Weld County, Colorado. Existing zoning rawsswxentryprohibit commercial use of the propeaty:ffirapafet. ar any other, indtrsttiai/rnanufacturing type commercial operation. The applicant exhibits a total disregard for existing laws and has been illegally conducting a business with employees and automated manufacturing equipment. This commercial manufacturing business has been operational for at least 7 months. The County has been notified on several occasions without satisfactory result. If the county issues a permit, we question; to what extent will the occupant develop the business without further consideration for regulations, laws, or authority. Moreover what disregard of consideration for neighbors will they descend to next? The operation of this type business is unsafe, offensive and objectionable to resident neighbors. Esthetically, the operations detract from the rural "agricultural/residential" essence of the area. (Pictures included) This is not a neighborhood that portrays a commercial or industrial appearance. In fact, when we bought our property, we checked to be sure we were purchasing not only our perfect home site but also an environment conducive to quiet country living. We found the applicant's property was zoned agricultural/residential with only an unused permit to store liquids, such as fertilizers, in storage tanks. As far as we can determine, to date, the zoning has not changed.The owners of the property, at the time, were retired and lived quietly according to the zoning laws and ordinances in effect. The new owners commenced a commercial industrial/manufacturing operation. From early morning until late at night, the noise of the pneumatic manufacturing equipment and the general activity of the employees does not cease. On several occasions activities have gone on until after midnight. Semi-trailer trucks, air compressors, forklifts, flatbed trucks, skid loaders and all manners of cars and pickups and employees are operating in and out of the property continuously. At one time we counted 18 workers involved in the operation. Deliveries of raw materials and shipping of finished product occurs without regard for time or day, including Sundays. This illegal activity is less than 30 yards from our front door! HI EXHIBIT 2003-1590 Y Disposal of waste material by fire is the rule. Scrap lumber and manufacturing debris is simply set on fire. On several occasions, the manufacturing equipment is left unattended. The circular saws, the automatic nailers and other items used in the process are not secured and therefore are an attractive nuisance. On one occasion we called the LaSalle Fire Department to control an unattended air compressor that caught fire and could have set fire to the mountains of scrap lumber, raw material, debris and pallets nearby. Had we not been home to observe, it is possible their manufacturing building, their home and barns (and ours)would not exist today. The fire hazard is only one of the potential dangers of having an industrial operation in the neighborhood. We live in a flood plane. The water table is only 24 inches below the surface. The underground aquifer is like a sponge saturated to within 2 feet of the surface. Our drinking water comes from our well, which is only130 feet from the property line. There are no sanitary facilities visible for the employees. A new septic system has not been installed to accommodate the commercial operation and employees. Whatever contaminates the industrial processes seep into the ground water go directly into our well. Our back yard, our picnic table, is less than 15 steps from a pile of pallets towering 8 to 12 feet high. Lumber storage, debris and pallet storage is within 6 inches of our property line. Using our yard for entertaining our friends is out of the question. Our 2-'/2 year old daughter is not allowed to play outside. Even the existing noise ordinance is regularly violated. This is all happening without a permit: It is illegal. What will it be like if a permit is granted? To summarize, we request no zoning change. We request no permit to allow industrial or commercial operations be granted or special use. We request that the County takes its responsibility for monitoring compliance seriously.
