HomeMy WebLinkAbout20030549 RESOLUTION RE: GRANT COUNTY DANCE HALL LICENSE NUMBER 301 ISSUED TO RJML, LLC DBA LA MARAVILLA- EXPIRES DECEMBER 31, 2003, AT 12:00 MIDNIGHT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, RJML, LLC, dba La Maravilla, presented to the Board of County Commissioners an application for a County Dance License to hold public dances at the location described as follows: 13015 Weld County Road 16, Fort Lupton, Colorado 80621 WHEREAS, said applicant has paid to Weld County the sum of TWENTY-FIVE AND NO/100 DOLLARS ($25.00) for said Weld County Dance Hall License, and WHEREAS, having examined said application, the Board deems it appropriate to grant a Weld County Dance Hall License to RJML, LLC, dba La Maravilla, subject to the following conditions: 1. Prior to issuance of the dance hall license, the applicant shall provide to the Clerk to the Board, a traffic plan approved by the Weld County Sheriff's Office, addressing entrance into, and exit from, the liquor licensed premises onto Weld County Road 16 and U.S. Highway 85. 2. The Dance Hall portion of the liquor licensed premises shall be limited to 350 persons anytime the licensed premises is open for public dances, and WHEREAS, said license shall be issued upon the express condition and agreement that the public dances will be conducted in strict conformity to all laws of the State of Colorado, and any violation thereof shall be cause for revocation of the license. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Dance Hall License Number 301 be, and hereby is, granted to RJML, LLC, dba La Maravilla, to conduct dances at the hereinabove described location. Any person,firm,or corporation desiring such license shall make application therefor in writing to the board of county commissioners of the county in which such public dance hall, booth,pavilion, or other place is proposed to be located. Such application shall state the name and address of the applicant, if a person, the names and addresses of all the persons composing the partnership,if a partnership,and the names and addresses of the officers and directors of the corporation, if a corporation, a full description of the place and premises at which it is proposed to conduct and carry on such public dances, and the term for which such license is desired. The board of county commissioners has the authority, within its discretion, to grant such license to such applicant for the current calendar year or part thereof unexpired upon the payment by said applicant of a fee of twenty-five dollars to the county treasurer. Such license shall authorize the person, firm, or corporation receiving it to operate, conduct, and carry on a public dance hall, booth, or pavilion at such place for the term from the date of its issue to the end of the current calendar year for which it is issued. This article shall not apply to incorporated cities and towns." C.R.S. § 12-18-103, states: "The board of county commissioners issuing such licenses has full power and authority, at its discretion, to revoke and cancel any license issued by such board under this article whenever such board, by proper resolution, determines that the public morals or public safety or public health of the community requires such revocation or cancellation." C.R.S. § 12-18-104,states:"Any person violating any of the provisions of this article is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than twenty-five dollars nor more than three hundred dollars for each offense,or by imprisonment in the county jail for not less than ten days nor more than thirty days for each offense,or by both such fine and imprisonment." That the dance hall portion of the liquor licensed premises shall be limited to 350 persons anytime the licensed premises is open for public dances. 2.
