NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, acting as the Board of Equalization, that the evidence presented at the hearing supported, in part, the value placed upon the property by the petitioner. Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's (CBOE's) decision to the Board of Assessment Appeals (BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) Binding Arbitration: You have the right to submit your case to arbitration. If you choose this option the arbitrator's decision is final and your right to appeal your current valuation ends. (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. 2003-2119 AS0055 RE: BOE -WINNETT CAROLYN TRUSTEE Page 3 Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing may be confidential and closed to the public, upon mutual agreement. The arbitrator's written decision must be delivered to both parties personally or by registered mail within ten (10) days of the hearing. Such decision is final and not subject to review. Fees and Expenses: The arbitrator's fees and expenses are agreed upon by you and the CBOE. In the case of residential real property, such fees and expenses cannot exceed $150.00 per case. The arbitrator's fees and expenses, not including counsel fees, are to be paid as provided in the decision. Box 758 Greeley CO 80632 RE: Parcel #095922043004 Account #R0591601 This letter will serve as an appeal of the actual assessed value of$137,977 as of June 30, 2002, assigned to my property on the May, 2003 Notice of Valuation. I request that the value be adjusted to $127,255 based on market sale information I've obtained for 18 months prior to June 30, 2002, and is enclosed with this appeal, consisting of like properties in this condominium complex for comparison and analysis. The 17 attached actual sales represent the following information to justify this adjustment request in value: I. All units are the same in these aspects: being first floor, 2-bedroom, 1 % baths, exact same floor plan, and all in the Pinnacles Condominium Complex. 2. All sales are from January 10, 2001 to May 24, 2002. 3. Closing sales prices range from $120,598 (1/19/01) to $134,000(5/24/02) 4. There were only 3 final sales above $130,000 as follows: A. $131,000 on 10/01/01 B. $133,000 on 4/03/02 C. $134,000 on 05/24/02 5. These 3 sales represent only 18% of all the sales in the 18-month period. 6. The majority of the sales(9 of the 17) ranged from $120,598 to $124,802. 7. 14 of the 17 sales(82%) were below $130,000. 8. Five of the sales occurred in MY building of 1900 ranging from $126,140 to $129,833 with the average of the 5 final sales being $128,200. 9. The median amount of all 17 final sales is only $126,309. 10. The VARIANCE between these units lies: with their location in the complex, outside side wall access for required satellite dish placement, and access to sunlight. 11. My unit has NO SIDE WALL access for satellite dish placement. I receive NO DIRECT SUNLIGHT to the front and patio of my north-facing unit. And my unit is farther from the clubhouse/pool amenities, and in direct earshot of the car dealership loudspeaker system. All of these factors affect any appraisal for resale value and comparable sales. Therefore, based on this information, I am requesting that my appraised actual value be adjusted to $127,255 for June 30, 2002. Thank you for your consideration of this matter.
