RE: GRANT MOBILE HOME PERMIT, ZPMH #2413 - DAVID AND CAROL HYETT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County,Colorado,on the 8th day
of November,2004,considered the request of David and Carol Hyett, 15225 Weld County Road 49,
LaSalle, Colorado 80645, for a mobile home to be used as a Temporary Accessory Use During a
Medical Hardship, and
WHEREAS, said mobile home is to be occupied in the A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot 23 of Milton Lake Estates, First Filing; being part
of Section 13, Township 3 North, Range 65 West of
the 6th P.M., Weld County, Colorado
WHEREAS,the Board of County Commissioners, having heard all of the testimony, finds
that said request should be granted subject to the following conditions:
1. The existing septic system(SP-0300258)is permitted for three(3) bedrooms. Any
existing septic systems that will receive additional hydraulic load will require an
Individual Sewage Disposal System(I.S.D.S.)evaluation prior to the issuance of the
required septic permits. In the event the system(s) is found to be inadequate, the
system(s) must be brought into compliance with current I.S.D.S. Regulations. As
an alternative,a new septic system may be installed for the proposed mobile homes,
and a Weld County Septic Permit will be required. Evidence of approval from the
Department of Public Health and Environment shall be submitted to the Department
of Planning Services.
2. Prior to the occupancy of the mobile home, the applicant shall finalize the Building
Permit for the mobile home.
3. The mobile home shall not be occupied until such time that the applicant has
complied with Conditions #1 and #2 stated above.
4. The applicant shall submit a statement of an exit plan acknowledging that the
temporary permit shall cease to exist at any such time as the mobile home is used
for other than the permitted use. Such statement shall include a detailed plan for
removal of the mobile home upon expiration of the permit, or at such time the permit
is not renewed by either the Department of Planning or Board of County
Commissioners, the applicant will have 30 days to put the exit plan into place.
5. All zoning permits for mobile homes during a medical hardship are temporary. Such
permits shall be subject to review annually on the anniversary of the original permit's
issuance. Such permits shall be extended only if the use continues to be in

conformance with the criteria set out in Section 23-4-180. Any permit for a medical
hardship use shall automatically expire,and the mobile home shall be removed upon
cessation of the medical hardship or at any such time the mobile home is used for
purposes other than the permitted use.
5. The applicant shall submit documentation to the Department of Planning Services
by October 1st of each year describing the status of the medical hardship. This
permit is temporary and shall terminate once the medical hardship ceases to exist,
at which time the applicant shall have thirty (30) days to remove the mobile home
from the property.
6. The applicant must obtain a Building Permit for a mobile home and must comply
with all installation standards of Chapter 29 of the Weld County Code applicable to
mobile homes.
7. All proposed or existing structures will meet the minimum setback and offset
requirements for the Zone District in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured
from the future right-of-way line.
8. Any future structures or uses on the site must obtain the appropriate Zoning and
Building Permits.
9. Weld County Road 49 is designated on the Weld County Road Classification Plan
as a major arterial status road, which requires 130 feet of right-of-way at full build
out. There is presently 60 feet of right-of-way. This road is maintained by Weld
County.
10. The applicant shall use the existing access to this parcel, no additional access shall
be granted.
11. Should noxious weeds exist on the property, or become established as a result of
the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County
Code.
12. The applicant shall maintain compliance with Section 23-4-180 of the Weld County
Code at all times.
13. The mobile home with VIN#VK1108 shall be removed from the property within thirty
(30) days of the date of this Resolution.

