The Weld County Public Works Department has reviewed this proposal; this project falls
primarily under the Use by Special Review Standards, Weld County Code 23, Article II, Division
IV, Section 23. Our comments and requirements are as follows:
COMMENTS:
WCR 59 is designated on the Transportation Plan Map as a collector status
road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-
of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured
from the future right-of-way line.
The average daily traffic count for WCR 59 between WCR 12 and WCR 14 reflect 1,391
vehicles taken 10/9/1997.
Access: The access point for this parcel was worked during the recorded exemption
application. There is adequate access in both directions. The applicant has placed a drainage
culvert to accommodate roadside drainage.
REQUIREMENTS:
Circulation and Parking: There appears to be adequate circulation and parking at the facility
to accommodate to proposed use. The off-street parking spaces including the access drive
shall be surfaced with gravel, asphalt, concrete, or the equivalent and shall be graded to prevent
drainage problems.
Access/Sight Distance: The applicant indicted that trees will be placed along the west and
south property lines to screen the area. These trees shall be placed behind the future right-of-
line on WCR 59. The trees shall be placed in such a location as not to create a sight distance
problem prior to entering WCR 59 from the property.
Storm Water Drainage: The five-acre parcel appears to drain to the center and disburse to the
east to the adjacent property. The applicant shall contain any storm water run-off from the site
and release at a historical flow. This may be accomplished by using a small retention area, hay
bails, or silt fencing. Seeding of the site with native grasses would mitigate run-off coming from
the site.

Environmental Health Services has reviewed this proposal for parking of vehicles and
trailers. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
8. A permanent, adequate water supply shall be provided for drinking and sanitary
�. purposes.
9. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Weld County Code, the
Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.

USR-1398
1. If any repairs will be made to the semi-tractor and/or trailer within any building on site, that
building will need a building permit. A plan review is required for that building. Two complete
sets of floor plans and plot plans are required when applying for the permit.
2. The building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
3. The building shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Codes currently adopted include the 1997 Uniform Building Code,
1998 International Mechanical Code, 1997 International Plumbing Code, 1999 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by Chapter 23 of the Weld
County Code.
5. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for the intended use and the
type of construction, and to determine compliance with the bulk requirements of Chapter 27 of
the Weld County Code. Building height shall be measured in accordance with Chapter 23 of
the Weld County Code in order to determine compliance with offset and setback requirements.
Offsets and setbacks are measured from the farthest projection from the building.
6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
Section 23-3-250.A.4 and Section 23-3-250.A.5 of the Weld County Code addresses the
required yards and required landscape areas. Section 23-3-250.A.5.a states "No more than
eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall not be deemed
covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by
decorative gravel or wood chips, or if it is otherwise suitably landscaped."
Section 23-3-250.A.5.a states "That portion of a Lot which abuts a public or private street right-
of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the
Lot line towards the interior of the Lot. Driveways may pass through the required landscaped
areas."
There is not a plant material list delineates a diversity of plant material. Substitutions in plant
material species shall be approved by this office prior to installation. Further, the applicant has
not called out a selection of ground cover including sod on the drawings, Future submittals shall
address the type of plant material proposed for the ground plane, including all shrubs and tree
species.
Landscaping materials as indicated in the Approved Landscape Plan shall be maintained at all
times. Dead or diseased plant materials shall be replaced with materials of similar quantity and
quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that a commercial well permit has been obtained prior to recording the USR plat.
The parking area shall delineate seven spaces, including one for the tractor-trailer combination,
for a total of eight designated parking spaces. The applicant shall delineate curb stops for the
parking spaces shown on the USR plat. One curbs stop for each space is the standard.
Per Section 23-3-350.B, the applicant shall delineated sufficient screened off street paved
parking areas. Further, one off-street loading space is required for a facility of this size. All
parking and loading areas shall be screened from adjacent properties and road rights-of-way.
The applicant shall delineate an opaque visual screen on all sides of the property to mitigate the
potential negative impact and aesthetic concerns on surrounding properties.
Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Appropriate language shall be included on the plat delineating the
access to this parcel.
The internal circulation within the service yard is unclear. Future drawings shall delineate the
proposed circulation pattern and outdoor storage areas.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash.
Section 23-3-260 addresses operation standards for Commercial uses. The applicant shall
address the issue of on-site lighting, including security lighting in applicable. Subsection B.6
states "any lighting ... shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties...."
The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall
adhere to Section 23-4-90.A and .B of the Weld County Code. One identification sign per
principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet
in area per face. Further, the location of the sign, if applicable shall be delineated on the
Landscape / Site Plat. All structures, including signs, on site must obtain the appropriate
building permits.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.

In consultation with the Natural Resources Conservation Service(NRCS), we have reviewed the above
referenced case and have the following comments.
SOILS/LIMITATIONS: The Colby loam found on this parcel has slight limitations for shallow
excavations,septic tank absorption fields. dwellings with or without basements and small commercial
buildings. Windbreaks and landscape plantings are generally suited to this soil.
PRIME FARMLANDS: No Prime Farmlands will be taken out of production.
SOIL EROSION POTENTIAL: Surface runoff is medium and the erosion hazard is moderate.
OTHER: If future land use will include grass establishment and grazing, we would recommend that the
new landowner contact the local NRCS office for guidelines on establishing and maintaining the grass and
grazing management. Additionally,the future landscape plan should address the reduction of water use
with the use of Xeriscape. We also recommend that Ron Broda,Weld County Vegetation Management
Specialist be contacted to assist the landowner in developing a weed management plan. Ron can be
contacted at 970-356-4000 x3770.

The sheriffs office has no concerns with this Special Use Permit. The sheriffs office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County

Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Comments of Henrylyn Irrigation District concerning the Special Use Permit.
Henrylyn will not object to the special use as long as there are no hazardous
materials stored or parked on said property. All runoff(drainage) is prohibited
from getting into the Loline Ditch. Such runoff could contain gas, oil, leakage
from tank trailers, antifreeze, etc. If such runoff is not contained and allowed into
the Loline Ditch, serious harm could be anticipated to the water users and
landowners located along the Loline Ditch.
