge the Weld
County Department of Planning Services to carefully consider the following
items:
o the written letters and phone calls from neighbors surrounding the
property;
o clearly define what is permitted by any Use by Special Review, Accessory
Use or ag-zoned uses by right the county may grant detailing maximum
numbers of animals allowed in total and by species, as well as maximum
number of vehicles that can be stored on the premises at any one time; and
o enforce all building regulations of the county, including required
permitting.

SUBJECT: Use by Special Review 1433, for a Kennel
Leslie Windyka, applicant
The Department of Planning Services has reviewed this application and has the following
comments:
The applicant is proposing to kennel 20 dogs of the Beagle breed. Additional information shall
be provided stating their typical daily requirements, including approximate square footage of
dog runs, housing (bedding) and dietary requirements.
The applicant is also proposing a vehicle service and repair facility that will include a junkyard.
The junkyard will consist of automobiles that are utilized for parts. The three door garage
located to the north will be utilized for this use.
The applicant's USR Map delineates limited fencing on site, however, the site visit performed by
staff did visually acknowledge that additional fencing has been erected. Staff acknowledges
that it is the intention of the applicant to add additional fencing as required. Depending on
traffic and complaints from surrounding property owners, the Department of Planning Services
will agree to permitting the existing conditions to remain until such time that there are
substantiated complaints from surrounding property owners.
Given that this is a private facility with little public contact, staff will waive the parking
requirement. Staff will not require the site to meet ADA standards.
The application does not provide information concerning the date of construction for all on-site
structures. As there is a change in use, the Department of Building Inspection shall be
contacted to verify how the structure was permitted and if there are any building related issues
that should be addressed.
The application states that domestic water is obtained from Central Weld County Water District.
As this is technically a commercial endeavor, verification of a commercial tap should be
obtained from the water district.
The application states that there is a leach field on site. Wastes ae disposed of through a
refuse hauler.
Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public
rights-of-way and all adjacent properties. These areas shall be designed and used in a manner
that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing
whether the trash collection area is screened from the public rights-of-way and adjacent
properties. Written and /or graphic evidence shall be submitted to the Department of Planning
Services for review and approval.
Section 23-3-250.A.9 addresses "Outside storage. Uses involving outdoor storage of vehicles,
equipment or materials when permitted shall be screened from public rights-of-way and all
adjacent properties." It is unclear from the applicant's drawing whether there is an area for
outdoor storage. Written and /or graphic evidence shall be submitted to the Department of
Planning Services for review and approval.
Section 23-3-250.6 addresses Operation Standards. Section 23-3-250.B.6 addresses the
issues of Light. "Any lighting, including light from high temperature processes such as welding
or combustion, shall be designed, located and operated in such as manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties; neither the direct nor reflected light from any light
source may create a traffic hazard to operators of motor vehicles on public or private streets;
and no colored lights may be used which may be confused with or construed as traffic control
devices." It is unclear from the applicant's drawing whether there is an any exterior lighting.
The applicant shall provided written and /or graphic evidence to the Department of Planning
Services for review and approval. A Lighting Plan may be required, if applicable.
Section 23-3-250.6.7 states "Property shall be maintained in such a manner that grasses and
weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property
owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1)
The existing on-site landscape treatment is adequate for this facility.

Environmental Health Services has reviewed this proposal for a kennel, junkyard and
vehicle service/repair. We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The septic system serving the residence shall be reviewed by a Colorado
Registered Professional Engineer. The review shall consist of observation of the
system and a technical review describing the systems ability to handle the
proposed hydraulic load. The review shall be submitted to the Environmental
Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
2. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).

2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Weld County Code, the
Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
5. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
6. The applicant shall operate in accordance with the approved "waste handling
plan".
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.

9. The facility shall utilize the existing public water supply.
10.Adequate handwashing and toilet facilities shall be provided for invited guests of
the facility.
11.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.

I will be doing Tuesday's hearings.
Unfortunately, the septic system for USR-1433 was permitted as a residential system only considering
domestic-type flows. It did not consider extra flows that result from the operation of a kennel, ie. washing
and cleaning of animals and pens, additional laundry, etc. An engineer must evaluate the flows into the
system (possibly from CWCWD records)and make a determination if the existing system is large enough
to handle the routine flows from the operation.

I was wondering who will be attending the hearings on Sept. 2 so I can email them the comments for
USR-1429 and USR-1433.
Also, one of the comments Char had made in her referral for USR-1433, states that the septic system
serving the residence shall be reviewed by a Colorado Registered Professional Engineer... The applicant
has asked me to investigate why they are being asked this request when they have included in their
application a statement for an existing septic system and a map of its location?