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the request of David and Carol Hyett for permission to place a mobile home
to be used as a Temporary Accessory Use During a Medical Hardship on the above described
parcel of land, which was found to be in compliance with Chapter 23,Article IV, Division 3, of the
Weld County Code, be, and hereby is, granted subject to the hereinabove listed conditions.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by

The Department of Planning Services' staff has reviewed this request and recommends that this
request be denied for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-4-180 of the Weld County Code, as follows:
a. A medical hardship exists in which the person to be living in the mobile home requires the
supervision and care of those persons residing in the principal dwelling unit on the
property (or the reverse). Documentation of the medical hardship shall be established in
a letter from the subject's medical doctor or other evidence deemed suitable by the
Department of Planning Services. The letter shall be submitted as a part of the zoning
permit application and shall verify that the subject is physically impaired and requires full-
time care.
The Department of Planning Staff reviewed the information provided by the applicant,
and concurred that an additional home is not justified as full time care is not required. A
letter from Dr. James Meyer with Platte valley Internal Medicine & Pulmonary has stated
that Mr. Hyett has had triple bypass surgery in the past and should not be doing
excessive lifting or overly strenuous activities. A letter from Dr. Rosemary Cushman with
Kaiser Permanente states that Mrs. Hyett has osteoporosis, crohn's disease, and asthma
and also should not be doing any excessive lifting of heavy objects.
{ This application if approved, will correct a portion of the exiting violation (VI-0400144). However, if for
any reason, this application is denied, the case will be scheduled within approximately thirty (30) days of
"denial"to proceed with the Violation Hearing process.
Should the Board of County Commissioners approve this request, the Department of Planning
Services' staff recommends the following conditions be attached:
1. The existing septic system (SP-0300258)is permitted for 3 bedrooms. Any existing septic
systems that will receive additional hydraulic load with require an I.S.D.S. Evaluation prior
to the issuance of the required septic permits. In the event the system(s) is found to be
inadequate, the system(s) must be brought into compliance with current I.S.D.S.

To Whom It May Concern:
We are requesting a medical hardship for us,Dave and Carol Hyett, because we are
professional horse breeders and we require our daily help with our land, house,and
livestock. I have problems with my heart and can no longer do the work the horses
require daily. My wife, Carol has osteoporosis and Crones disease and can not do the
work either.
We purchased this property because it had two dwellings, but was obviously improperly
done. Both our families are willing to do whatever we need to do in order to make this
work. The reason we need to be able to have two mobile homes attached to each other is
because James and Chantel Hove are our daughter and son-in-law and they run a foster
home and need the more room for the children. Not allowing us to have two mobile
homes would be asking them to not be able to have their children,which would not be
possible because they love their children. Both mobile homes will be completely
moveable with no difficulty. The mobile homes will be fixed up and made to look very
nice.
We are all good,honest, helpful and quiet people and will be a good addition to the
community. We will continue to improve and build a nice and working ranch. In time,
people will enjoy to drive by and see this ranch.

Both trailers would only need to have the tong bolted on which is underneath the trailers.
The skirting would need taken off,remove the tie downs, disconnect the sewer and
electric, and then each mobile home is able to be pulled out in just a short amount of
time.

The Weld County Public Works Department has reviewed this proposal. Our comments and
requirements are as follows:
COMMENTS:
WCR 49 is designated on the Weld County Road Classification Plan (FHU) as a major arterial
status road, which requires a 130-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK
in the Weld County Code, Chapter 23, Article Ill, Section 23-3-50, the required setback is
measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The applicant shall utilize the existing residential access to this parcel.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
No new private residential accesses shall be allowed onto roadways classified as arterial. A
parcel shall share the access point already in existence. Access to new parcels may be
obtained by a mutual reciprocal easement across the involved parcels. To connect with existing
points of access or by connection to adjacent public non-arterial roadways. (WCR 49)

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. All septic systems located on the property shall have appropriate permits from
the Weld County Department of Public Health & Environment. The current septic
permit# SP- 0300258 is permitted for 3 bedrooms. Any existing septic system
that will receive additional hydraulic load will require an I.S.D.S. Evaluation prior
to the issuance of the required septic permit(s). In the event the system(s) is
found to be inadequate, the system(s) must be brought into compliance with
current I.S.D.S. regulations.
As an alternative, a new septic system may be installed for the proposed mobile
homes, and a Weld County Septic Permit will be required.
